#McStay - After the trial started, on Jan 15, 2019, Det. Smith took the keys found in Joseph McStay's pocket and tested them on the Isuzu Trooper. He said the key worked on the door and ignition.

They seriously waited until after the trial started and the Defense said it in their OS's?

I got company, so I have missed the testimony from the break until now. *sigh* Now I have to wait until they upload it tonight!

#McStay - McGee: Were steps taken by you to verify that he was in Hawaii? Smith: There were steps taken by the team. I did not personally verify it.

So basically DK was investigated and interviewed

#McStay - McGee attempts to ask several questions about Kavanaugh and money through Joseph's business. Judge sustains all prosecution's objections.

#McStay - McGee: Do you think you did everything you could have to rule out Kavanaugh being involved? Imes objects saying it calls for speculation. Judge sustains.

The different track widths prove two different grave runs IMO

It can't be that he just pulled out to find better ground

For me this is a curiosity of the case. Why make 2 runs?

I'm reading the posts and I didn't hear the testimony... but this is what I cannot understand lol I will have to hear the testimony for myself. But I can't see how 73 and 76" tire tracks can be from the same truck, and how it makes sense ...

I believe it had been raining the 4th/5th of Feb 2010. From my experience of off-roading in this EXACT desert area, we LOVED it when it rained. The sand/rock composition of the Victor Valley Desert would compact (harden) when it rained, rather than getting muddy. That meant MORE "grip" was available and it was easier to get traction in the sand.

One reason for possibly having a wider tire track could be due the weight of the truck. The heavier it weighed, the more "pressure" was placed on the tires. It is also a known fact that people lower their tires air pressures while traveling in sand to help "cover" more area, access more grip by lowering the tire pressure. JMO

This is the same reason why back home you drive on the beach within the tide line, on the wetter, packed sand ;)

#McStay - McGee: Did you subpoena Mr. Kavanaugh's bank records? Smith: No McGee: Did you follow up on a financial motive that Kavanaugh may have had? Smith: We followed up on Kavanaugh and determined that he was in Hawaii

This is the thinnest gruel

they have nothing on DK's involvement.

Because of two different runs.

Wet vs dry sand and possibly different weights.

Go drive your truck on the beach in wet and dry sand

You will get a perfect print in the wet sand

I get the same thing with the tractor - in very wet conditions - the print is a lot wider than the tire and raised. That is not driving on sand which is different. On earth, the boggy ground cannot hold the weight and spreads around the tire due to the very high weight.

As @Edmo correctly states, sand is different. Damp sand can better hold the weight. No different than if you walk on the beach from the dry zone into the wet zone.

are they done already today?

OK - I have to ask sorry. Why don't you use a normal hammer? :D I tend to use the back of a screwdriver or block of wood

Exactly - this is almost conclusive IMO

If they weren't killed at the house, how did wet paint get on the hammer?

Lol I really dont have an answer for not using other tools because I do have those available.

The small sledgehammer is in my paint tool chest along with all of my other paint supplies. Its just easier to use the small sledge than go out in one of our outbuildings to look for other tools.

I don't think I would have enough strength to tap the lid hard enough to seal the lid by just using a screwdriver.

If I cant find a paint lid remover when I need it I have used a screwdriver to pry the lid off of the can but never to seal it.

Quick question: what is the Sidebar that I hear about during the hearings?

I think I have maybe been misled by the term "sledgehammer"

For me a sledgehammer is the long handled tool that i use to break down walls. I know this one is short handled, but the weight of the head is not that much - i only just checked it in kg

The murder weapon seems to be in the range of what i would still term a hammer.

When counsel approach the bench to debate procedural points with the Judge

#McStay - Cross exam of Det. Smith. McGee: You didn't think it was relevant to test the key in the victim's pocket to the Isuzu Trooper? Smith: Because it was abundantly clear they didn't drive themselves to the desert, bury themselves, then drive vehicle back to the border.

Ha! It sounds like Dt.
Smith is no pushover and is not playing along with the defense games. Lol!
