My guess is that no new evidence has been presented in this case- just old evidence that has been re-interpreted in an attempt to prove the unprovable- that Scott is innocent.

And the judge stated the reason for denying the evidence:

“In the court’s ruling, strong exculpatory evidence was disregarded as ‘inadmissible’ which is not the correct legal standard,” Brown wrote.


So this 'evidence' was legally inadmissible---thus possibly Hearsay, Speculative or Irrelevant, Illegal Procurement, etc.

Sadly they just released a person using this law who had a life sentence. The person before him had been sentenced to 355 years (A life sentence) "Gregory Vogelsang, 57, a convicted child predator serving a 355-year-to-life sentence for sexually abusing young boys in the 1990s. Granted parole in Nov. 2025 under the state's Elderly Parole program."
There is also David Allen Funston who received a 20 year+ 3 life sentences........he was granted parole as well. "In 1999, Funston was convicted of kidnapping and sexually assaulting multiple children in the Sacramento area. Prosecutors said he targeted young children. Funston was sentenced to more than 20 years and three life terms in prison."

So unfortunately it is a sad reality that Scott Peterson could be released on parole. All he needs to do is be over the age of 50 and serve 20 years.

No, the exclusion is for "life without parole" sentences which covers Peterson, but not Vogelsang.

Excluded Individuals: Those sentenced to death or Life Without the Possibility of Parole (LWOP) are not eligible

What a bunch of useless noise.

They may as well have written, "he should be exonerated because he's got really nice hair."

It's probably the only thing he has going for him.

Does anyone have access to the docket to get a copy of Judge Hill's ruling? I really want to see what the Court actually said.
