7/7/22 Thursday, Trial Day 11, Jury Deliberations (Day 1): The Jury deliberated between involuntary manslaughter, 2nd degree & 1st degree. The judge threw out voluntary manslaughter. They deliberated part of Thursday. Deliberations continued to 7/8/22.
7/8/22 Friday, Trial Day 12, Jury Deliberations (Day 2): Jury deliberated almost all of Friday. Jurors reached a guilty verdict on 2nd degree murder. Next probation & sentencing hearing on 8/1/22.

*Sentencing Hearings (Federal Charges) (Travis @ 10am & Bryan @ 1pm ET) - GA – Ahmaud Marquez Arbery (25) (Feb. 23, 2020, shot while jogging in Satilla Shores neighborhood, Brunswick) - *Travis James McMichael (34/now 36) & *Gregory Johns McMichael (64/now 66) indicted (4/28/21), charged & arraigned (5/11/21) with Federal crimes of 1 count of interference with rights (hate crime), 1 count of attempted kidnapping, 1 count of using, carrying & brandishing firearms during & in relation to a crime of violence & attempted to unlawfully seize & confine Arbery in an attempt to restrict his free movement & detain him against his will & Travis: plus 1 count of discharging a firearm. Both plead not guilty. No bond.
*William “Roddie” Roderick Bryan, Jr. (50/now 52) indicted (4/28/21), charged & arraigned (5/11/21) with Federal crimes of 1 count of interference with rights (hate crime), 1 count of attempted kidnapping & attempted to unlawfully seize & confine Arbery in an attempt to restrict his free movement & detain him against his will. Plead not guilty. No bond.
Trial began on 2/7/22 with jury selection. 12 jurors (7 whites, 3 Blacks & one Hispanic) with 4 alternates (3 white members & 1 Pacific Islander). Prosecuted by Assistant U.S. Attorney Tara Lyons of the Southern District of Georgia & Deputy Chief Bobbi Bernstein & Special Litigation Counsel Christopher J. Perras of the Civil Rights Division. 2/22/22 Tuesday, Trial Day 7-Jury Deliberations (Day 2): Jury continues deliberations. Have reached verdict. Approx. 1 ½ hours of deliberations.
Verdicts for Gregory McMichael: Count 1 Interference with Rights: GUILTY. Count 3 Attempted Kidnapping: GUILTY. Count 5 Using Firearm During Crime of Violence: GUILTY.
Verdicts for Travis McMichael: Count 1 Interference with Rights: GUILTY. Count 3 Attempted Kidnapping: GUILTY. Count 4 Using Firearm During Crime of Violence: GUILTY.
Verdicts for William "Roddie" Bryan: Count 2 Interference with Rights: GUILTY. Count 3 Attempted Kidnapping: GUILTY.
Jurors are excused. The judge is addressing each defendant as they approach the bench, informing him of post-conviction rights. They have 14 days to file motions; can get another appointed attorney if need be; right to appeal. Remanded to US Marshals' custody. There is first a 14-day period in which lawyers will be able to file post-trial motions, than the court conducts a pre-sentencing interview. At that point, likely sometime in mid-March, sentencing would occur.

("the evidence at trial overwhelmingly established that the streets of Satilla Shores were public streets…").
4/19/22 Update: Sentencing hearings: Travis McMichael on 8/1/22 @ 10am, Bryan on 8/1/22 @ 1pm & Greg McMichael on 8/8/22 @ 10am.

*Bench Trial set to begin (@ am ET) – LA – Meing-Chen “Mandy” Hsiao (34) (last seen July 29, 2015, Monroe; found Aug. 8, 2015) - *Quentin Verdell Tellis (27/now 32) charged (8/16/16), indicted (5/17/19) & arraigned (6/18/19) with 2nd degree murder. Plead not guilty. No bond. Judge reduced bond (10/23/19) to $300K. And future reductions possible). Bond reduction denied (7/28/21).
Bench Trial set to begin on 8/1/22.

3/2/22 Update: On Wednesday, a Louisiana prosecutor says the murder trial for Tellis (on 3/14/22) has been delayed while a defense attorney tries to discredit a piece of evidence. No new date has been set. 3/14/22 Update: The trial was originally set for 3/14/22 will begin on 8/1/22. It was delayed when Tellis' attorneys attempted to discredit a key piece of evidence in the case. Tellis' attorneys hired an expert to determine where his phone was at the time of Hsiao's murder. Tellis' attorneys waived his right to a standard jury trial & instead will try the case in front of a judge.

*Trial set to begin (for both) (@ am MT) - UT - Angelina Costello (3) (July 6, 2017, Ogden) (Starved, burned & beaten to death; weighed 13 lbs.) – *Miller Eric Costello (25/now 29) & *Brenda “Ericka” Emile (22/now 26) arrested & charged (1/17/18) & arraigned (5/14/18) with 1st degree felony aggravated murder. Both plead not guilty; no bail. DA will seek DP.
Angelina died from a combination of blunt force trauma, burns, starvation & malnutrition. She weighed 13 pounds. Her ribs were visible, her legs & arms thin & covered in bruises. Burn marks on her face & chest were caked with makeup an attempt, Emile later told police, to minimize the severity of her injuries.
Trial set to begin 8/1/22 & might be delayed to 2023 because of intellectual disability evaluation. (7-week trial).

6/10/21 Update: Second District Judge Michael DiReda on Thursday scheduled a seven-week trial to begin Aug. 1, 2022, for Emile & Costello. Next pretrial hearing on 8/12/21.
5/20/22 Update: During a 2nd District Court hearing on Friday afternoon 5/20/22, Judge Michael DiReda acknowledged a motion filed Wednesday by Costello’s attorney, Randall Marshall. The motion said Costello “intends to claim, & to offer evidence, that he is exempt from the death penalty” due to intellectual disability. Marshall said defense experts have evaluated Costello for the disability & DiReda said he would take the next step as determined by state law: A court request to the Utah Dept. of Health & Human Services to assign at least two experts to evaluate Costello. If the state experts report that Costello has the disability, Weber County prosecutors would have the option of rebutting the finding with additional expert evaluation. This process could take several months, which led DiReda to cancel Costello’s scheduled August trial. The trial now might not be held until 2023. Emile is scheduled to go on trial in October.

*Trial continues (Day 5) (@ 8:30am PT) - CA - Kristin Denise Smart (19) (missing May 25, 1996 while walking back to her dorm from a off campus frat party at Cal Poly, reported missing on May 26, 1996, San Luis Obispo, still missing; legally declared dead on May 25, 2002) – *Paul Ruben Flores (19 @ time of crime/44/now 45) arrested (4/13/21), charged (4/14/21) & arraigned (10/20/21) with 1st degree murder. Plead not guilty. No bond.
*Ruben Ricardo Flores (55 @ time of crime/80/now 81) arrested (4/13/21), charged (4/14/21) & arraigned (10/20/21) with accessory to murder after the fact. Plead not guilty. $250K bond. Bond was lower to $50K. Has posted bond (4/22/21), out of jail.
Trial began with final jury selection for Paul from 6/27 & ended 6/28/22 & for Ruben jury selection started on 7/11 & ended 7/12/22.
Trial began on 7/18/22 with opening statements for Paul in am & Ruben in pm (which was continued on 7/21/22).
Paul’s attorney Robert Sanger & Ruben’s is Harold V. Mesick. Prosecutor is Christopher Peuvrelle. Judge Jennifer O’Keefe presiding.
Judge O’Keefe has blocked defense attorney Sanger from suggesting someone else killed Smart unless he can provide evidence of direct involvement.
Trial has been moved from San Luis Obispo County to Monterey County in Salinas. For 2 juries each: 12 jurors & 8 alternates; Paul’s: 8 men & 12 women & Ruben’s: 9 men & 10 women (still waiting for correction).

7/26/22 Tuesday, Trial: The Smart trial was canceled Tuesday morning, as one of Ruben jurors did not show up to the hearing due to an emergency. Court was already scheduled to be dark for the rest of this week. Trial is set to resume Monday, 8/1/22 @ 8:30am.

*Jessica Rosalie Kelley (33/now 38) (cousin of FG) – plead no contest (1/7/19) to reckless abuse of a child resulting in death, 3 counts of tampering with evidence, 1 count of aggravated battery & 1 count of conspiracy. Sentenced on 4/28/22 to 50 years with 6 years suspended. Once Kelley is released from prison, she will be on probation for 5 years. Testified at Gonzales’ trial.
*Michelle Martens (37/now 41) (“mom”) – plead guilty (6/29/18) to 1 count of intentional abuse of child resulting in death, with all other charges dropped. Will testify against Gonzales & will be sentenced after that case is over. Faces up to 12-15 years in prison. Sentencing hearing on 2/11/22 was cancelled on court site.


Tuesday, August 2nd:
*Plea Conference Hearing-Continued! (@ 9am CT) – NM – Anastazia Romero (1) (last seen Dec. 13, 2018, Albuquerque, found Jan. 4, 2019 buried in a back yard) – *David “DJ” John Zuber (26/now 30) “father” indicted (5/7/19), recharged (5/8/19) & arraigned (5/20/19) with 1 count of reckless child abuse resulting in death & 1 count of tampering with evidence. Plead not guilty. Held without bail.
Two other children in custody of CYFD.
Trial was set to begin on 8/8/22 but has agreed to a plea deal.
Originally arrested (1/4/19) with child abuse resulting in death, tampering with evidence & conspiracy. Held without bond; Judge released him (1/13/19). DA dismissed (1/8/19) all charges without prejudice, awaiting autopsy report. Recharged on 5/18/19.

*Sentencing Hearing (@ am PT) – WA – Hazel Journey Holman (3) (Nov. 27, 2019, Bellingham) - *Kamee Nicole Dixon (27/now 29) (Father’s GF) arrested (12/5/19), charged (12/6/19), indicted (12/9/19) & arraigned (12/13/19) with homicide by abuse (domestic violence) & 2nd degree murder (domestic violence). Plead not guilty. $1M bond.
Trial began on 6/6/22 & ended 6/22/22; jury started deliberations on 6/22/22 & ended 6/30/22 with guilty verdict on homicide by abuse & did not come to a verdict on the murder charges.

7/14/22 Update: Attorneys for Dixon have requested a new trial. Court documents state that Dixon’s defense attorneys submitted the request on 7/6/22. Her attorneys claim that the jurors did not fully understand the definition of torture, which jeopardized Dixon’s right to a fair trial. A hearing date has been set for 7/18/22. Dixon is scheduled to be sentenced on 8/2/22.
7/18/22 Update: Whatcom County Superior Court Judge David Freeman found in the July 18 hearing on the motion for a new trial that the jury was properly instructed & that there was not a need to further define torture, because it was not a technical term that required a definition. Freeman said during court that had the court further instructed the jury on the definition of torture using the defense's requested definition, it likely would have been more confusing for the jurors. Judge Freeman then denied Dixon's motion for a new trial. Next sentencing on 8/2/22.


Thursday, August 4th:
*Sentencing Hearing (@ 10:30am MT) - CO – Sylvia Mae Quayle (35) (found murdered on Aug. 4, 1981, Cherry Hills Village, so. of Denver) - *David Dwayne Anderson (21 @ time of crime/62/now 63) arrested & charged (2/10/21) & arraigned (9/24/21) with 1 count of 1st degree murder (after deliberation) & 1 count of 1st degree murder (felony murder). Arrested in Cozad, NE & waived extradition to CO.
Trial began on 2/25/22 & ended 3/8/22 with a hung jury.
Re-Trial starts on 6/24/22 with jury selection & trial started on 6/27/22 & ended on 6/30/22 with a guilty verdict.

6/30/22 Thursday, Trial Day 4: The jury found Anderson GUILTY. Of 2 counts of 1st degree murder. Sentencing hearing on 8/4/22. He faces life in prison with the possibility of parole after 20 years.

Santiago Esparza, Jr. (30/now 32) (BF) – Jury trial set to begin on 7/13/22 & ended 7/26/22 with guilty verdict & sentenced to 40 years in prison.

*Trial set to begin (@ am CT) – TX – Cecilia Huerta Gallegos (30) (missing July 7, 2019, reported missing July 8, 2019 by husband, San Antonio, not found) - *Reyes Huerta Gallegos (36/now 37) arrest & charged (8/24/21) & indicted (11/16/21) & arraigned (11/19/21) with murder (by manner & means unknown to the grand jury). $250K bond lowered (1/14/22) to $200K.
Previous charges: 1/13/20: Assault with bodily injury was dismissed as a material witness was missing. Plead guilty to filing a false police report & was sentenced to 6 months on the false report, but it only shows a credit for time served of 132 days - just over 4 months.
Trial was set to begin on 3/23/22 continued to 5/20/22 & continued to 8/5/22.

8/1/22 Friday, Trial Day 14/Jury Deliberations Day 1: After less than four hours of deliberations, a jury found Gonzales guilty on all nine charges.
Child abuse with reckless disregard resulting in the death of a child under the age of 12: This first-degree felony carries a mandatory 18-year sentence under New Mexico law.
Seven counts of tampering with evidence: Each count is a third-degree felony, carrying a three-year sentence. That means a possible 21 years for those charges.
Conspiracy to commit tampering with evidence: This fourth-degree felony holds a one-and-a-half-year sentence.
Gonzales faces a maximum of 40 1/2 years in prison, but ultimately, Judge Cindy Leos does have some leeway with sentencing. No sentencing date as of yet.

7/14/22 Update: Attorneys for Dixon have requested a new trial. Court documents state that Dixon’s defense attorneys submitted the request on 7/6/22. Her attorneys claim that the jurors did not fully understand the definition of torture, which jeopardized Dixon’s right to a fair trial. A hearing date has been set for 7/18/22. Dixon is scheduled to be sentenced on 8/2/22.
7/18/22 Update: Whatcom County Superior Court Judge David Freeman found in the July 18 hearing on the motion for a new trial that the jury was properly instructed & that there was not a need to further define torture, because it was not a technical term that required a definition. Freeman said during court that had the court further instructed the jury on the definition of torture using the defense's requested definition, it likely would have been more confusing for the jurors. Judge Freeman then denied Dixon's motion for a new trial. Next sentencing on 8/2/22.
8/2/22 Update: Whatcom County Superior Court Judge David Freeman sentenced Dixon to 34 years in prison.

5/27/22 Friday, Trial Day 4: Johnson was found guilty Friday of 2nd degree murder & 2 counts of contributing to the delinquency of a minor in connection with the death of Bellamy. The verdict was read after about two hours of deliberations. During closing arguments, Johnson's attorney used a Jenga set to say Gamboa & Johnson's relationship was unstable & he snapped. They argued Johnson should be found guilty of the lesser charge of manslaughter. Prosecutors argued Johnson deserved to be convicted of murder. Following the conviction, the jury then recommended Johnson serve a 25.5 year sentence. The judge will rule on 8/2/22 about whether or not he agrees with the recommendation.
8/2/22 Update: Johnson was sentenced to 25 years to life in prison.

6/30/22 Thursday, Trial Day 4: The jury found Anderson GUILTY. Of 2 counts of 1st degree murder. Sentencing hearing on 8/4/22. He faces life in prison with the possibility of parole after 20 years.
8/4/22 Update: Arapahoe County District Judge Darren Vahle on Thursday handed Anderson a life sentence. The 18th Judicial District Attorney’s Office said Anderson will be eligible for parole after 20 years, a result of the sentencing guidelines in place at the time of the crime.

On March 8, 2022, attorneys for Travis & Greg McMichael appealed the verdict, citing that federal hate crimes laws apply only to public places & that the crime occurred in a private street. Attorneys for Greg McMichael also appealed the conviction on targeting Arbery because he was black, citing his career as law enforcement agent, spanning several decades, where McMichael's attorney said, there was no evidence of racist behavior.

8/2/22 Update: Defense attorney, A.J. Balbo, in his legal filing Monday didn't downplay the seriousness of the federal hate crimes case. Greg McMichael is asking a federal judge to show leniency when he's sentenced next week for a federal hate crime conviction. While Greg McMichael deserves “a substantial period of incarceration,” his defense attorney said in a legal filing, he should be spared a life sentence — though he has already been sentenced to life without parole on a separate murder conviction. McMichael also wants the judge to transfer him to a federal prison so that he avoids serving time for Arbery's murder in Georgia's state prison system, which can't ensure his safety from attacks by other inmates, the lawyer said. McMichael is scheduled to be sentenced Monday, 8/8/22 in U.S. District Court along with his adult son, Travis McMichael & their neighbor, William “Roddie” Bryan. A jury convicted all three in February of committing hate crimes, concluding Arbery had been targeted because he was Black.
8/4/22 Update: Defense motion filed. Travis McMichael faces sentencing Monday in U.S. District Court after his conviction on federal hate crime charges in February. His defense attorney filed a legal motion Thursday asking the judge to keep McMichael in federal custody. Attorney Amy Lee Copeland argued McMichael has received “hundreds of threats” and won't be safe in a Georgia state prison system that is under investigation by the U.S. Justice Department amid concerns about violence between inmates.

7/29/22 Update: The defense counsel filed a motion late yesterday. Motion to offer evidence that crime was committed by another. To be admitted that person(s) other the defendant committed the murders. 8/4/22 Update: On Thursday, McCraney’s attorneys brought forth four witnesses who they feel could help sway a potential Jury. One was McCraney’s wife who said Coley wasn’t at the crime scene. Then a former Ozark Newspaper delivery boy took the stand & said he saw an Ozark police officer at the scene of the crime. Former Houston County deputy charged with DUI. Next was a lady who said she overheard Ozark police officers admit to the murder of Beasley & Hawlett. But the state witnesses were the ladies’ brothers who say she is a compulsive liar & she is grieving over the loss of two family members. Finally, the defense brought a former officer who said that the officer at large was with younger women & that he was told to keep quiet about the case. 8/5/22 Update: Order: Judge William Filmore said that the evidence that others than McCraney killed two Dothan teens will not be allowed during his upcoming murder trial. His attorneys hoped to implicate a now retired police officer who had been rumored as the killer, but a woman whose claims spearheaded those rumors were recanted on Thursday. Rena Crumb testified during a pretrial hearing that she lied about officer involvement & police cover-up. "The Defendant can only introduce evidence of another’s guilt at trial that is legal evidence. The Defendant cannot prove guilt of another by hearsay statements, especially statements that when under oath are recanted,” Judge William Filmore wrote in his order. He also nixed potential testimony from others who claimed they may have seen police cars near the crime scene in Ozark & who also suggest officer involvement in the high school students’ death. “The evidence offered as relevant to another’s guilt must be inconsistent with the guilt of the accused. In the face of the DNA evidence against (McCraney), the Court does not find that the evidence presented by the defense would exonerate the Defendant,” Filmore wrote. Jury selection is set to take place on Monday, 8/8/22.

SLO Tribune, ABCNews, Associated Press & LA Times filed motion to unseal records in Smart case. The motion hearing is on 8/4/22 @ 3pm.
The Judge decided to begin unsealing records, after the Media's motions was filed. Both the prosecution & defense agreed most records should be unsealed now that the jury has been picked. The news coalition believes the records should have been unsealed regardless. DA & Defense must provide a list of documents they want sealed and why they want them sealed no later than 8/25/22. The Judge also modified the gag order.

4/8/22 Friday, Trial Day 19/Jury Deliberations Day 5: A jury in the trial against four men charged with plotting to kidnap Michigan Gov. Gretchen Whitmer has returned a mixed verdict. The jury found Daniel Harris & Brandon Caserta not guilty on all charges & were unable to reach a verdict in the charges against Adam Fox & Barry Croft, resulting in a mistrial. The verdict was read in federal court on Friday afternoon. Fox & Croft will return to jail for the time being. Harris & Caserta are being freed right now. Andrew Birge, U.S. attorney for the Western District of Michigan, vowed to retry the accused ringleaders, Fox & Croft.
6/30/22 Update: Chief U.S. District Judge Robert Jonker ordered two men accused of plotting to kidnap Michigan Gov. Gretchen Whitmer to face a retrial about three months after jurors failed to reach a verdict, multiple outlets report. 8/8/22 Update: Sentencing: Federal judge DENIES Travis McMichael's request for a transfer to federal custody. She says she doesn't have the power to do so because State brought charges, convicted & sentenced first. "You killed a man on Feb. 23, 2020," U.S. District Judge Lisa Godbey Wood noted, noting that the video is seared into the court's memory. "A jury found that you acted because of the color of Mr. Arbery's skin." Judge tells Travis he received "a fair trial. It was the kind of trial Ahmaud did not receive before he was shot & killed". Travis McMichael, the gunman who murdered Arbery, receives another life sentence — but he'll be in state custody, a federal judge rules.
U.S. District Judge Lisa Godbey Wood sentenced Greg McMichael to life in prison plus 7 years. He will first serve his life sentence in State prison.
Federal Judge Lisa Godbey Wood sentenced Bryan to 35 years. He's already serving a life sentence in State court, where he has the possibility of parole. There is no parole in the federal system. Both state & federal judges dealt him less than the McMichaels. "Let no one think that 420 months in a federal prison is a light sentence, because you don't deserve a light sentence," the judge says. Bryan was sentenced to 420 months (effectively 447 months less the 27 months he's served in jail on State charges so far). That's 35 years. She did note that his sentence in State charges is life with the possibility of parole. The judge noted that he'll be close to 90 years old when he completes his federal sentence but the victim "never got to be 26 years old."

8/18/22 Thursday, Trial Day 3: Both sides rested, Stephen decided not to testify during the trial & Deputy prosecutor Jesse Miller & Deputy prosecutor Justine Szostak for the State & Defense attorney John Reeder did closing arguments. It took a Madison County jury 20 minutes to find Stephen guilty in connection with the death of her son. Stephen showed no reaction Thursday when Madison Circuit Court Division 1 Judge Angela Warner-Sims read the verdict of guilty on a charge of neglect of a dependent resulting in death. Judge Warner-Sims set sentencing for 9/13/22. Stephen is looking at a possible 40-year sentence.

Fox & Croft Jr. declined to testify. The defense rested their case. The government is allowed a rebuttal after defense presents their case. They have decided not to give any rebuttal in this case. *Trial begins (Day 4) (@ 9am CT) – TX – Scarlette Olivia Newsom (2) (Oct. 17, 2018, Dean; taken off life support after 5 days) – for *Joshua Thomas Fulbright (23/now 26) “BF” arrested & charged (10/17/18), indicted (12/18/18) & arraigned (1/22/19) with 1st degree felony count of injury to a child resulting in serious bodily injury. Indicted (1/13/22) on murder. $250K bond. Bond reduced (12/23/19) to $50K. Out on bond on 12/23/19. Posted $50K bond (1/13/22) with GPS monitor & having no contact with Newsom.
Jury trial was set begin on 12/6/19 with jury selection, but were unable to find 12 jurors. Trial was set to begin on 3/25/20-cancelled due to COVID is continued on 8/22/22 for Jury selection. Will be tried in Montague County.

*Sentencing Hearing (@ 9am ET) – PA - *Jasmine Jean (4) & Nicole Elisabeth (6) Snyder (missing/last seen since Sept. 2015 & found Nov. 6 & 7, 2021 buried in Williamsport City, Lycoming County; Jasmine: died/was killed on around Aug. 11, 2017 & subsequently buried in 2017 & Nicole: died/was killed around May 10, 2016 & subsequently buried in 2016, both in the back yard on Livermore Rd.) – *Michele Lee Butler (43 @ time of first crime/48/now 49) (mother of Echo) arrested & charged (11/9/21) , recharged & arraigned (1/7/22) with 2 counts of 3rd degree murder, 2 counts of felony endangering the welfare of children, obstruction in child abuse cases, abuse of corpse, concealing the death of a child & tampering with evidence. Bond denied, reason: flight risk & danger to society. Plead guilty. Sentencing date 6/21/22.

4/11/22 Update: A guilty plea has been scheduled for one of the four individuals charged. Michele Butler waived her court arraignment Monday on third-degree murder & related charges. The court docket shows a guilty plea sentencing date of 6/21/22. No plea offer has been made at this time, DA Ryan C. Gardner said. Butler also had waived her preliminary hearing. Her husband, Ronald also waived his arraignment & is scheduled for trial on charges of endangering the welfare of children & obstruction in child abuse cases. Arraignments for the Butlers’ daughter, Echo Butler & the dead girls’ mother, Marie Sue Snyder were continued.
6/21/22 Update: Sentencing hearing is rescheduled on 8/30/22.
