The defense is going to have to call CM to the stand to explain WHY CM called JM and vise-versa after all this check/call/check/call stuff.
I'm starting to wonder if they are considering it LOL

Nowwwww if that's the case I think @JMarsh should have to buy is ALL popcorn! LOL
 
It doesn't mean it wasn't though. I have been waiting to see this QB info and even the cell phone activity to see "patterns".... these, IMO, are patterns.

A 'pattern' can be deceptive though. If Joey has a history of calling Chase a dozen times a day, then it doesn't mean it is a pattern that it happens right after chase is creating checks, if that same amount of calls comes in when Chase is NOT creating checks too.

And sure, it doesn't mean Joey was NOT discussing the checks. But there are other things which make that seem improbable. Like the coincidence that it happened right when the family vanished. And the improbability that Joey would want to give Chase access to his QB account and allow him to sign his name and write his own checks.
And the strange backdating and deleting--which makes no sense in accounting for those funds. And that Chase had previously had no explanation for the backdating and deleting. And if Joey had told him to do so, he would have explained that at the time of his LE interviews.
 
McGee is asking questions... that are getting sustained... but is asking about if Joey told McGyver that he was finally rid of Dan on Jan 31st/Feb 2nd. McGee implying at that point, Joey may have changed where he was doing his book keeping...

Yes call came in 11 minutes after cheque created according to this:

Joey would still be alive. He never knew then he would one day have a defense lawyer claiming on his behalf that the family was still alive on the 5th.

Ok, but if the family was still "alive" on the 5th, why would he back date the checks? Without the audit, the checks would have been taken at face value, ie., the checks were written on the 4th. But WITH the audit, it clearly shows the checks being post dated from the 5th.
HOW does CM explain THAT?

Feb 1st (sorry, didn't get the details)

9 min 56 sec. Joey/Merritt (I believe during the time that the cheque was created and around the time it was deleted)

after the cheque is deleted another call.

I can't believe he actually said: "It doesn't look suspicious now, does it" to Hanke so the jury could hear that. The Judge should have REAMED him for that, IMO. Judge Smith is a push over.

But that does not mean that the creation of the checks had any connection to the calls. We might also say that Joey called Chase right after Chase used the bathroom, or after Chase let his dog outside---but it wouldn't necessarily mean there was any connection between the events.

I think the re-examonation is showing that now, by showing ALL of the calls made between the 2 of them, many when there were no checks being created.

But you'd have to believe Joey was psychic or could see what Chase was doing to decide to call him at that exact time.

ok wait? what? LOL They happened at the exact same time. So either they were doing it "together" or Chase was doing it while talking to Joey on the phone without his knowledge (in the case of the first one) One of those is true.

I get that they had lots of calls between them, but it's VERY coincidental that calls are going on during or shortly after EVERY QB activity is done.

By the sounds of it the judge has forgotten his warning that he would cite them for misconduct in front of the jury if they continued pursuing previously determined disallowed lines of questioning. It's beyond a joke. It never was a joke but it is playing out like one in that courtroom IMO.
 
If I was just getting off probation, and had a history of arrests for theft etc, I would keep a letter or a text or an email, from my boss, giving me his permission to create checks from his account, made out to me, for me to cash.

I am surprised that Chase didnt have some kind of written instructions, on the computer or the phone or by notation somewhere, about what Joey asked him to do.

If I asked an employee to call Books and change over my account, and delete the old one, I would give them important instructions and necessary passwords etc. It didnt seem that Chase had any of that. JMO
