Is it common for the defense to concede that all evidence was treated properly? The only other trial I have followed is the bosma trial and I don't remember an agreed statement of facts regarding evidence collection. Why would the defense concede to that? Wouldn't they want to leave that little bit of doubt in the jury's mind that maybe the evidence was contaminated?

They'd need a legitimate concern or risk the ire of the court.

It does seem a little different from most trials I've followed. But perhaps this defence team knows the severity and sensitivity of this trial and has no delusions that their client is innocent and is being "fitted up" by LE and the Crown. Their main job in this trial may just be to ensure that their client receives a fair trial and that all procedures are done to the letter of the law and that there is no chance for an appeal when the final verdict is read.

I see that some believe that DG just wants to go through the motions of this trial to get everything out in the open about how he was wronged and perhaps feels somewhat justified in what he did. And perhaps he needs this trial to ease his own demented sense of entitlement and get the final word. Should be interesting if he decides to take the stand. If that is case, his defence team have no choice but to represent him. If they choose to do this by just making sure that everything was done according to protocol, then I could see them agreeing to a lot of things that they don't have any issues with.

I found it interesting that the one thing that I had a question with yesterday was the officer who claimed he thought it unusual as soon as he saw the router off in the home. I thought that was a bit of a stretch and he may have been elaborating his initial response and I noticed that the defense also questioned him on it. So they will question the things that they are doubtful about but perhaps just go with an ASF for the things that they wouldn't be questioning anyway?

I did attend a high profile case here in Ont. saw the same. Not much was challenged by the Defense. Saw to it Rafferty received a fair Trial. I actually liked the Defense Lawyer as shocking as that may be lol. Rode the elevator with him a few times and in line for coffee. Benign convo of course. In essence I agree with Kamille. Sometimes the evidence is so overwhelming there is not much to challenge. Especially in horrific crimes.

That's exactly the case I was thinking about Bravo! I do think that Derstine just made sure MR got a fair and balanced trial and that he had no chance for appeal. And after the initial shock of some of the things that went on, I did come to appreciate that he was doing what he had to do to make sure his clients rights were defended and therefore I really came to appreciate what he did and consider him to be an upstanding defence attorney.

I'm getting the same impression here.
