Defense attorneys Wednesday rested their case in the trial of two former Fullerton police officers accused of beating to death a mentally ill, homeless man two years ago.

Their final witness was a forensic pathology consultant. He testified that psychosis and a weak, enlarged heart brought on by years of drug abuse led to the death of Kelly Thomas, 37, who died five days after he was involved in a violent struggle with six police officers, including the defendants.

Superior Court Judge William Froeberg on Thursday excused jurors for the holidays for two weeks. Prosecutors are scheduled to call their final witnesses on Jan. 6, followed by closing arguments.

“Video evidence for asphyxia is compelling in this case,” Juguilon said. “It’s clearly documented in the video that the chest was compressed.”

Juguilon said he based his opinion also on reports, photographs, microscopic slides and prior testimony in the trial of two Fullerton police officers charged with homicide in connection with Thomas’ death in July 2011.

His testimony bolsters the opinion delivered earlier by Dr. Aruna Singhania, who performed the autopsy on Thomas, and contradicts opinions offered by two expert witnesses called by defense attorneys.

Well, how do you guys feel about the case? I have an empty feeling that it will end with a mistrial or acquittal. Leo Terrell is covering the case on his website, and has been attending the trial everyday. He is not impressed with the prosecution. I just hope Rackauckas hits a home run with his closing argument.

I, personally, feel that these officers went way outside of what should be procedure in how they dealt with Kelly Thomas. It is really horrifying that this seems to be "departmental procedure" when dealing with a situation that they instigated themselves!

I also think the DA has been less than energetic in his prosecution of this case. I don't know if he didn't want to do it, or is worried about future cooperation from LE, or what, but I am not encouraged with his prosecution.

From the video, Kelly Thomas didn't do anything to provoke this beating, and was only trying to defend himself from these awful cops who were out that night looking to hurt someone.

I just wish there would be some other LE officers that would come forward and say that they don't agree with how this came down. I know that all cops aren't bad. But, by their silence, it makes them all look bad. jmo

I feel for the Thomas family and hope they can obtain some sort of justice for Kelly. No solace there, though.

FYI, at Clear the Court Ron Thomas gave an interview and said the prosecution would be filing some motions tomorrow, 12/27, that he feels will help. We will have to wait to see what they are and whether they are allowed in. Hopefully, they will be something good.

I have a very bad feeling about the outcome as well. I live here in Orange County and it s a very conservative county. A lot of people seem to always side with the cops no matter what.

As far as I am concerned Kelly Thomas was brutally murdered. In my mind there can simply be no reasonable explanation for what those cops did to a mentally ill young man as he called for his father.

It's a disgrace. I am almost 60 years old. I hold down a job, pay taxes, own property and have never in my entire life been arrested, nor has anyone in my immediate family. Yet I have grown to hate cops. There are just too many examples of how they abuse their power and I believe the profession attracts a certain (sick) type of personality.

Yes, I am certain there are exceptions. There are probably honest used car salesmen, and politicians that don't lie as well. But the bad vastly seem to outweigh the good.

I am prepared to be profoundly upset by this verdict.

A judge ruled on Friday that prosecutors can see the confidential employment records of two former Fullerton police officers on trial in the death of a homeless man. The documents could play a crucial role in the trial.

The judge did not order that the documents be handed over on Friday, which leaves time for an appeal. The documents are expected to be handed over on Jan. 3, unless that appeal is successful. The judge has not yet ruled how much of the evidence jurors will see.

The jury will return to court from a two-week break on Jan. 6.

This is interesting (to say the least!) because Rubio, the Fullerton PD training officer, testified that Ramos & Cicinelli were acting within department policies.

Yet, they are no longer working at the department. Why? I am very interested to see
what these records disclose. Hopefully, they haven't been cleaned up by the department.
We shall see, we shall see.
I don't know of Clear the Court has some inside info or if he is just speculating.
