Defense is almost finished.

Wow!!

ETA:

What points does everyone think the state made in its presentation and what points did the defense make?

What evidence did the state admit and what evidence did the defense admit?

I mean I know there's a lot but maybe someone is willing to give the highlights?

And after all the testimony that nails Merritt and they are worried about the truck this is not good imo.

IMO, the truck is small potatoes compared to the back dating and calling QB pretending to be Joey. I am hopeful they just want to be thorough.

IMO, if they bought into the alternative accounting theory, then the truck doesn' matter.

IMO, the jury believes there was some shenanigans going on, and CM was responsible.

Maybe, in all the time they have hanging around outside the courtroom they collectively write questions they'd like to ask the judge. I don't know if that counts as discussing the case.

Having been there "hanging around outside the courtroom" I can say, without a shadow of a doubt, I have not heard the jury discuss a single aspect of the case. What I have heard them discuss is where they want to go for lunch... who is going to drive... and what work is being done on someone's house.

MOO

That's right. I haven't watched but examples could be that the defense is trying to introduce hearsay or statements that lack foundation, etc. Or issues that have been deemed inadmissible during pretrial motions.

We have rule of law for a reason!!

This morning was a bit different lol I heard a lot of objections/over ruled.... objection/approach .... after the sidebar, the line of questioning continued, the Judge said can continue 'as discussed' or whatever... then.... objection/over ruled/ can we approach/NO... objection/over ruled/ can we approach/NO, a few were sustained or had to be reworded. I am guessing that is what the original poster meant by "what they were hiding". JMO

The rulings on the 3rd party culpability in this case are not really clear, the defense has been able to ask questions about the financials related to the 3rd party and the victim's business, and questions about where he was at the time of the murders... what LE did to verify, etc, but there are things they are not allowed to ask about, like his personal finances, his history, statements he made. They were also allowed to call an ex-gf of his who he had 'confessed' to late last year, but it doesn't appear that they are if they are finishing up soon.

Can you imagine the families going through all this again? Joey and Summer's families have gone through so much already.

It will be hard for everyone involved, esp. for families on both sides. As JM's brother said at the press conference:
"If it’s the last thing I do I wanna, I just wanna know ... that you know, ... when it’s over."

I wonder what the defense would do if they didn't have DK as their scapegoat? They'd probably try to hone in on another innocent person. Smh

What would the state do if they didn't have CM as a scapegoat? They'd probably try to hone in on another innocent person. Smh

#McStay - Defense will finish with Bachman at some point tomorrow and they will call their defense investigator. They still have Dr. Rudin who would likely be next week, but he's McGee's witness. The judge wants the defense to at least continue with those witnesses (cont)

Cathy Russon‏ @cathyrusson 9m9 minutes ago
#McStay - (cont) Judge says as far as the rest of the evidence if McGee and his doctor think he can continue next week then they will, if not they may have to talk about a continuance depending on predicted length of time.

I feel for him. Trials are intense and can ruin your health. Or make it worse.
Yeah, I'm willing to bet other attorney's can relate to this too! I don't think some realise just how stressful it is being a lawyer and how it can take take a toll on one's health. :(

I would think so, I wonder if the death penalty option being removed would make a difference?

Welcome!

From my understanding the death penalty option was voted in by CA voters at the ballot box. The majority still want it as an option.

What the Governor did was suspend all execution during HIS time in office.

I believe it would have to be put back on the ballot again for voters to decide if it is to be repealed or not.

Imo

As upset as the prosecution is about this, and other's... the judge pretty much said, if he forces the one lawyer to go on without the sick one, they will ask for a mistrial, and it sounds like he would grant it... so he said, it's either this or it's a mistrial and we do it all over again.
