Lol. Everybody knows Kavanaugh doesn't have a pot to piss in so I highly doubt he's concerned about exposure to any civil liability. As far as any criminal liability goes I'm sure he knows if there was any evidence against him he would've been charged already.

BBM but unless I am mistaken, it has been the defense team that subpoenaed the financial records and bank records for Dan. Unless I have missed it? So that tells me that LE didn't even look into it. The kid sold the business and the "hinky meters" didn't go off prompting someone... anyone... San Diego... Dugal.... San Bernardino Sheriff dept... to look into the financial records to see what went where and how much Dan sold Joey's businss for??? That is just crazy to me. JMO

They've gone to another 30 minute recess. I just don't get it, they had 2 hours to prepare for Sgt Steers to ask him about the awning in the Mitchley video. Now they're not ready for the next officer.
I think Maline is doing the best he can under the circumstances. I believe these witnesses were McGee's. It's better than calling it a day (or week) they said Hanke wasn't available tomorrow.

Since we're not privy to all the records we can't know for certain what or who the State has investigated. They may have looked at DK and his financials years ago and cleared him of any wrongdoing. Unless he's called to testify we may never know the answers.

IMO, Maline is struggling. I foresee this being an issue in the future if the two timed felon is convicted.

I think the defense has been struggling...even when McGee *was* there. LOL

But does he have the option to not testify if he's been subpoenaed?
I suppose he could risk being in contempt of court. Depending on the importance of his testimony the judge may or may not charge him as it's at his discretion.

Well in their defense, look what they have to work with. I wouldn't want to be in their shoes.

If they had, they would have been part of discovery and would have been handed over to the defense IMO and the defense would not have had to subpoena them at all. We know that the PayPal records were only subpoenaed and received a few weeks ago, it was in testimony. I also recall Dugal specifically being asked if he verified with Paypal what Dan sent him in an email, Dugal did not and did not get any of Dan's records. He also was not able at the time to get any financial records because the family was considered "voluntarily missing" at that time. The lawyer that testified last week, was asked about LE contacting him, they did not IIRC.

How much of CMs financial records have been entered? Did they produce any of his business or personal tax returns, and 1099s?

The way I understand the discovery each side turns over the discovery each one plans to use in each one's case.

So it would be up to the defense to get DKs financial records since they were the ones going to use it in their CIC.

Ita! That's a bad mistake on the DTs part.

Imo, anytime an expert sidesteps or purposefully omits pertinent very important information it drastically effects their credibility.

He should have pretended he was a neutral unbiased witness.

Experts are not there to put a defendant in a better light. That's called being biased. They are to layout ALL the facts, and let them fall where they may for the jury to decide.

He started out that way, appearing unbiased, but then he lost it under MR's blistering cross. She is so smart and so organized and well prepared. She rarely puts a foot wrong. I hope she gets a bonus after this. MOO.

It's important to remember that this trial isn't over. Depending upon the outcome there may be future investigations. There is no statute of limitations on murder (or most crimes committed during a murder). I don't think anyone wants to be "sworn in" until this trial is settled. jmho

I'm in the Charles Merritt courtroom. Court has been on a long break to allow the defense to meet with Det. Henke. He is expected to be the next witness. Henke testified in the state's case.

Who's overall agenda? Do you really think anyone is going to take the time, money and effort to sue DK when they know the well is empty and probably always will be?
