Casey Anthony's defense wants prosecutors removed

As my 12 yr old would tell them "oh give me a whine burger and some french cries."

I can't wait to watch the Judge rule on this motion.

I hope the judge requests that JB submit all future motions on toilet paper, as I can't think of a more fitting vehicle for his "legal expertise". :)

Ya see, that's what concerns me...section 3 may be a veiled reference to what did or did not take place in regards to the August 4 visitation. Yes, in the end, Casey was the one who agreed to the visit. No getting around that. I think JB is mighty angry and hopes this motion if heard will open the door to questioning the prosecutor's office and (in his mind) will ultimately reveal some slick maneuvering on the prosecutions part. IMO, George wanted it...needed it. JB is reaching. I truly think the court will get tired of JB long before trial.

If this is in regards to the parental figure visit with Casey that was just released, I think it is impossible for a defense attorney to tell the courts, the jail, or the investigators who can and who can't talk to his client. He can only control his client and if she chooses to visit with relatives the jail cannot stop her.
 
This is crazy.. Reading this motion was like listening to my 10 yr old tell me why he hit my 6 yr old.

This is a game I believe, more smoke and mirrors. I see that JB will be very busy distracting in the months to come. Filing motions against the prosecutors, filing motions to keep his client out of court, possibly even trying to cast a shadow of doubt on the judge to rule in this case. Coupled with the rumor and innuendo that is already flying. LA is going to be charged (his lawyer speaking), the A's lawyer stating that he is already working to have a funeral/memorial (don't know which actually) in the jailhouse. OSCO has denied that they've recieved any such request.

I wonder if the A's lawyer and LA's lawyer are working in conjunction with JB to defend KC? You know trying to assist in creating a better image of KC, cast an aura of KC not being treated fairly? Just a thought.

If that's not illegal I'm sure they are.

ITA...but in JB's warped mind he views it as an attempt to usurp his power. IMO he's throwing a temper tantrum...and as to not be directly connected to this motion (and possibly being viewed as a perpetual "whiner") he has LBK sign off on it. I find it odd that she penned her name on such a ridiculous request as she is onboard as an "expert".
 
JB is crying about leaks to the press from LE but even if LE leaked nothing, it would all still come out to the press before the trial due to the Sunshine laws of FL. If JB doesn't like it then he should work on getting the FL laws changed. I don't know how or why he thinks the prosecution should be recused because of leaks to the press! Somehow he thinks he and his client are special. Wasn't it the prosecutors that wanted a gag order and JB would have none of it? Usually a gag order is placed in cases like this and it should have been allowed in this case.
 
I find it very interesting that this is the first motion - if I remember correctly that was filed by someone else other than JB. Ms. Baden filed this motion, it is her signature on it.

If they got their info scrambled and thought the State's Attorney ratted them out, I can see them biting back at them. If, on the other hand, the SA just forwarded complaints they have received - then someone at JB's office did not do their homework and they are going to look foolish. While Ms. Baden may be aggressive, brash, abrasive, etc. the one thing I would not call her is foolish. If her name is on this motion, I think she feels there is merit to it. I wonder if she will be in the courtroom tomorrow to argue this motion herself. She better not leave it to JB, he does not have a good track record so far :)
 
Isn't it funny that he uses WFTV as the basis of his claim against the state attorney's office -- the same station he has repeatedly berated as being a tabloid, trash station that makes up stories and doesn't get their facts right.

Guess when it works in his favor, they're credible after all! :crazy:

There was an update on the local Orlando radio so I'll paraphrase it (87.7 station):

They were saying the Baez has reason to believe "someone" from the State's Attorney's office sent in a complaint or information having to do with the complaints filed against Baez with The Florida Bar. Thus, since Baez "thinks" someone from the SA office is trying to get him in trouble with the Bar (and perhaps removed from the case) that this complaint interferes with Casey's case. He wants ALL the attorneys removed from the case and the Casey's trial moved to another office. Oh brother...

I read the motion itself and I "get it" now:

To explain, Florida Bar complaints about Florida attorneys are sworn to by individuals.

Baez cites "anonymous complaints" and as I mentioned before The Florida Bar DOES NOT open files on "anonymous complaints" as they must be sworn to.

Then it dawned on me that the Florida Bar has an ethics hotline. It is supposed to be anonymous. Florida attorneys can call and field their issues through The Florida Bar and get an answer to any of their ethical questions. Frankly, it is a wonderful service.

I wonder if something happened through the ethics hotline and not a sworn complaint.

The ONLY other situation I know of (in which a person is not individually swearing about their complaint) is for when an attorney is charged by an agency for illegal activity (like arrested by law enforcement) or an advertising complaint. If an attorney makes the papers because he drives drunk and gets arrested then the Florida Bar simply gets the paperwork and opens a complaint.

If The Florida Bar is made aware of an advertisement that violates the rules they will open a complaint (especially if they see it in a paper or on television).
 
This seems like a "be careful what you ask for" situation to me.

8.If the Court feels it does not have enough prima facie materials to order reclusal at this point, it has the authority to further order a hearing and allow the agents of the Prosecutors Office to be placed on the stand under oath and be cross examined in this matter.
I would so love to see this hearing be ordered. This would open the door to the SA to expose all the nefarious activities of PCM, reveal who is really paying Todd B and investigate any deals made to profit from the case.
Did I mention that I would so love for this hearing to be ordered? :rolleyes:
