#McStay - Court will resume around 9:30am pst/12:30pm est. Today is day 12. Charles Merritt faces the possibility of the death penalty if convicted of the killings of his business partner Joseph McStay and his family.

This lady testified there were issues getting the fountains and CM was asking for additional money and CM asked for money to be wired to his wife!

Did anyone get a pic of the invoice? Nevermind, I just saw it ... will have to go back and listen to this testimony again. It seems like the pro's are trying to say the money went to Chase, the defense is saying it went to Dan? I am only catching the end of this ... lol

The Pros asked the older gentleman from Geis about suing CM for the $4k loss and he immediately said, "no." Even he was tired of dealing with CM and cut his losses.

Morning Break....

Okay, so what I got from that testimony is this...

on 2/2/10 an estimate was sent to Geis construction, requesting that 50% of the balance is to be paid first, which was $6250.

On 2/19/10 Geis Construction paid $6250 to EIP

Somewhere along the way, the balance was paid, $6250. No one can say where it was paid to? But the defense implies it was sent to DK.


In May...
$2000 payment made to CJ, as per CM's request
$1950 payment to Walker Sheetmetal as per CM's request

and later in May or June
$4000 payment to CM

The judge asks the witness about payments, this is what he says:

6250 deposit to EIP
2000 payment to CJ
4000 payment to CM
1950 payment to Walker sheetmetal

The defense then asks again if his understanding was that the full $12500 was paid before the cheques to CJ/CM/Walker. He says yes, doesn't know where that second $6250 went though.

I am not sure, I know that his daughter has been at the trial, the L&C reporter that is there has tweeted about her and said that she's a nice girl or something like that. Maybe someone else knows their ages?

I should have also added to my last post that when the prosecution was asking him how much he had spent on the fountains, he did say $6250 + 6250 + 2000 + 4000 + 1950 + the electrician + the plumber + cost to travel to pick them up + time

The pro's want to show an exhibit, through a detective, that show's money went into DK's account and it was transferred to CM right after.

The defense is saying that they should be allowed to, that the witness isn't an expert.

Pro's and judge saying that it's already an exhibit and it's admissible.

Seriously... why didn't they just have an accountant testify to all of these transactions... this seems like such a waste of time JMO

Bringing the jurors back in... sounds like the judge is going to allow the state to show a document that shows payment was made to DK, but DK paid CM? Not sure, will have to wait to see it.

This is a document that the defense used with the last witness to help him recollect where the 2nd payment of $6250 went.

CM is a professional con. His numerous times in jail and prison just helped him hone his skills. Incarceration can be spent learning how to better your crime skills or rehabilitate you.
From what we're seeing from the witnesses, CM could baffle EIP clients (and anyone else) with BS.

I'm wondering if CM was pissed that HE was not being made a partner in the business when Joey bought out DK? CM makes it sound like he was THE major contributor to the business when talking to the Detective, but I really don't see him doing anything but piddly electrical and plumbing, and even THAT is sub par or incomplete.
