No, but it makes one wonder why a forensic specialist retained attorney is filing a recusal motion. I can guarantee you an attorney did not draft this motion--it is absurd.

It sounds like JB may be a tad upset with the State. IF he is sticking around Orange County after the trial to continue with his practice (as he has said) he might just want to be careful who he messes with, they will no doubt be sticking around Orange County, after this trial, as well.

Every attorney has an ethical obligation to report ethical violations to the State Bar, including the attorneys at the SA's office. That Florida made the reporting of such violations anonymous is irrelevant to the issue. As an aside, that someone told Eyewitness news something --a quote that is not cited to the actual source BTW-is not a proper matter for judicial notice. This guy is a bozo. I wonder how much more of this tripe the judge will put up with before he starts sanctioning JB for frivolous motions.

Heck, nothing would surprise me at this point. Who knows who filed the original complaint, but "if" I happened to be the parent of such a child on trial, watching JB, being barred from access to my daughter, hearing about these "sources" of possible monetary deals, feeling more and more every day that he might not have "my" daughter's best interest at heart, I'd use every resource at hand to remove him. Just saying...

I don't think this motion has a thing in the world to do with Casey's constitutional rights. I believe JB is simply royally pissed that his reputation was questioned and is trying to strike back. Unfortunately, looks to me that his "helpers" from the law school came up with this one. I'm surprised LKB agreed to sign such a badly drafted and ridiculous motion.

I would dearly love to see that hearing he asked for happen, though. Does he really think he's got more on the state attorneys than they have on him? He won't get his wish, but it'd be fun to watch the state have their turn at him if he did.

I think JB knows this motion won't be granted and is just trying to do a little PR via the court system to boost his image. It's gonna backfire on him, IMO.

Then on Tues he shows up in front of the judge with a newspaper clipping about KC's appearance and wants to use it as a reason to keep her out of court. :waitasec:

Seems to me ol' Jose would start deposing the over 100 witnesses on the state's witness lists. At this rate he won't be ready for trial till 2010

And if he was paying attention he would have known that someone complained to the SA's office and all they did was pass along the complaint to the Florida Bar.

I guess he'll want all the evidence thrown out as well and ask that the charges be dismissed. Or maybe he'll sue the prosecution for unfair prosecution of his client.

Todd B's latest piece of PR carp makes it sound like SA filed a complaint with the bar, because of the whole "SA is only going to Grand Jury because of elections yadayada" and OF COURSE- JB had NOTHING to do with that statement, it was just the PR guys doing their job.....:waitasec:

WTF....Can the JB Hole in the Head Gang get any whinier and goofier? Remove the Pros. because info was released under the sunshine laws; the SA forwarded info (as I assume they are required to do) to the Bar Assoc that there were media reports that JB had some backdoor deals going on (which I think is something that the Bar would look into and say yay or nay...if nay, then JB is cleared and that's that); and it's certainly NOT FAIR (picture JB whining) that "sources" (who could be anyone-including someone in JB's office or TH like LP sometimes tries to be) gave info to reporters whose JOB is to develop inside sources so they can scoop the competition!!!!

I can only hope that Judge S. will hand JB his butt on a platter when these motions are heard.....:slap:

At first I thought at least JB is citing cases...but guess what folk, he's citing the WRONG cases! Gideon v. Wainright said the court has to APPOINT counsel for defendants who cant pay for them...

I HOPE the SA forces a hearing on this, to say - the defendant filed no income tax last year, so she has no income - who is paying for her counsel since its the courts job to appoint one, according to JB.

I am not saying anything bad about his character, but I really think he took out a first year criminal procedure book and is citing from the index. This is INSANE from a lawyer point of view.

As far as I'm concerned, if they're going to delay the trial, then let's delay it for about 75 years. Wonder how KC would like sitting in a jail that long waiting for her day in court. JB's future grandson could take over the case, all of the witnesses would probably be dead already, most of the evidence would either be lost or forgotten, the public would have forgotten about the case as well. Then again, all she would have to do is open her mouth and the jury in the year 2084 would convict her in a minute.

Judgment day is coming, KC....get ready!
