Trial started April 30, 2019 with opening statements & continued on May 1 with testimony which began on May 6. Trial is expected to take 12 to 18 weeks. Trial ended on 7/16/19. Jurors: 7 women/5 men (4 alternates; 5/1: One alternate juror removed due to work hardship. 5/9: one alternate juror removed as “veracity” issues). 8/19/19: 3 women on jury replaced by 2 men & 1 women alternates for contact with media. Court dark on Fridays.

9/3/19 Day 49/Day 3-Deliberations: The jury resumed deliberations after a 12-day break. Judge Trina Thompson told jurors to go ahead and unseal the evidence boxes that had been secured in their absence. Deliberations continue on 9/4. Judge Thompson held another closed hearing on Tuesday but the subject of the hearing wasn't disclosed. Getz said Thompson will hold another closed hearing on Wednesday morning. Thompson said two weeks ago that she has initiated contempt of court proceedings against two of the three dismissed jurors for allegedly not obeying her instructions to them.
9/4/19 Day 50/Day 4-Deliberations: The jury sent a note requesting readback from a witness. The witness is Capt. George Freelen of the Oakland Fire Department. Freelen testified that he visited the warehouse shortly after an arson fire outside the building and was concerned about the "fire load," or flammability of materials inside. He said he was so concerned that he asked colleagues at the Fire Department to follow-up but never got a response. Freelen also testified that Almena told him no one lived inside the warehouse. Meanwhile, the defense is once again moving for a mistrial. Judge Trina Thompson denied defendant Max Harris' motion for a mistrial during closed session Tuesday outside the presence of the jury. The judge will entertain a similar motion by defendant Derick Almena on Thursday. Jury deliberations continue to 9/5.

"OAKLAND (KPIX 5) — After weeks of deliberations and the replacement of three jurors for misconduct, creative director Max Harris was found not guilty Thursday and the jury was hung on manslaughter charges against Ghost Ship master tenant Derick Almena in Oakland’s deadly 2016 warehouse fire.

Both Harris and Almena had been charged with 36 counts of involuntary manslaughter. Of the jurors, 10 ruled that Almena was guilty of the charges while 2 felt he was not guilty.

Alameda County Superior Court Judge Trina Thompson said the jurors were “hopelessly deadlocked.” She ordered prosecutors to return to court on Oct. 4 to say whether they would retrial Almena or reach some kind of deal.

As the verdicts were read there were noticeable gasps and tears from the relatives and friends who had gathered in the Alameda Court Superior Courtroom...."

Almena and Harris were set to be sentenced last year to nine and six years in prison, respectively, after pleading no contest to manslaughter.

But a judge threw out their pleas after many of the victims' families objected, saying the proposed sentences were too lenient.

The fresh verdicts for Almena and Harris were announced Thursday afternoon after a three-month trial that drew family and friends of the victims to a packed courtroom.

There were audible gasps and tears from those gathered as the verdicts were read out, CBS reports.


Last month, Judge Trina Thompson booted three jurors for misconduct and ordered the new jury to restart deliberations and disregard all past discussions. She reminded them they cannot talk to others about the case or seek outside information about it. The new jury has been deliberating since August 26.

Today she said jurors were 'hopelessly deadlocked' before telling prosecutors to return to court on October 4 for a decision on whether they would retry Almena or reach a plea deal.

Justice denied for 36 people and the families and other loved ones of these 36 innocent souls.
Indeed, what has happened to our system of justice?
I cry and I will pray for all of us who live here in the USA.

What did the jury hear that many of us have missed? I don't understand how they could not find them guilty.

It is what they did not hear.

What caused the fire.

Proof that the collective was cited or fined for fire hazards from the county, and told to shutter the space.

The voices of every family member and friend who lost someone in that place, that night.

Alameda county has some issues with see no evil, hear no evil.

I only pray Almena will not be released in the next trial.

Jury foreman revealed that 10 on panel guilt. DA mulling over whether to retry Almena. Max Harris completely acquitted on all 36 counts of involuntary manslaughter. Prosecutors to return to court on October 4 for a decision on whether they would retry Almena or reach a plea deal.
NOTE: The judge has said one juror has indicated they have a vacation planned from September 9-13, with another juror indicating they're unavailable from September 19 until October 5.

I just hope there will be another trial. Please, let it happen. That ~man~ cannot just keep walking around and smiling to himself. That so-and-so was not even there when it happened, and he was one of the few who could have helped those good, trusting & innocent people find a way out of that inferno.

I agree that the plea deals involved short sentences -- but -- those plea deals involved sentences.

Did the jurors not know that these two murders entered guilty pleas?

(Or were they Alford pleas? Does California use the Alford plea, essentially 'I'm not guilty but agree that you have enough evidence to convict me.')

bbm - Yes, indeed the initial deal did involve sentences, and yes, indeed, they were shorter than they should have been. And now Harris can just walk out the door and not worry about it anymore. Grrrr.
And yes, CA does allow an Alford plea. That would be insulting, too, IMO, but maybe it would at least put that worthless scoundrel behind bars for a few years. SMH.

I stumbled across this case late in the game and couldn't catch up, but try to read about it whenever I can. I just stumbled across this interesting article with a lot of history of the town and factors that contributed to the GS way of living.
