Initially I thought there had been 6, but when the juror dropped out a week or so ago, I thought the judge (or someone) mentioned 4 alternates, so 3 left if that's the case.

Sorry! I was in a hurry so I didn't fully explain. In essence what that means is that if an attorney posits a theory in which a third-party is accused of something instead of their client, they have a privilege against a possible defamation suit. So they cannot be sued or rather, if they are they have a clear defense.

This privilege applies to other litigation scenarios as well.

From the passing out flyers to try to find them, in my town small town of Fallbrook, to the years and years of waiting and hoping they would be found.

I hate how the victims of this horrific murder take a back seat at Trial, and it's all about the defendant. What about the victims and their grieving families?
I am so praying for this farce of a trial to end soon and Pray for Justice for the McStay families.

I feel exactly as you do. This judge needs to be held accountable for the horrendous manner in which he has conducted this trial and for the outrageous antics he has allowed on his watch. From him making dental appointments during court hours, to having to pick up people from the airport to all the other personal issues he has chosen to deal with on court time. He has allowed entirely too many dark days, early conclusions, late starts and general tom foolery under his guidance. He has rewarded ill-prepared attorneys with even more down time and projected a lackadaisical attitude over a tremendously important proceeding. I feel the McStays will not receive justice because of this mockery of a trial. I surely hope his boss knows what has transpired in this courtroom for the last 4-5 months.

Kali, please know that your posts are appreciated and we miss your incite! I hope you take it slow, and be good to yourself.
You bring the "human" side to this tragedy which I forget about at times. Your posts ground me and re-evaluate my motivation for following this case.

It is a concern because in the Caylee case the jury was desperate to go home so they refused to find her guilty of even one of the several, optional crimes (various crimes and lesser includeds) that would have led to a penalty phase. Even child neglect.

They just wanted to go home.

Thank God this jury isn't sequestered.

I wholeheartedly agree here. Not so much about the judge's decisions or doings because he has demonstrated he's pretty sharp in his observations. It has been noted here that the dark days and durations are easier on jurors. It would seem this has been the case. These jurors are very attentive and not bored or uninterested. That might happen in a 9-5 monday thru friday schedule. That might be tenuous and mundane. That is also not what this family deserves for jurors to endure and become cumbersome. They actually have more time to reflect on the evidence and testimony and not be bogged down to the day-to-day testimony.

Your involvement is so appreciated and I wish I was with you on ground zero. This family deserves the best, and maybe this stop and go is the actually better, I don't know.

Merritt is down for the count.

It's absurd compared to other trials. e.g. we have had state witnesses coming back for days on end with meandering examination

Meanwhile I just watched a complex murder trial in South Africa and key witnesses get a couple of hours tops

There is no need for examination to drag on for days

There is no need to recall state witnesses for endless fishing expeditions with improper questioning.

I don't think any of it helps the defense case but I do agree with the court's decision that it should come in. Let them have their inconsistent statements and no grounds for appeal. IMO

I agree as to the 6th. I don't think the 4th should be allowed, but I guess the state will be able to point out differences

*Trial continues (Day 51) (@ 9am PT) - CA - McStay Family: Joseph (40), Summer (43), Gianni (4) & Joey Jr (3) (Feb. 4, 2010, Fallbrook; found Nov. 11, 2013) - *Charles "Chase" Ray Merritt aka Charles Ray Mandel aka Charles Ray Morritt aka Chase Meredith (57/now 62) arrested (11/5/14) & indicted (11/7/14) of 4 counts of murder with special circumstance; plead not guilty. DP case.
Trial started 1/7/19. Dark on all Fridays. 7 women & 4 men & 1 ? (alternates included 4 men & 2 women-minus one).

5/2/19 Day 49: Defense witnesses: Sgt. Daniel Hanke (re visit to San Ysidro). Sgt. Gary Hart (re home phones) & Sgt. Edward Bachman (re FARO scan & DK's alibi). Had only morning session. Trial continues on Tuesday, 5/7.
5/7/19 Day 50: Defense witness: Det. Edward Bachman Lead Investigator San Bernardino (asked about his investigation to verify Lavanaugh's alibi). Jury goes to early lunch. Before the jury was sent to lunch the judge addressed a request made by "several jurors" to see Merritt's truck in person. The judge is arranging for them to see it. Judge the defense and judge are in chambers with the court reporter. Maline asked the judge for an ex parte hearing & motioned that it may have something to do with McGee. Defense is asking for a continuance due to attorney McGee's "condition". Judge says as far as the rest of the evidence if McGee & his doctor think he can continue next week then they will, if not they may have to talk about a continuance depending on predicted length of time. Defense witness: Dugal. Trial continues on 5/8.
Tentative Schedule for week of May 6th thru May 10th: May 6th (Monday)-NO court-Judge not available. Court with jurors on May 7th (Tuesday), May 8th (Wednesday)-Defense expected to rest. May 9th (Thursday)-NO court (for a juror). Dark on May 10th (Friday).
Tentative Scheduled for week of May 13th thru May 17th: Closing arguments now expected the week of May 13th.
