Lawyers need to discuss a legal issue in #Garland trial regarding the next witness. The jury is dismissed for about an hour @CTVCalgary

We can sit in but not allowed to report anything that doesn't happen in front of jury until it's sequestered for deliberations #Garland Meghan Grant added,

Rural people burn their garbage, which normally means non-recyclable paper and burnable products. Food garbage is usually composted, recyclables are stored and recycled, and other garbage is taken to the dump. It is not true that all garbage is burned, although that is the impression given. The bottom line is that if all garbage was burned, the burn barrel would have to be replaced too often.

My point is that, from the crown's perspective, if they found bone fragments in the ashes from the first burn barrel, and put forth a theory that these fragments belong to the victims, the defence may dismiss those bone fragments as being from burned kitchen waste - beef, chicken or pork bones. By collecting the ashes from the other burn barrels, 9 months later, they are able to say "look, here's the difference between the ashes we collected with bone fragments we believe belong to the victims and regular ashes from an average burn barrel, same people, same property, presumably same garbage habits, no similar bone fragments in the ashes collected later"

PS I live in the country and you have not described my garbage/compost/recycle habits accurately at all. I don't think you can generalize for all rural folks as to how they dispose of waste.

IMO

Ah, its the evidence of the witness (not the witness themselves??). Sooo, the drill marks on the lock? Or are the locksmiths not coming next at all. More forensics??

Garland trial in voir dire over legal issue surrounding evidence of next Crown witness. Jury stood down for about an hour. #garland

  • #746
I thought it was the lock smiths today. What could the issue be with lock smiths?

The voir dire is usually to ascertain eligibility of the witness to "speak the truth" in this case may mean how is the witness deemed to be classed as an expert witness in order to "speak the truth"?? One of the locksmiths scheduled as a witness is a civilian and the other a CPS "expert".

Why this would not have been sorted out before the trial commenced I don't know! Taxpayers' money after all and they've had over 2 years to prepare.......

Perhaps if they can be considered an expert witness? Just a guess. I will assume CPS called in their special entry person or from RCMP to look at the lock that was drilled out.

How does one drill out a lock, assault 3 people and take them to a vehicle without making noise that alerted neighbors?
It was summer. Air conditioners were running. But still...

We had days of arguments at the Bosma Trial. They went straight to trial with no preliminary so it was arduous at best at times.

Air conditioners could hide some noise but it is important to keep in mind that this occurred during the weekend leading to the Canada Day holiday. Many folks, including possibly neighbours, would have been out of town.

We were out of town at the time in Montana and heard the amber alert on the radio as we were driving back to Calgary.

Regarding why this is just now being sorted, it's possible that the defense team is trying to frazzle the crown. Specifically in the Oj Simpson trial, the two sets of attorneys frequently would challenge evidence and witnesses say of, they forced the other side to prepare for witnesses they never intended to call, etc. I don't mean to make trial lawyers sound conniving, but it's not an outrageous idea.
