Good news! While I agree that whether or not to charge a juvenile as an adult should be considered based on the facts of the case and that not every juvenile should be tried as an adult, Madyson's case is one where IMO her murderer should be tried as an adult.

AG has some serious psychological problems that may or may not be treatable but he absolutely should not be free in 5 years - the crimes he committed against Madyson are despicable and go way beyond murder.

Adrian “A.J.” Gonzalez’s attorney plans to fight to bring his case back to juvenile court.

As a result, a Santa Cruz County Superior Court judge postponed the initial hearing for the accused child killer on Tuesday.

Transcripts have not been released from the juvenile court proceedings that placed Gonzalez, now 18, in adult courts. As a result, the court delayed Gonzalez’s arraignment to Feb. 20. That will give the defense time to appeal the juvenile court’s ruling that transferred the case to adult courts.

Salazar ruled that Gonzalez did not suit the juvenile system for three legal elements: He was sophisticated, and multiple teachers said the boy is intelligent and observant. There is insufficient time to be rehabilitated by the juvenile system, Salazar said, And the gravity and circumstances of the crime warranted adult courts.

Public defender Larry Biggam asked the court to postpone the arraignment — a proceeding in which a defendant reviews the charges against him — for one month. With no objection by Santa Cruz County District Attorney Jeff Rosell, Volkmann approved the continuance and scheduled the arraignment for March 26.

Biggam is waiting for transcripts from the proceedings in juvenile court that resulted in Gonzalez’s transfer to adult court. Superior Court Judge John Salazar in October ruled in juvenile court that Gonzalez should be tried as an adult. Salazar ruled that Gonzalez was sophisticated and lacked time to be rehabilitated by the juvenile system amid allegations of such gravity and circumstances, they warrant an adult trial.

“We continued the arraignment so that we can secure all of the transcripts from the eight- or nine-week transfer hearing that are required to file a pretrial writ of mandate, which is a way of appealing Judge Salazar’s ruling, sending Adrian to adult court,” Biggam told reporters after the hearing Tuesday. “The stakes here are extremely high. It’s a difference between treatment and rehabilitation or punishment in an adult prison.”

The brief appearance in Superior Courtroom 3 with Judge Timothy Volkmann gave defense attorneys Ted Fairbanks and Jerry Christensen time to ask that a new arraignment date of May 14 be set to allow time for electronic filing requirements to be accepted by the court.

District Attorney Jeffrey S. Rosell said outside of court Monday, “Today what took place is they asked for a continuance of six weeks so that they can perfect and file their writ, which we have confidence, just like the court found, that the defendant will be tried as an adult. The court made an excellent record of it. The facts we think are overwhelmingly in favor of it.”

Gonzalez, appearing in the court Monday wearing the colors of an adult inmate, pleaded not guilty to the charges.

The Santa Cruz County District Attorney had already made the decision of prosecuting him as an adult, but then Proposition 57 passed, and the DA needed a judge's ruling. After nine weeks, a judge agreed and moved Gonzalez back to adult court.

With Monday's appeal, it might be another three months before an appellate court rules on trying Gonzalez as an adult.

Gonzalez is due back in court on July 31 to set a preliminary hearing.

For Biggam, the case hinges on whether the juvenile system can rehabilitate his client. The case is awaiting appellate review. If the case is returned to juvenile proceedings, Gonzalez would not face potential life in prison.

“We need to give the (6th District) Court of Appeal time to review that issue,” Biggam said. “Proposition 57 wants us to give more kids who commit crimes treatment and rehabilitation than pure punishment in the California Department of Corrections.”

Biggam said Salazar’s decision must be seriously reconsidered.

“He focused more on the crime and less on the child,” Biggam said. “I think the crime overwhelmed the judge and I understand that.”

I think its inevitable that his appeal will be denied but I disagree with what the defense attorney said. The reason the judge may have focused more on the "crime" is because of its brutality. All of the details that have been released (including Gonzalez's behavior), demonstrate that "pure punishment" would be the more appropriate outcome.

I agree. I find it hard to imagine Gonzalez being rehabilitated in a short period of time, if ever. Given the grisly details of Madyson's murder and his history IMO it puts him in the rare category of having psychopathic tendencies. A few years of talk therapy and meds will do little to change that. All MOO.

I work for a freaking defense attorney. I understand appeals. I have no issue with them taking their time and getting it absolutely right, as long as he's incarcerated while it happens.

I also understand why it takes forever to get those transcripts. You don't even want to know what they paid for those! Last week we got the transcript of a two hour hearing, fairly straight forward, no witnesses called - $400! I wouldn't even want to know what a 9 week transcript would cost.

I think the judge focused on the crime committed AGAINST THE CHILD.
An innocent child who was brutally tortured and killed.
A child who COULD HAVE BEEN SAVED!

I'm sorry, but a 17 year old who is that calm after committing murder?
They aren't a CHILD.

This is the case that taught me the phrase "positional asphyxia". That little girl died a slow, horrific death in that dumpster. I am all for saving those that may be saved, but his absolute lack of empathy for her plight proves that he is not redeemable.

A.J. Gonzalez case among multiple proceedings pending appellate court review

Three years after Madyson Middleton’s death, Adrian “A.J.” Gonzalez still has not stood trial for murder.

His case is among several awaiting review by the 6th District Court of Appeal, which has not ruled on the transfers — often involving defendants age 14 or older accused of significant crimes — from juvenile courts in Santa Cruz County, District Attorney Jeff Rosell told the Sentinel on Tuesday.

Superior Court Judge Timothy Volkmann on Tuesday continued homicide proceedings against 18-year-old Gonzalez while the court of appeal considers the request — sought by the defense — to review orders that placed the case in adult courts.

The adult proceeding is slated for preliminary examination 8:15 a.m. Nov. 6 in superior court, Volkmann ordered Tuesday.

Madyson’s maternal grandfather, Bruce Jordan, and other relatives packed the gallery during Tuesday’s hearing.

How stupid can lawmakers get? To apply the law equally for robbery and assault and murder and rape as if these crimes are all on par with the level of violence. Someone's smoking too much Mary Jane IMO.
If prosecuted as a minor, Gonzalez would likely be freed when he turns 23 years old. His 18th birthday is next month
Instead, defense attorney Larry Biggam is focusing on building a psychological profile of a neglected boy who never received help for undiagnosed mental challenges. Biggam presented studies showing that a 15-year-old's brain is not fully developed, and with therapy and treatment in the juvenile justice system, someone like Gonzalez can be rehabilitated.
During Monday’s hearing, Gonzalez frequently played a pretend piano, tapping his fingers as chords on the desk in front of him. When Biggam walked away, Gonzalez pushed his attorney's chair farther away from him. Every time Biggam’s empty chair swiveled, Gonzalez turned it back again.
Gonzalez watched police detectives and FBI agents as they were searching for the girl’s body, and calmly asked them how their investigation was going, police said. He allegedly cleaned up the crime scene meticulously, and then began sending flirty text messages to girls.

Madyson's grandfather started an online petition to try Gonzalez as an adult. 7,000 signatures. Apparently our representatives don't really want to represent us.

In a few years this psychopath will be on the streets again along with a host of other killer kids who should be segregated from society. Let's wait and see how many will be "rehabilitated."
