I hope too much emphasis is not placed on this aspect.

To me the paint on the sledgehammer and bra and the painters tape, taken together seem strong


I am sure the Defense will argue over paint on Summer’s bra as she could of easily of knocked the wall when walking around the house getting ready for bed. Also if the sledgehammer belong to the McStay (we don’t know if it did) then paint again doesn’t prove anything more than the family was decorating.

As I recall, McGyver originally had said that he saw Susan cleaning the paint tray and was surprised that there was no foil lining the paint tray as he had previously advised Summer to do so for easier cleanup. The discrepancy could be attributed to erroneous recording, or misunderstanding re: Susan cleaning and his noticing the paint tray. But what is weird to me is that originally the whole point was that there was no foil lining in the paint tray, alluding to the possibility that someone other than Summer had used the paint tray. Now we hear that he actually saw the paint tray and it WAS lined with foil, with dried paint inside it. Which I don't see as alarming at all, she had two small kids and could have been distracted and forgot to clean up the foil. So I don't know what to make of this. Would Chase have bothered to line the tray with foil?

they were already, that Joseph Sr.'s, mother, Susan, and

Summer's mother, Blanche, had already started to clean up the

house because they felt that the family was still going to come

back.

He said that he quickly started taking mental snapshots

of things he noticed around the house. And said he believed

there was a futon cover for the futon in the downstairs living

area that was missing.

He said that another big thing he noticed was the paint

trays that were downstairs. Susan was washing paint out of

there. And McCarger believed that was suspicious, because

during the time that he was painting with Summer, she complained

about having to clean up afterward. So, he showed her how to

foil-line the paint trays. And he said it was -- generally
Summer would just have to wad up the tinfoil and throw it away,

instead of having to scrub the paint trays as Susan was doing.

Thanks for the info. I wondered if it was a reporting issue.
It appears that it was available but LE's requests to save wasn't expedient so it was purged. I believe it's normally 90 days with most carriers before it's purged.

IMO
The paint on the bra was described in the opening speech as a drip going sideways, indicating that Summer was lying down when the paint dripped.

I love how McGyver had more forsight than the Susan. No doubt evidence would of been lost because of her need to clean.

#McStay - Defense shows photos of what appears to be the futon covered folded on top of the dryer. These pics don't show it (my screenshot) but when zoomed in you can see a zipper and woven material. Remember, Summer's mom did laundry at some point.

Now redirect, and they are asking him if he recalls saying he thought something looked repainted, he says 'not exactly'?

dang feed went on me!

If the prosecutions theory was that CM painted over any blood, they maybe should have made sure with their witnesses! JMO

Right! Thanks for that info! That is my understanding as well.

Until reading the transcripts, I thought they had all that info, but they don't. So when there was gaps, it doesn't mean for sure that it was offline, just that he wasn't getting/receiving calls. Only when he was getting calls and had it turned off will we know that it was off/airplane mode/out of range. And for that info I would have to go back to the transcripts, but IIRC it was "off" on the evening of the 4th.

Someone can correct me if I'm wrong, but I do believe the prosecution used that to connect the house to the McStays to connect CM being there, it was part of their "confirmation bias" stuff in the OS's. It turned out it was not the futon cover wrapped around Joey, it was a blanket.

It certainly seems like both Susan and MM were anxious to disturb the crime scene and make apparent to others that they had permission from LE to do so.

There has been so much controversy over that futon cover over the years! If I understand correctly, it now appears that it was *not* the futon cover that Joseph was wrapped in, but rather a blanket? I haven't had time to go back and listen to everything yet...

Did the defense note a date as to when that photo was taken, and by whom? I wouldn't assume that family had handled the futon cover, maybe the kids spilled something on it and Summer threw it in the wash and just hadn't had a chance to put it back on yet. I'm trying to remember, when LE first arrived at the home, I know they mentioned noticing the bowls of popcorn on the futon but did they notice whether there was a cover on the futon or not.
