This is why Josh phoned the police and created the lie that Caitlan was suicidal and she ran from their apartment (on her mom's last night in town-last chance to be saved) while screaming. Josh thought he was so clever that he could restrain and control Caitlan forever. Lock him up!

Christie Blatchford: Defence suggests Coleman’s volatile relationship with Boyle was more consensual than abusive April 3, 2019

At various times, he suggested either specific alleged assaults or sexual assaults didn’t happen; that she drew up a list of rules (including back rubs and oral sex) for Boyle as he had done for her; that Coleman had asked to be spanked, or, controversially, that she had “agreed to let him try” anal sex.

Coleman had just described how Boyle had tried to penetrate her anally. Greenspon then said “if there is evidence that any anal sex which happened in Ottawa was consensual, what would you say to that?”

The question brought prosecutor Meaghan Cunningham to her feet to object, and in legal arguments shortly afterwards before Ontario Court Judge.

Questioning a sexual assault complainant about previous sexual activity or whether she had consented to similar activity before is prohibited by the Criminal Code because it suggests that an un-chaste woman is more likely to consent or is less credible.

She collected her passport and of those of their then three children, because she said, Boyle often spoke of how he wanted to “return to the Third World,” and she feared he might take the kids.

Her testimony will continue later in the trial, but via video conferencing from the United States, where she lives with the couple’s now four children.

The trial continues Thursday.

At this time, Caitlan has temporary sole custody. If Josh isn't jailed, what will happen to the temporary custody arrangement? Will it immediately end?

Josh's attorney certainly must be aware of this criminal code. I hope the judge is tiring of his strategies.

At this time, Caitlan has temporary sole custody. If Josh isn't jailed, what will happen to the temporary custody arrangement?

We don't for how long the Family Court judge granted her temporary sole custody nor when it will be reviewed again
We also don't know if either one of them has filed for divorce. If they have it has not been reported.

Josh's attorney certainly must be aware of this criminal code. I hope the judge is tiring of his strategies.

I would guess that, a high profile attorney who has been practicing criminal law for as long as he has, Greenspon is aware of that law but tried to get around it anyway in order to put forth a vigorous defense for his client.
The Judge did have words for Greenspon

" the judge said Greenspon was “edging up to one of the (so-called rape) myths” and told him if he wanted to continue this line of questioning he would have to bring a special application before him.

Greenspon then amended his question and asked if on this specific occasion in December, “it was consensual, yes?”

“No,” said Coleman. “I am certain I did not let him try.”

“I suggest Josh convinced you to try anal sex by guilting you into it?” Greenspon said.

“Not in this specific incident,” Coleman replied. “There were times like that, though.”

I wondered about that line of questioning.
Did Josh have some written document from her, did he record something?

What else could that mean except a video of the act? Or if she wrote a note afterwards, perhaps? Seems like an aggressive tactic to take with this victim.

Is this a jury case?
