I am certain the Minute Order from today will be available shortly. The SCScourt tweet was posted this morning, so I'm not sure if agt was even present for this hearing. I am still waiting to hear back from my friends who usually attend the hearings. Hopefully MSM reports on this tonight. I sent a tweet to @NBCKris / Kris Sanchez, the reporter who wrote the article mentioning today's hearing. That's what led me to the tweet and the court's twitter feed. I forgot all about it. :blushing:

I'm hearing there wasn't an "appearance" today. I'm trying to obtain verification regarding those charges being dropped (either via a response from MSM inquiry or from someone who attended court).

Today's filing could have occurred without agt being there as it has so many times before. The defense is moving to seal the GJ testimony so I'm not expecting much to be posted on the site. :moo: However I'm still going to try!

I'm more concerned about why the "dropped charges" weren't mentioned before. :waitasec:

Monday’s hearing for Antolin Garcia Torres on charges of murder and attempted carjacking was rescheduled for April 16, according to a Santa Clara County Superior Court spokesman.

My friends assured me there was no court yesterday and that they were being dropped. If you look at the 2nd minute order PDF (dated 2/13/14) linked upthread

it left the "next appearance" blank, but it clearly states those charges (1-4 pursuant to indictment 213515) were going to be dropped. I guess we should have looked those minute orders up sooner. FTR, Kris Sanchez (@KrisNBC) never replied back to my tweet asking for clarification on her story, and she doesn't have an email address listed on her news story. It was her error in reporting :facepalm:

This is all JMO, but I believe that when the DA had to go the route of the GJ indictment, it closed the avenue of the continued delays. Therefore, it would make sense that any charges tied up in those delays would be dismissed and "rolled in" to the GJ charges.

ETA: Notice the wording on the tweet from @SCSCourt: it says "in lieu of indictment 213515" which I read to mean the GJ indictment which we will (hopefully) hear about at the next appearance in April. lease: The LaMars have waited long enough! :moo:

I can't imagine the State dismissing charges against agt. They have DNA tying him to the other cases, and that's part of how they were able to strengthen their case for Capital Murder (that hurts so much to type) for Sierra.

Because there is a pending motion to seal the GJ testimony, all we can see is what is public knowledge regarding the previous charges (which the defense had no problem delaying for years).

So, we will have to wait until April 16th for confirmation, but I have a strong feeling we will hear him recharged on everything then.

At least that is my hope. They have been waiting for him for years to enter a plea, and start the clock ticking. Now we will see and hear Santa Clara County DA Rosen throw the book at him, and be the voice for Sierra and the LaMar Family, and the People of the State of California, on the record.


I will be on pins and needles until then.

I agree with Kimi. I don't believe any of the charges will be dropped. Especially with the physical evidence found on the stun gun used in the Safeway attacks. The GJ indictment just cancelled them out per say so they can charge AGT thru the indictment.

I have my calendar marked for the date - two years and one month from the day Sierra was taken from her family and friends.

I hope the defense continues to feel the pressure of the public outrage and support, because it is real, and it isn't going anywhere. They are committed to seeing this case through, and for #JusticeForSierra to be served!

I know counts 2- 4 are used to show a pattern that's leading up to his killer Sierra on 3/16/2012 - but the 3-year gap till her being taken is strange... Unless I have the dates wrong(?)

The investigation was officially declared a homicide investigation the first week in March of 2003.

Your dates are correct. I personally believe there have been more victims. I have always found it interesting the Safeway attacks and Sierra's disappearance all happened in the month of March. Maybe something in March is a trigger for him? In the beginning it was discussed maybe it had something to do with each time his girlfriend became pregnant?

Thanks Lash for confirming dates are correct. Good point about attacks all taking place in March. So he attacked three times in one month and then did nothing of the next three years - that is strange, and agree most likely there are other victims.
