I don't think either side is calling Dan. As much as I want to see him hit the stand.... I don't think either side will call him... it's unfortunate, I wanted to see him squirm. JMO
I think it would be more like calling DK could backfire in ways they wouldn't want, IMO.

I don't see why the DT has chosen this course of action. IMO, there appears to be very little downside for the defense in subpoenaing DK to testify. Perhaps, he can't be found?

Something drastic happened for Merritt's bank to have closed his bank account in November 2009, which is when he moved out of his house into an apartment also. That seems to coincide with the timing of the arguments at Metro.

IMO Because the State is using money and Merritt being cut from the business as a motive to kill Joey and the family, it's only right that others with those same motivations should be examined.

Whether Dan did or did not do this, LE did not investigate Dan in this regard, even with the knowledge that Joey was cutting Dan out (from Susan and from McG) and whether Chase was or wasn't being cut out seems to be up for debate IMO. Dan's paypal and bank records were subpoenaed by the defense, the lawyer that dealt with the sale of EIP was questioned and subpoenaed by the defense. THIS is the defenses defense in this case, that they focused solely on Merritt and made the evidence fit to their theory and ignored all others. Now, I know I'm going to hear 'but he was in Hawaii and it was verified'... my answer to that is, how? what verification was used? It wasn't the paypal records because they just got those 2 weeks ago. And it would not be the first case where a suspect "appeared" to be somewhere that they weren't, or the alternative that they hired someone to do it while they alibied themselves elsewhere. I'm not saying that is the case, but I do not see that they ruled that out either, and it does appear that Dan profited more by the family disappearing than Chase did. ALL JUST MY OPINION!
BBM, I would take the testimony of Joey's mother in that regard as not being disputable or up for debate. Joseph McStay was her son that she had spoken with. It is legit and testified to in a criminal proceeding.

This "forensic accountant" for the defense is a LIAR. When he knows the true answer is not one he wants to provide, he diverts and tries to cloud things up every time. Wonder if he has any political motives in SB County.

It really annoyed me when he spent an hour setting out a multi-year course of business with every cost and payment documented for every job, then completely "forgets" to mention that a couple of days before Joey is murdered someone started deleting the cheques in QB etc

you just know if he was being paid by the state he would be all over that as suspicious - its precisely what you look for - departures from the established course of dealing

I'm just glad their accountant is done. His bias was blatantly obvious.

It creates the classic cut throat defence - one of the most dangerous situations of all.

And worse, dan isn't charged whereas Chase is - it creates the perfect incentives for Dan to implicate Chase in any way he can.

That would like lead to Chase needing to testify.

But your take and my take on that testimony IS different, so that would mean it's disputable LOL

IMO in statements from 2014, she told Hanke that Chase would be a part of Joey's new vision (one warehouse all under one roof)... that he was not going to be cut out and instead Joey would be adding welders in addition to Chase, not in replacement of. That was what she recalled and told LE in 2013/14.

Considering the amount of underwhelming testimony they've had calling various witnesses and that working against them, it would not be a good move. Since the defense has stated they'll wrap this week and a day and a half left to go, I really doubt he will be called.

Any lawyer in his right mind would advise DK to take the 5th, the only thing that could backfire is if the prosecution extends an immunity offer to DK. If this were to happen then DK could potentially implicate both CM and himself without concern for the consequences.

If you listen to SB's testimony she states it was a misunderstanding about JM adding more welders along with CM, and denied that the statement was correct. Joey definitely wanted to be rid of Merritt.

I agree, it doesn't look as though he's going to be called. Apparently, both the DT and PT are afraid of where it may lead, they must know something that we don't know.

Which was before Chase stole off Joey. So maybe that was the vision for awhile and Chase just couldn’t help himself.


He is just a con man at the end of the day and Joey wasn’t the first fool to swallow Chases lies.
