Looks like pt wants to get this ball rolling, no more excuses.bapparently, dt is not really communicating. Hasn't this guy changed lawyers more than once? Maybe if there is one judge he can get through the motions and tell the def. you can't quit, you have had this case for years GET AT IT!

Tiger09 I don't know. It's strange. Next week it will not be to set a trial date, but to assign judge to all cases to be the one

Emi, unfortunately we see this every time a case is a death penalty case. Most death penalty cases in recent years are taking at least three to four years to come to trial. That is the average time and some have taken even longer. The reason this is happening so often now is because of defense lawyers pushing the case back and wanting to stall it from coming to trial. And Judges gives more leeway to DTs when the case is a DP case.

It is in the best interest of the defense to stall the case time and time again. I cant remember one death penalty case where a defendant wanted to exercise his or her right to a speedy trial.

The reasons are two fold. IMO

1. Hoping the passions/media articles about the murder of a young innocent girl will die down where the jury pool will be picked from.

2. Jail is a much better setting for any defendant rather than being locked up in a maximum secure prison. The rules aren't as stringent and if its in a local jail the defendant's family can come to see them regularly. I think they have meeting rooms set up so they are face to face meetings in most jails. But in a maximum prison most visitors have to talk to the inmate behind a plexi-glass and never get to be within touching range of them.

While they say that Scott Peterson has the life of Riley now he didn't when he was first sent to death row. So if this defendant receives death he will be locked down alone in a cell for 23 hours out of 24 until he gains more rights to have other types of freedom in the prison.

If he is sentenced do you know which prison he will be sent to and how far away it is from where he is housed now? tia

This was one of the very first cases that really drew me in to websleuths - I know they say you shouldn't judge on beauty but I was so drawn in by how stunning and doll like Sierra was. Her personality just radiated from her and she truly seemed like such a funny and caring girl who couldn't do any harm.

I was thinking about this case as I fell asleep last night and a thought struck me that I hadn't considered before - Sierra was so small and little, so caring and subdued despite being so outgoing that chances are she didn't even put up a fight to this monster. She probably didn't even raise a hand to him, even amongst the confusion and terror she must have been experiencing.

Yes, San Quentin -- that's the place for males given the DP.

California's death row -- the largest in the country -- is expanding beyond the capacity of San Quentin State Prison to hold it. In response, Governor Jerry Brown has proposed a $3.2 million expenditure to make about 100 new cells available to incarcerate death row inmates.

"The body had been there for a while" I wonder if 2 and a half years is a "while", I am sure for the family it seems like forever. this is so close to where all the searches were originally done, i wonder if the body was from before and that is why it was not discovered in the intense searches right after Sierra went missing. though it would be wonderful to have Sierra brought home.

MHPD investigates body found in business park
http://www.morganhilltimes.com/news...cle_13602cc4-f4e3-11e4-99f1-af5310ce3727.html
Officers and patrol cars surrounded the entire block bound by Cochrane Circle, Cochrane Road and Monterey Road. The body was found at an unidentified spot inside this area, which consists of an undeveloped and overgrown field with tall grass, shrubs and weeds. The block, which is located within a business park, was also cordoned off with yellow police tape.

A small tractor sat in the field, but Ramos said he did not know if the machine was in any way related to the body.
