I am fascinated by the following from the Search Warrants

The list of people who had access to the McStay house on Tues 8th is pretty small

A forensic examination was conducted on the computer hard drive belonging to Joseph McStay. The forensic examination was conducted by the Hi-Tech Crimes division of the San Bernardino County Sheriffs Department. The examination revealed that on February 8th, 2010, the internet to the computer was accessed and the address of 17037 Brookhurst Street, in the City of Fountain Valley. Investigators determined this location has a total of five suites and one of the suites to the location belonged to a former customer of EIP.

Another suite was occupied by T-Mobile, with a customer service center and sales department. Based upon my training and experience, I know suspects in murder investigations will take victim's phones in order to discard them or alter evidence within the phones that may incriminate the suspects. Cellular phones commonly known as smart phones, such as the Google phones owned by the victims, are typically password · protected which would protect a suspect from being able to access the phones. A way to gain access to the . CBS\J\I 1 4 - 1 5 9 3 phones is to take the phones into the cellular phone provider's customer which in this case would be a T-Mobile such as the one at 1703 7 Brookhurst Street, and have a store employee access the phones for them.​

As far as I can work out Chase had 5 missed calls from a number while he went dark on the 4th and that is the number he calls back at 9.30 ish

This is assumed to be Jarvis

On 6 feb he will call the same number from a tower 1.5k from the grave site

11:30, 11:31, 11:33, 11:34, and 11:52 am

Pretty huge IMO.

The trooper will be found the next day.

Found it. The wording of that is so odd.

The examination revealed that on February 8th, 2010, the internet to the computer was accessed and the address of 17037 Brookhurst Street, in the City of Fountain Valley

Internet to the computer... do they mean the computer accessed the internet? lol And then do they mean from the address of 17037 Brookhurst St.? The way it's worded does not make a lot of sense.

This is why overall i think the phone evidence does not support this theory

It seems far more likely he was calling her in a panic earlier and then she was calling him not knowing where he was

If they were in cahoots - this phone activity is really dumb
I think it's more likely he left his phone with a brother, I don't know how many brothers he had but I think a trusted family member would make the most obvious candidate to help him out, even if he didn't know the reason why he was helping him out.

The spoiler mentioned my prosecutor mentioned it during the time line on the 4th of Feb. 2010. I believe I was watching live.

It appears that the video footage shows a vehicle driving by but it was not the trooper because the exhaust pipe is seen on right hand side of the vehicle. Again another boondoggle. I see it that the only proof JM was home would be the futon cover.
seen at 26:00 on screen.


At the 58:30 mark, the prosecutor talks a about a “107 minute call to Quickbooks on 2/9/10 from someone claiming to be Joseph McStay, yet the call was made from the defendent’s cell phone.”
The prosecutor goes on with details about the call, but my mind is still blown. We’ve all been waiting for years to see the evidence against CM. It’s bone-chilling...and I find myself seeing CM as the monster that he truly is. He didn’t have the kill those sweet little boys. I know he didn’t have to kill anyone, but my mind always goes back to those little boys. It’s all senseless.

I think it's more likely he left his phone with a brother, I don't know how many brothers he had but I think a trusted family member would make the most obvious candidate to help him out, even if he didn't know the reason why he was helping him out.

Is it realistic a brother can be on the scene so fast?

As I understand it, someone googled that address from the desktop computer at the McStay house on the 8th

This is a pretty alarming piece of evidence IMO

Well I don't know where they live / work. I'm presuming Merritt went to him not the other way around.

That is a lot to do on the 8th then, taking the Trooper to the border in the am and accessing QuickBooks in the pm - not from the home computer.

From the OS :

On February 8th that’s the day the Trooper was towed from the lot in San Ysidro, from 7.26 to 1.31 am [should be pm] – at 7.26 the defendant has a cell phone connection to a tower in Rancho – after that his cell phone is not receiving or sending any messages so it’s either turned off in airplane mode or not connecting with any towers, from 7.26 am to 1.31 pm.

On February 8th again that’s the day the Trooper was found, at 1.31 when the defendant’s cell phone comes back on the grid, so to speak, it comes on at 1.31 he’s near the 91 freeway in the Corona area and then at 1.41 there’s a cell phone tower contacted on the northbound 15, in the Corona Norco area, 1.51 he’s even further north and 1.54 to 6.31 he’s accessing or sending a signal to towers near his residence.

On that date February 8th, Monday, guess what, QuickBooks is accessed.

At 2.20 pm a cheque is added to charles merritt all lower case, that cheque’s deleted, there is a 107 minute phone call to QuickBooks on Monday 8th. The caller identified himself as Joseph McStay the number he was calling from was the defendant’s phone number. There was some indication of cancelling a subscription, getting a new version, he tells San Diego investigators Joseph gave me his credit card number even though we’re two different companies and I don’t even do all his fountains, gave me his credit card number to get a new version of QuickBooks.

A cheque to charles merritt was created it was backdated to February 4th printed and deleted and was deposited on February 9th 2010. The two cheques to Metro Sheet Metal that were written on 5th and backdated to 4th those were held onto until March by the bookkeeper because they didn’t look right, it wasn’t like what she’d gotten from Joseph in the past.

I believe it’s an odd way of saying there was a connection between the internet and computer in which data was transferred.

So was his attempt to get into Joey's phone because he was identifying himself as Joey to QuickBooks and he didn't want to use his own phone to do that, but ended up having no choice?

What was your feel on the jury. More men/women? Younger/older? Did they seem engaged or bored? TIA!

What I found a little weird is that the jury had to wait in the hall with everyone else to enter the courtroom. They had their jury badges on so we would know not to approach them or talk about the case within ear shot. Of course the baliff was there the whole time. We had to wait an extra 20 mins because def. att. Maline was late.

Anyway...I got good vibes from this jury, including the alternates. Most seemed to be middle age (30-45) with a few older and a few younger. From what I could see of the jury box they were really engaged and taking lots of notes.

Maline has been late 3 times as I understand it. Terrible attitude. And I don't like him.

Re the 11:51am call to the bank. Do you think there will be a written record of JM’s call held by the bank confirming that he rang querying the missing amount? I really hope so...
I would think so if police were doing their jobs properly in searching for the family, they should have looked into every phone call that day to find out what was going on in Joey's life. Someone at the bank would have been digging around to get info on the cheque that Joey was querying, who it was payable to and where it was cashed.

That is a lot to do on the 8th then, taking the Trooper to the border in the am and accessing QuickBooks in the pm - not from the home computer.

Remember CM's interview with SDSD on the 17th, they asked him what he did on the 8th and he had to call his "wife". They couldn't recall him going anywhere. She was definitely complicit.

Also, according to court docs. one of CM's brothers had to submit to having his DNA taken. Defense had a motion to unseal that search warrant but withdrew it because the state said it was not going to call him as a witness.

About the Trooper. DuGal said they were able to get surveillance footage from several stores in that shopping center. Yet nothing showed up regarding the Trooper. Did CM just get lucky or did he know exactly where to park?

Back to Day 11 part 3: The bra evidence is being discussed along with slides. The prosecution gets permission to pass around the evidence and at the last minute adds exhibit #745. At about the 116:40 mark CM goes from watching the Jury pass around the bra evidence to looking up towards the big screen and visibly jumps (startled) and eyes get larger. He then is in a flurry of conversations with the attorneys. At the end of these convos, he suddenly seems to notice the camera is on him, and he quickly turns around and starts writing on his pad.

So, it appears that whatever is on the screen spooks him. Alternatively, it could have been some personal revelation, but the jump was quite noticeable, so I'm thinking that while the jury is examining the evidence the prosecution puts up #745 or another slide or he sees something on the bra evidence slide that startles him. The court is recessed for a break a few seconds later. Day 11, Part 4. After the break, the line of questioning is about the keys found in JM's left pocket and one key discovered in his right.

It seems to be a really important "tell," but what caused it?
