I am on the :fence: about the unsealing of the GJ transcripts.

My only wish is for the adjudication process to remain fair and impartial. Sierra and her family have been through he11 since March 16, 2012 and much of this has been at the hands of the (delay tactics of the) defense - IMVHO.

I still believe (and have said this before) that victims are forgotten in this process. They do not have guaranteed, inalienable rights, and until the system changes, we will never truly have balance. I value our judicial system greatly, and have hope that we will be able to allay this issue once and for all - for the greater good.

:twocents:

I truly hope that if the transcripts are released, this does not damage the State's case in chief, play into the defense team's strategy, or harm the LaMar's in any way.

I know the waiting game and strategizing begins anew for another of many chapters. It almost seems like too much to ask to imagine true justice for Sierra. And yet, I refuse to give up that dream.

It will happen, no matter how long it takes. Justice for Sierra will come to fruition.

:please:

The transcripts have been released. The forensic experts' testimony about the DNA seems to make up most of the documents.

The judge has placed a restriction that means the transcripts can't be uploaded online for us to read, so we'll have to rely on news reports for the info. A little disappointing, but I'm glad we're finally getting to see some new information after all this time.

Disturbing details found in unsealed Sierra LaMar grand jury testimony

Posted: 6:17 p.m. Friday, July 11, 2014
One detail that surfaced in the testimony was the discovery of hair on a rope inside the trunk of Antolin Garcia-Torres's car when it was seized on April 7, 2012.

The hair was the first and only bit of physical evidence from LaMar’s person that was found during the investigation where it wouldn’t already be expected such as at her home or on her own clothing.
The transcript also talked in detail about the discovery of his vehicle and Sierra LaMar’s cell phone also about black polyester fibers from the floor mats in Garcia-Torres's car similar to fibers that were found on one of her sweatshirts. more at link: http://www.ktvu.com/news/news/crime-law/court-clerk-releases-grand-jury-testimony-sierra-l/ngdpF/

Don't know if you've seen this one. It's from the paper that fought for the transcripts to be released
http://www.mercurynews.com/crime-co...ranscripts-prosecutors-say-sierra-lamars-hair

'Among new revelations in the transcripts were that Garcia-Torres -- who has pleaded not guilty to all charges -- appeared in police interviews to assume it was his semen that had led investigators to him, when in fact the DNA found on her clothes was of unspecified origin.

Garcia-Torres offered that he had ejaculated into a tissue and thrown it from his car, as a possible explanation for how the material somehow might have become associated with Sierra's clothes.'

Thank you zwie

I am in :tears: reading for the first time publicly what I've known for so long....

I need to step away and hug my daughters.

I will leave you all with this snip:

Steven Clark, a criminal-defense attorney and former Santa Clara County prosecutor, said the defense "has its work cut out for it."

"The defense now will have to do two things: create doubt based on other possible scenarios of DNA transfer and also fix that big lie which is, 'I never met Sierra LaMar.'"

Okay from this info. we now know for sure he sexually assaulted her, the clothes folded up couldn't have been a change of clothes-probably she folded them, she was in his car, and possibly his trunk.

http://www.contracostatimes.com/news/ci_26133623/grand-jury-transcript-be-released-case-murder-suspect?source=JBarTicker

Some information from the transcripts:

1. One of Sierra's hairs was found on a rope in Garcia-Torres's car.
2. Black fibers on Sierra's clothing were consistent with the interior of his car.
3. Sierra's shirt had dirt inside the back of it, which the prosecutor says is consistent with her being on her back and dragged by her feet
4. Garcia-Torres incriminated himself during an interview by telling police that his DNA was probably on her stuff because he'd often masturbate, ejaculate into a tissue, and then throw it out the window. At this point, LE had not specified that the DNA was from semen. Basically, he already had a detailed explanation for how his DNA would be on Sierra's stuff.
5. His alibi was that he was on a fishing trip and said he'd taken a different path to the reservoirs (a path that took him to Palm Avenues, not far from where Sierra disappeared), even though that path was in the opposite direction from said reservoirs.
6. His wife provided an alibi for him that day, but it fell apart once it was looked at closely.
7. He purchased bleach and a turkey baster only three days prior to Sierra's disappearance.
8. Video evidence from a bank and trailer park shows he had 6 hours to commit the crime, which is plenty of time to kill someone and hide their body.

ETA: I'm very curious to see the approach the defense will take. It's going to be really hard to come up with an innocent explanation for everything.

There are mixed reaction from the family of a missing teen a day after grand jury transcripts were released, detailing evidence of the man accused of killing 15-year-old Sierra LaMar...

Sierra's father spoke to ABC7 News about the grand jury transcripts that were released. He says it's tough to hear about the graphic evidence. "It's upsetting and not the kind of thing I want to read about what possibly happened to my daughter," Steve LaMar said.

From the above link -

The 1,900-page transcript lays out a case against Garcia-Torres based on several pieces of DNA and forensic evidence.
-Her clothes had fabric fibers from his red Volkswagen Jetta.
-When detectives searched his car, they also found her DNA on an armrest
-and her some of her hair was found on a rope inside the trunk.
-His DNA was also found on a pair of her pants recovered in a field near her Morgan Hill home.
