Crazy hypothetical here (buckle up :)

Say a group of people got permission from a neighbor (that bordered SF’s property) to dig. IF they dug a tunnel to the Flores yard and under the concrete slabs....would that render any findings useless in a court case against PF? I get that it would be trespassing, but I’m wondering what that would do to potential evidence?

I live on the opposite side of the country, so I have absolutely no plans to make this happen. It’s just a scenario I ran through my mind.

With regard to statute of limitations in CA is everything besides murder off the table for prosecution now? Manslaughter, rape, accessory-after-the-fact, etc?
From what I understand, yes. The only thing they can prosecute now is murder

IIRC, the podcast host (Your Own Backyard/episode 6) stated in 1996 PF attorney went to the Smart’s attorneys with an offer- allow PF to plead guilty to involuntary manslaughter with a 6 year sentence & an agreement not to pursue him in civil court and he would lead authorities to KS body. However, the offer was quickly withdrawn by PF before the Smart family could consider.

so there is no doubt she is dead unfortunately. And at least she is recoverable, ie not dumped somewhere random or in water etc.

I wonder why he withdrew the offer ? Did he realise with no body he could possibly get away with it ?(which he has in a way)

While this sounds logical, I wouldn’t assume this. Impotent little Criminals (Perp or not), get their kicks toying with grieving families.

amateur opinion and speculation

Crazy , he’d be out by now probably. Maybe for the rest of the public it’s good because he had to behave. I live in Stockton and like everyone else. I really just want her family to get some answers.

The crazy thing about that plea deal is that he would have had 6 years to serve (likely out in less time) and probation afterwards. He could have resumed a somewhat 'normal' life within 10 years and perhaps even have disappeared quietly to start a new life.

Here we are 23 years later.....and he is still prime suspect #1 and he will live that way in many people's eyes way until the day he dies (unless he confesses.)

Stupid a** should have taken the deal. Put her family out of their anguish.

It would be a heavy burden if he isn't a sociopath. Imagine having to think about it every day. Just when he starts forgetting, things come back up. It is likely nowhere near as bad a prison but is a sort of prison.

But he almost certainly is a sociopath/psychopath.

I don't think this is a hoax. I also don't think she is alive unfortunately. But what I do think could be shocking is if they have had her body for a long time wrongfully listed as a Jane Doe. That would be so sad for the family to hear after all these years.

Omg I never thought of that scenario. Jane Doe.

Anyone know when new episode coming out? Backyard.

It is really informative about the status of the investigation. Also, it’s revealed one/both of the Flores family trucks from 1996 have been recovered and are in police custody

That could certainly happen, but I don't think it would be kept from the family. I think the family would be notified immediately based on confirmation through DNA or dental records.

I was thinking maybe a Jane Doe police don’t even know about. Like found in another county.

If the police don't know about it, then it couldn't be the genesis of the retired FBI agent's comments to Mrs. Smart.

I doubt very much whether Flores would have driven all the way to Mexico to dump Kristin's body. Crossing a national border with a corpse in the vehicle would be insanely risky.

Oops! Multi-tasking got me again. I'll have to remember to take the time to read carefully.

I'd have to think that even in 1996 any Jane Doe found in California would have been checked against missing women statwide.

And yet no other answers either. It’s just a thought not fact.

A statement from the Smart Family:
"Congratulations to Chris Lambert for his outstanding podcast, Your Own Backyard! His seventh episode is now live and it is a must listen. Thanks to Christopher Lambert and all the supporters who have made such an amazing difference. Your Own Backyard has been instrumental in renewing interest in Kristin’s investigation and generating many new leads. We now know that the San Luis Obispo County Sheriff's Office has issued 18 search warrants of 9 locations, conducted 91 new interviews, filed 364 supplemental reports and obtained 140 new items of evidence. Later today, the Sheriff’s Department will confirm that now they have both vehicles of interest in their possession. Keep the faith and know that you are all making a difference." - Stan & Denise Smart
