She lived in San Fernando Valley at the time of the murders.

Didn't she live in Corona at the time of the murders? Isn't that where Chase went by to talk to her?

The AT&T guy said that if a call is made to a phone that’s turned off and a voicemail is left, the voicemail is saved directly to the AT&T server with no record of where the receiving phone was located. A followup question was then ask regarding what would happen in the same exact scenario except the receiving phone is on, but not answered, his reply was non-responsive, leaving the question unanswered.

I always thought that cell phones, even turned off, would still ping from tower sites? The FBI "cell tower expert" has yet to testify. I'm wondering if he will have MUCH more info about CM's whereabouts after investigating his cell phone/tower records?

I thought the only way a cell phone would not ping was if the battery or sim card were removed?

Your right, I was guessing. At some point for a duration of about 20 minutes between 3 and 5:45 I think his phone was dead and charging. During the landline call, wasn't he on the phone with Chase? So he didn't answer the landline call which is probably why it didn't register. At 4:27 he listens to the VM. I think it's for 2 or 3 min? I don't have access to the record right now. Strange he didn't call back.

There is no other cell data overlapping the 4:25, so we just don't know yet...

It could be that the 4:25 is wrong?

A good prosecutor will take all those "ripped Joey off" statements and the fact that he kept doing business with Chase, and paint a picture for the jury during the closing arguments (is that what it's called?) Anyway, the prosecutor's summing up everything for the jury -painting the picture- is so important. If he does his job in this case, it will be: "Joey was a good guy and knew Chase had some financial challenges, as well as the fact that Chase generally did good work, so Joey overlooked a lot.

The breaking point came, though, when Joey realized Chase was actually forging checks, and the "ripping off" became outright theft, to the tune of thousands of dollars. Joey had reached the point where he could no longer be the nice guy, and something had to change. He told Chase the gravy train was over and Chase, realizing it was finally so, exacted his revenge"... He has to walk the jury through it, step by step. We shall see if he can do it.

I don't mean to sound like this is news to anybody here, I guess I'm just thinking about how I want this to go. How I hope this goes.

Also, in the Prosecutor's OS, he said CM owed JM almost $43K at the time they were killed.

If I was a juror I would not be relying on Carmen's memory to say he went into MSM during the morning - she was unsure and had no reference point to make it a stand out memory, like it happened before such and such happened. She had to have her memory refreshed several times.

It's most likely he was south of Azusa (MSM) on Monday morning given that he was over 30 miles away at Corona and heading north at around 1.30 pm. That suggests he was south of Corona before his phone came back on.

The clearest evidence of when he went to the border is when his phone wasn't connected to any towers - from 7.26 am. Unless he went to MSM before setting off on his journey south.

In several cases I've followed when the jury spoke afterwards they said on the witnesses that had difficulty recalling what had happened they decided the best thing for them to do is look at their original statements when all of the information was current and fresh in their mind at the time which makes a lot of sense.

I think this jury will do the same.

Yes, his cell was off for 6 hours 7am-1:30 pm when it "pinged" in Corona, Ca.

I think it's VERY important to distinguish between the phone being off/in airplane mode/out of range and it being inactive.

IMO It doesn't guarantee that his phone was on, but it also doesn't show that it was off. I notice that the prosecutor is careful in his wording as well, he will say 'not active' or 'no activity'.

I have included screen shots as well. The first one is from the 4th, it shows the calls going to VM where his phone is off/in airplane mode/ out of range, and it also shows the no activity from 9:32pm -7:00am on the 5th.

The second one shows that on Feb 8th, he had one call at 12:34pm that went to voicemail because his phone was off/in airplane mode/out of range. There was no activity between 7:36am and 12:34pm, so I am not sure how they would be able to tell exactly when it was not connected.

If he was pinging elsewhere by 1:30ish, how long would it have taken to go and drop the Trooper off and get back by that time? It's possible Carmen did see him early morning Monday and then he left. She said often he was there before she got to work at 8am.

And this is the way CM decided to repay Joey for his unbelievable kindness.

Due to CMs notoriously bad reputation I would bet there was no one else that would even consider doing this for THIS man.

It truly is a sad case of such betrayal.

It was never enough for CM. Joey had already loaned him 43k, but he wanted more so he took it by then stealing from the very one who had already helped him so much.

It would also depend where the Trooper was parked/driven from as well. You could make a 6hr round trip to SD and back to Corona area, IMO.

A few other screenshots I grabbed of Joey's phone records from the 4th showing his internet activity.

We can see that he was accessing web pages during the time he is reportedly with Chase at Chick-Fil-A.

Another thing I noticed (not all in these screenshots). His phone accessed the internet at 2:35 4:35 6:35 8:35 10:35 and 12:35. Just speculating, but I think his phone could have been checking for emails every 2 hours? It's the only thing I can think of that would check that often and would show a connection to the internet.

6 hours????? geesh, I didn't think he needed that much time. And that's not including how he got back? I was thinking a few hours. I need to go see if we know where his phone pinged at 7 that morning.

I have to go visit my friend google maps lol

Ah, so perhaps it wasn't answered and no message left so it doesn't show up?

OK, trying to understand this. How did LE know about the call if it didn't show up on Joeys log?
Does it show up on CM's as a MISSED call?

Yeah, a fully bogus story but not intentional. That was really a strange thing, including the date exact or almost exact of the day the remains were discovered IIRC.

@fridaybaker, I know you've been around since the early days, I wonder where all the old stalwarts @liz b., @OldSteve, @McSpy, @white rabbit, @panthera, @krista, @Nancy2441, @TLS51, @Woe.be.gone, @SherlockKittyCat , @TerriM, @gitana1, @tripleB, @Illuminada, @Isabellnecessary, @Seajay and @bessie??? So many had invaluable input over the years and sadly I don't see many around that had followed this case from the beginning.
Agreed. Missing all the old stalwarts. Just not the same, IMO. So much is lost this many years out. Seems like yesterday that the defendant was looking for a speedy trial due to his imminent demise. Can only imagine how the family feels.

This was a call from the house phone to Joey's cell phone which pinged in Fallbrook.

We discussed the lenghth of her drive to get into Fallbrook to pass out the flyers.

Didn't she live in Corona at the time of the murders? Isn't that where Chase went by to talk to her?

Add another 15 minutes to get to the border. I drive monthly from Fallbrook to the san San Diego airport. On a good day, it takes me 1.05 hours. On a bad day, up to 3 hours in either direction.

From Fallbrook to San Diego takes about an hour, less if you are going with the traffic flow. People usually drive around 80mph down the I-15 and I am not joking. It would also depend where the Trooper was parked/driven from as well. You could make a 6hr round trip to SD and back to Corona area, IMO.

I remember the location Tom's Farms from somewhere on my travels here. I don't know if that's where she lived in Feb 2010?

ETA: Just found this in the OS -

In 2010 they lived in a town called Fallbrook. They moved into the residence in November of 2009.

Prior to that the family lived for a brief period of time with Joseph’s mother Susan Blake, in the Tom’s Farms area just south of Corona.

The network probably looked for the phone at the last known tower but couldn't find it for some reason

I've just replayed the beginning of Susan Blake's testimony, she lived in a place called Trilogy of Glen Ivy, South Corona when Joey and family moved from San Clemente to stay with her for a few months in 2009 before they moved to Fallbrook. They were in Fallbrook for Thanksgiving.
