Yes!!! Two paths to first-degree murder for Nathan. There is no way he isn't getting first-degree on all three now!

I've always thought first degree for Nathan as well but I know some we're arguing possible second degree.

#Garland would have to have intended to restrict Nathan's freedom to move about for him to unlawfully confine him, says Gates.

  • #1,003
He contradicted himself...

I wonder if that would be in reference to Nathan.. DG intentionally killed N. but he did not plan to do it?

Jurors can also consider whether evidence from home leads them to believe Nathan was taken from the home alive, says Gates. #Garland

If #Garland unlawfully confined Nathan before killing him that would be first-degree murder as well, Gates explains.

Still on subject of 1st degree murder question of O'Brien, Gates goes over factor of "unlawful confinement" #Garland #yyc

Lucie Edwardson ‏@MetroLucie 1m1 minute ago
If Nathan was "unlawfully confined" (mentally, physically or was injured) that would be 1st degree murder as well #Garland #yyc

there is is.

Bingo....that is means to find him Guilty of 1st degree in Nathan's death. Gotcha!

If they believe he was alive, Gates tell them it's likely Nathan, a 5y/o, was under control #Garland control #yyc

"Gates notes a murder can be intentional without being planned #Garland"

2nd degree murder?
Yes, I believe that's what he's referring to

He contradicted himself...
I disagree. You can intentionally kill someone without it being planned. Anger in the moment and you shoot to kill. Not pre-planned but you meant to kill.

The confinement and murder of Nathan O'Brien would need to be considered as one event, says Gates, for it to be 1st degree murder #Garland

Kevin MartinVerified account ‏@KMartinCourts 2m2 minutes ago
Jurors would have to find #Garland murdered Nathan while continuing to confine him for it to be 1st degree murder, says Gates.

"Nathan's presence in the residence was in all likelihood a surprise," says Gates. #Garland
Yikes!! The judge should not be giving his opinion as to what occurred.
