I completely agree. The defence lawyer has a couple of hundred clients, and his only job is to present a defence for his client based on the information provided by: his client, the prosecution, and the law. It is not his job to investigate, imagine, or postulate. Someone like Jose Baez would be out of a job in Canada because Canadian lawyers have to know the law and they are confined by facts.
It is not uncommon for lawyers to hire private investigators to aid in their client's defence.

It is my understanding that the mental health assessment that one is given in jail/prison, is to determine the levels for supervision in suicide watch. It is not used for defence purposes when determining mental fitness to stand trial. That is done through asking the court - A court ordered, SPECIFIC assessment.I found this info, interesting:
" The hallmark of the Strategy is its plan to provide a continuum of mental health care from admission to release into the community and up to the end of an offender's sentence.
The Strategy provides that all offenders are screened for mental health problems on admission and receive an in-depth assessment, if warranted. Much as people with mental illnesses in the community are generally managed by community based services and providers, most offenders with mental health problems are placed in regular institutions where they can access psychological as well as other mental health services. For those offenders with acute or demanding mental health needs, there are in patient settings at Regional Treatment Centres psychiatric hospitals whose catchments area happens to be the other prisons in the region." If I was sitting with a client against whom there was simply circumstantial evidence, if it were weak, I might be inclined to go pro-active and present a most cooperative, Boy Scout of a client.
If the best defense is sometimes a great offense....
I think if it becomes questionable then, there might be a request for more time, an evaluation etc etc.
The appearance may be quite telling tomorrow!
