  • OpenAI’s lawyers are seeking to eliminate some of Birchall’s testimony about xAI’s bid to acquire OpenAI.
  • Birchall was also questioned about any possible restrictions on Musk’s donor-advised funds.
  • Lawyers from OpenAI and Microsoft wrapped their cross-examination of Musk.
  • Musk said that his for-profit companies Tesla, SpaceX, X and Neuralink were all “socially beneficial.”

The case caption alone will likely elicit a reaction from the roughly 100 potential jurors summoned to an Oakland federal courtroom Monday.

The trial of Elon Musk v. Samuel Altman is beginning. And the personal feelings of jurors will pose a special challenge in the multi-billion dollar trial over Musk’s claims that Altman betrayed OpenAI’s founding principles, as it features two household names that each come with significant baggage.

The American public’s broad antipathy toward the AI industry looms over the trial, as well.

Weeks ago, a man was arrested for allegedly throwing a Molotov cocktail at Altman’s San Francisco home, and polls have shown Americans hold negative views toward AI. Last month, Musk alleged a San Francisco jury showed bias against him.

While many of Elon’s antics are less than virtuous, I side with him on this one. This trial is raising many ethical questions about the use, and misuse of AI. And while Altman is a very bright man, Musk can run mental rings around him, even on a bad day.

FYI: Starting tomorrow (Monday, May 4th), live audio of the Elon Musk v. Sam Altman/OpenAI trial will be live-streamed on the official YouTube channel for the US District Court for the Northern District of California.

The livestream will be available to the public while court is in session, usually between 8 AM – 2 PM PT, Monday through Thursday, until May 21.

OpenAI’s president, Greg Brockman, who was meticulously taking notes during some of Elon Musk’s testimony, is expected to testify next week. And Stuart Russell, a computer scientist at UC Berkeley, will testify about AI safety. I’m expecting that to open the floodgates to this crazy discussion about who can be trusted to build AI.

A bunch of other high-profile people are expected to testify, like former OpenAI chief scientist Ilya Sutskever, former CTO Mira Murati, and Microsoft CEO Satya Nadella.


The trial is supposed to last around three weeks. The nine jurors will deliver an advisory verdict that guides the judge on how to decide Musk’s claims against OpenAI. The judge doesn’t have to listen to the jury and can decide however she wants. If she decides OpenAI is liable, then she’ll decide what sort of remedies are appropriate.
