interesting article!

yup here it is--- this will be the inadequate defense claiming!

from link - "
“I do have some concerns about the contents, your honor, because it's so numerous and massive," Martinez said in part. "One whole year of texting. There's no way that I'll be able to compare what I have that she provided versus the Excel sheets. That's what my concern is all about. She has it all in a different format, and in order for me to even decipher whether there [were] errors on the format of the Excel sheet, I would have to look at what she had provided earlier, and she's not using all of it…. It burdens me a lot, and I can't be listening to her question and listening to the answer and then trying to object and then trying to check. It's just an extreme hardship on the defense, your honor.”

Moring responded: “Counsel, this case is voluminous, and there is a lot of discovery, and you just need to be on top of it. If you're going to be representing him and doing a job — a competent job — then you just need to make sure that you have a mastery of the evidence and you've got to anticipate what is going to come in. And you've had this case for quite a while. We were supposed to do this preliminary hearing a year ago. I don't know if you had the discovery a year ago because, apparently, some of the discovery is coming in on a rolling basis, but if you had — if you've had this for a year, you should be on top of it."

interesting article!

From the link, I think this explains Martinez's performance during the prelim: she doesn't know how to respond to the state's evidence that MM is deceased.

“I'll note this is a homicide case," [Judge] Moring said. "You've raised the issue that he didn't even kill her, that she's alive.”

Martinez responded: “She's still alive. That's our position.”

The murder trial for Larry Millete is scheduled to begin in September.

I was not near the tv, but caught something about the Larry Millete Secret Sidebars documentary on this coming Monday night. Now, I can't find anything more on it. Hope I remember to watch it.

I trust OP is aware that San Diego News 7 produced an extensive piece on the sidebars last Tuesday 2/7, right?

If there's an additional report, hope you can link it. Thanks.

Yes, trying to be competitive with News 7 perhaps. Caught one more fast blurb, and it said "Millete Hearing Secret Sidebars" also. A ploy to watch this on News 8 on the 11 p.m. news, which means it'll be a short little piece. I probably won't catch it. I watched the hearing, so I'm not that curious even for me. I know which attorney was the big problem.

News8 got the transcripts from nine of those private sidebars. I take it some are silly things Larry's Defense Attorney wanted to bring up and question beyond the Judge's patience. One was when all on a camping trip, when Maya went with her sister to a bar drinking, leaving the children in a trailer (most likely under someone else's care). Prosecution said it wasn't even relevant. I believe they said one issue was about the blood in the bathroom which wasn't Maya's.

I couldn't link the news video. Their site used to be friendlier.

Interesting sidebar about how the state wanted to allow Maya's alleged complications following an abortion because they believe it goes to motive as evidenced by the spellcaster emails but defense attorney Martinez could not seem to grasp allowing the single post-procedure medical event where Larry took Maya to hospital for treatment did not grant the defense an opportunity to introduce unrelated events which serve only to malign the missing mother.

Copying the MSM transcript report violates CA Statute so viewers must reference the link below:

Editor's note: California Gov Code 69954(d) prohibits the copying of purchased court transcripts and posting those pages on the internet as PDFs.

1/25/23 Update: Day 10: State witnesses: San Diego County DA Investigator James Rhoades back on stand. Deputy District Attorney Christy Bowles delivered more than 13 minutes of final arguments & attorney Bonita Martinez gave final arguments to Superior Court Judge Dwayne Moring. Both sides rested at the preliminary hearing. Judge Moring has ruled there is enough evidence for Millete to be tried on one count of murder. The decision came Wednesday, 1/25/23 exactly two weeks after the start of the preliminary hearing to determine whether the San Diego County District Attorney's Office has enough evidence -- despite never finding the body of the missing Chula Vista mother of three -- to convince a jury that her husband was behind her death. “The court finds that corpus delicti requirement has been met for sufficiency of the evidence,” Moring said. “Based on the evidence presented in this preliminary hearing, it appears to the court that there is probable cause to believe that the offenses charged in counts one (murder) & two (possession of an assault weapon) have been committed & is guilty thereof.” The defense elected for an immediate arraignment on those charges. Larry Millete pleaded not guilty & waived his right for a speedy trial to be conducted within 60 days. Larry also faces one count of possession of an assault weapon when his trial begins on Sept. 14, 2023 in Chula Vista. Next felony readiness conference hearing on 3/22/23.

Had the News8 on and heard a short blurb, but can't find the article or video yet. This happens to me all the time. I just spend a half hour searching for what I heard on the news. At least, I found some other local news I wanted to share with a friend, and also which eye drops have been recalled. Anyways--

A tentative Trial Date of October 9, 2023.

I am still fuming over the ridiculous performance of LM's attorney at pretrial hearing. It is time for LM to hire a competent and qualified defense attorney.
As objectionable as she is by extension of her client, she's dumb like a fox. She's planting as much "reasonable doubt" as she can.
She knows what she's doing, and given what she has to work with, it's a clever approach.

Amateur opinion and speculation

It's a rerun on tv tonight. That San Diego case I've mentioned many times here because it reminds me so much of Maya's case. This is the one where the husband must've hid his wife's body in a freezer for two years, then as he was leaving town he put the body in the bay. She, too, had seen a divorce attorney that day and was trying to leave. Where is Maya? Why hasn't she been found? Keeping her, her family, and all the tireless searches in my prayers.

Here's the Dateline Elizabeth Sullivan case the whole episode in parts.

I am waiting for LM's uncle and aunt to take the stand in the trial.
I haven't followed the thread in a while so may have my facts wrong; if so please correct me. If recollection serves me correct, they had something to do with the refrigerator early on, yes?

I also seem to recall some car referenced in front of LM's home very early in the morning the day MM disappeared, caught on video. Was that car and its owner identified?

What a sad and bizarre case, "spell casters" and all. It illustrates how far a twisted mind will go when they believe they are losing control of their "possession", if even 1/4 of what we've heard via the media is true.

But most of all, there are three little kids who have lost their mom, and effectively their father. Given the vitriol from LM's family towards MM, I think it's inappropriate that they are living with LM's parents. In the article linked below, it states: "...these children strongly believe that their maternal family has caused (their) father’s incarceration and it makes them uncomfortable around that side of the family. I’m not certain why they believe this, but they do.” That is very troubling. IMHO, and we'll see what the court decides, it would be much healthier for the children to be placed with MM's sister.
All just amateur opinion and speculation!
