*Trial continues (Day 51)-Verdict Watch! They remain in custody at the Santa Rita Jail in Dublin on $750,000 bond (was $1.8M) and face up to 39 years in prison each if convicted.
Trial started April 30, 2019 with opening statements & continued on May 1 with testimony which began on May 6. Trial is expected to take 12 to 18 weeks. Trial ended on 7/16/19. Jurors: 7 women/5 men (4 alternates; 5/1: One alternate juror removed due to work hardship. 5/9: one alternate juror removed as “veracity” issues). 8/19/19: 3 women on jury replaced by 2 men & 1 women alternates for contact with media. Court dark on Fridays.

9/3/19 Day 49/Day 3-Deliberations: The jury resumed deliberations after a 12-day break. Judge Trina Thompson told jurors to go ahead and unseal the evidence boxes that had been secured in their absence. Deliberations continue on 9/4. Judge Thompson held another closed hearing on Tuesday but the subject of the hearing wasn't disclosed. Getz said Thompson will hold another closed hearing on Wednesday morning. Thompson said two weeks ago that she has initiated contempt of court proceedings against two of the three dismissed jurors for allegedly not obeying her instructions to them.
9/4/19 Day 50/Day 4-Deliberations: The jury sent a note requesting readback from a witness. The witness is Capt. George Freelen of the Oakland Fire Department. Freelen testified that he visited the warehouse shortly after an arson fire outside the building and was concerned about the "fire load," or flammability of materials inside. He said he was so concerned that he asked colleagues at the Fire Department to follow-up but never got a response. Freelen also testified that Almena told him no one lived inside the warehouse. Meanwhile, the defense is once again moving for a mistrial. Judge Trina Thompson denied defendant Max Harris' motion for a mistrial during closed session Tuesday outside the presence of the jury. The judge will entertain a similar motion by defendant Derick Almena on Thursday. Jury deliberations continue to 9/5.
