A 12-day preliminary hearing for two men accused in the 1996 disappearance of Cal Poly freshman Kristin Smart will move forward next month, a judge ruled Monday in San Luis Obispo Superior Court.

But Superior Court Judge Craig van Rooyen said the hearing will not be live streamed, and media coverage will be limited.

San Pedro resident Paul Flores, who is charged with murdering Cal Poly freshman Kristin Smart, appeared in San Luis Obispo Superior Court on Monday via Zoom.

*Pre-Preliminary Hearing for both (@ 1:30pm PT) - CA - Kristin Denise Smart (19) (missing May 25, 1996 while walking back to her dorm from a off campus frat party at Cal Poly, reported missing on May 26, 1996, San Luis Obispo) - *Paul Ruben Flores (19 @ time of crime/44) arrested & charged (4/13/21) & arraigned (4/15/21) with 1st degree murder. Plead not guilty. No bond.
*Ruben Ricardo Flores (55 @ time of crime/80) arrested & charged (4/13/21) & arraigned (4/15/21) with accessory to murder after the fact. Plead not guilty. $250K bond. Has posted bond, out of jail.

5/17/21 Update: Had pre preliminary hearing. Will be back before a judge once more on 6/21/21 before the preliminary hearing is set to begin July 6. It’s expected to take 12 days and will be an opportunity for both sides to present their cases before the judge, who will decide whether there is enough evidence to move forward with the charges against the pair. Prosecutor Chris Peuvrelle also stated before the judge Monday that additional discovery would be presented.
6/21/21 Update: Paul & Ruben Flores appear virtually in court with attorneys for a pre-preliminary hearing. Judge likely to decide if cameras will be allowed in the courtroom moving forward. An attorney representing NBCNews & KSBY is arguing a motion to allow audio & visual recording of the case. He says it would allow people to see/hear & understand the criminal justice process in such a high profile case. Robert Sanger, Paul Flores's attorney, objects & is asking for no cameras in the court saying there is no right to cover it in that way. Judge van Rooyen says preliminary hearing will not be livestreamed & rules that no cameras will be allowed in the courtroom. His reasoning is to have a "fair jury" & to protect potential trial witnesses. Still photos & video are allowed, but no filming of witnesses or audience & no audio. Judge van Rooyen also issued a gag order. Prosecution has requested another pre-preliminary hearing to be held 6/23/21. Preliminary hearing set for 7/6/21 for 12 days.

It's angering (toward the suspects, not LE) that LE still hasn't found Kristin yet, even though they said they had an idea of the area she was moved to.
I'd hoped they would have been able to before the trial, maybe with the help of dogs, etc. It must be a large or difficult area. So maddening, and I wonder the liklihood now.

Yes, it's concerning that they still haven't found any remains yet & the fact that it took 25 years to arrest PF/RF for this crime.

Was the "trace evidence" (if that's the right terminology) that KS was buried at the various properties enough to give the authorities justification to arrest PF & RF, or was it something else?! In other words, I hope that the evidence they have is enough to keep at least PF in jail for a long time. Hopefully this will all come out at the trial.

In the "Up and Adam in the morning" radio interview from April 2021, CL stated that there was info./evidence?! about the case that hadn't been disclosed yet - even during the "In Your Own Backyard" podcast.

UPDATE: A pre-preliminary hearing for Paul Flores, along with his father Ruben Flores, that was scheduled Wednesday afternoon in San Luis Obispo County Superior Court has been canceled. The next court date is July 6, when the preliminary hearing is set to begin. #KristinSmart

I still cannot believe they released Ruben, while in the same breath admitting that the and 🤬🤬🤬 Paul had recently moved Kristin's body. Further, there was evidence of her body being under the deck!

He may be elderly, but he is notoriously active around his home around the neighborhood. If he could help move a body again after 25 years, he's able-bodied enough to further interfere with the investigation. Just a disgrace IMO.

Preliminary hearing in Kristin Smart murder case postponed
The hearing for Paul and Ruben Flores was originally scheduled to begin Tuesday but now is tentatively slated to begin July 12 upon a judge's approval. Court officials expect the hearing will last 12 days. .... During the July 6 hearing, Van Rooyen is expected to review a potential July 12 start for the preliminary hearing or set an alternate date at Superior Court in San Luis Obispo.

Tuesday, July 6th:

It will not be live streamed & media coverage will be limited. The parties discussed the scheduling for the preliminary hearing on 7/6/21.
6/29/21 Update: During a virtual hearing Defense attorney Robert Sanger motioned to the court to push back the scheduled start of the preliminary hearing set for 7/6/21. Sanger is still waiting to receive discovery from the prosecution. Judge Jacquelyn Duffy granted the motion. Judge Duffy set a date for a pre-preliminary hearing for 7/6/21 @ 8:30am & Superior Court Judge van Rooyen may select a new date for the preliminary hearing at that time.
7/6/21 Update: Court site shows pre preliminary hearing on 7/6/21 only for Ruben Flores.
