There's the reason Mr. Padilla will use for revoking the bond and returning her to jail.

I wrote this on the Nancy Grace thread bringing it here:

Did you notice at the end of the show that LP said there were to be demonstrations on Monday and we are already getting increased threats. He then shakes his head and says "worrisome". I think that he is leading up to saying, we can no longer be responsible for her safety.
IMHO She may be back in jail by tomorrow if not sooner.

Well, if Casey was in a position to prevent an accident but couldn't because of her impaired state, then it might not have been a true accident in the first place. Under those circumstances, Casey could be charged with something.

I think that the original poster was asking what would have happened if Caylee truly died from an accident and Casey notified the authorities within a reasonable amount of time. It was a hypothetical question. No one was suggesting that Caylee died accidentally -- not that there's anything wrong with making that suggestion anyway.
NO clue...too much for my itty bitty brain to process...it's all yours...LOL

I believe no matter what actually happened on purpose or accident, she did call for "help" or "attention" between 4 and 4:25pm on June 16th. No one answered. The rest of all this is the fallout. IMO
I understand what you are saying. Technically I think you are right. But I can't figure out what in the world made her quit calling for help. There is no excuse for her being out partying without a care in the whole wide world to all appearances.

Beagle I missed that. I did hear him say that Tony will make a decision tonight as to whether or not to rescind her bond.
I hope he does.

So everyone is saying that Caylee is dead and was in the trunk of the car.
Is this accurate or just a new story? Why is the State AG office involved in this. That usually means that there is some scope of this concerning areas outside of just Orange County. If I am wrong someone please feel free to jump in and explain.
The 'news' report is claiming that is what the FBI said. Doesn’t the FBI make their own statements or at least other LE says based on tests back from the FBI. This ‘report’ hasn't been confirmed [that I can find by anyone else other than other news agency picking up the same story.], says the tests confirmed that there was a dead body in the trunk. There was hair that DNA says is Caylee's. Nothing about the stain
JB says he has no knowledge of any report on DNA or decomp test from the trunk.
LE is not saying yes and they are not saying no that this report is correct.

So, if this report is for real, there was a dead body in the trunk and there was hair in the trunk that matched Caylee but does not mean the body was in fact Caylee. If I understand the process the stain would be the thing that would say the dead body was Caylee. Caylee's hair, unless it had decomp material on it and that decomp material was in fact proven to be Caylee, could have been placed in the trunk or transferred to the trunk in normal day to day activity. I.e. blanket, clothes she used.

Something my husband said yesterday really rang true when I FINALLY got to AH's sworn statement. He said, with all her craziness, lies, stealing, talking bad about her parents, etc., Cindy and George are lucky she didn't kill THEM.

The whole story about taking over the house, etc. is just sooooo bizarre. That was NEVER going to happen, so why take this friend for a ride of moving into the house. She was obviously looking to get out from under the control of her parents. Staying at all these friends houses, etc. looking to move in. That myspace post of just a few more days and all the girls living together. She had to be planning something....just one more thing in her twisted mind that doesn't add up.

Maybe she had some crazy plan to off her parents and realized that would be too tough, so get rid of the source of her jealousy.

I've cried so many tears over this in the last few days I can't even count.

But covering up an accident..leaving the scene of an accident and the lying about your participation in the accident and said coverup is a crime.

I am in total agreement with your interpretation of what we know. I was merely indicating what some of the defense's remaining tactics might be, even when it seems that their backs are against the wall.

Just back from the NG thread...at the end of the show, LP said that he had just heard from some of his "people" and they were going to have to put major security on Casey because they've received lots of threats since this latest info was released...

I wonder if he's saying that in the hopes that that info, combined with what must be escalating tension in the house at the moment, that G/C will decide it's better for Casey to be in jail and THEY will instigate it...and then the Padilla gang had nothing to do with Casey' winding up back there.

I totally agree..she had walked from her parents due to issuses with Casey's stealing money and issues with her life style, and with Caylee and her lack of mothering..so to get back at everyone and maintain her pride she left with Caylee. But she was used to sleeping around with different boyfriends for a place to crash..but she wasn't used to Caylee being there 24/7. She had crashed with Caylee in tow many times before, but mostly I think that Caylee as with Cindy and George overnight ..but the 24/7 thing wasn't there..which leads me to believe that once the guys were at work or school, her parents were at work..she went back home, slept and put Caylee in her room...maybe locked the door..but Caylee got out and went in the pool and the rest is history.

They did accomplish one thing. A helluva lot of publicity for $50K. Which is what I think was their objective, to begin with.

Leonard paid the bail to his nephew who could actually return it to him. So potentially it cost him zero.

Hey, guys, I hope that you all will allow me to do this every once in awhile....

We are so glued on this case that we may not be checking the weather, so I'll post updates in general discussion threads as the situation is updated.

Here's the last NHC cone of potential landfall. If you're anywhere in the shaded area, get all your vehicles gassed up, get your prescriptions filled, put your important paperwork in ziplocks in rubbermaid tubs, and get food, water, and ice. Just in case.

Yep.... I had forgotten about the calls...so true.
And as far as not confessing later ...for the same reason Joran Van Der Sloot won't confess...his freedom depends on him keeping his mouth...no morals...no sense of right and wrong...it's all about them at whatever cost.

Should Casey take their hand and take them to the body, LE can still charge murder, LE can still try the case based on evidence LE originally discovered. LE can use their own originally discovered evidence discovered AFTER Casey locates the body. What they could not use is forensic evidence located by a coroner's autopsy, for instance -- because that comes from the body that Casey found for them. Under the deal, LE could not use anything Casey said to them pursuant to the deal. See, if they make an immunity deal, ONLY the evidence Casey shows or tells them covered by the immunity deal is off limits to prosecution.

These are very tough legal concepts, Gigi, I applaud you for giving it the effort to understand it. Good for you!

If Casey claims the death came as a result of an accident but autopsy shows intentional killing can they then use that autopsy report in the prosecution even though she led them to the body?

There is a link to the news article about two pages back from this one. According to that the stain came back positive also.
If I read the article correctly there can be no doubt to anyone that LE believes all the evidence was positively Caylee.

Let me ask you this....I read tonight on one of the Orlando sites that the States Attorney is handling this. Or that the State Attorney said that she is invited into their office to give them information.

Is that because its not in a city...its in a county?
It is not a matter of geographical jurisdiction. The crime is a violation of Florida penal statutes and the office responsible for prosecuting such violations is the States Attorney. Some cases, depending on the facts, may require the State Attorney General to grant the immunity. A CITY attorney might prosecute violations of city ordinances. But, without making this too confusing, the prosecutor for this case is the States Attorney. That is a person who has assistants or deputies. Usually it is an elected position. Because this is an immunity issue and the States Attorney is prosecuting it, only the States Attorney can handle an immunity deal. LE cannot grant immunity -- only the head of the proper prosecuting office can do that.

I'm trying to catch up...between the server going down and the news reports coming fast and furious, I never made it to the grocery store.

It is 9:26 and I have just finished dinner........bacon, eggs, grits, cantelope and toast.

I LOVE breakfast for dinner, but have no appetite....my heart is still breaking for Caylee.
