Should Casey take their hand and take them to the body, LE can still charge murder, LE can still try the case based on evidence LE originally discovered. LE can use their own originally discovered evidence discovered AFTER Casey locates the body. What they could not use is forensic evidence located by a coroner's autopsy, for instance -- because that comes from the body that Casey found for them. Under the deal, LE could not use anything Casey said to them pursuant to the deal. See, if they make an immunity deal, ONLY the evidence Casey shows or tells them covered by the immunity deal is off limits to prosecution.

These are very tough legal concepts, Gigi, I applaud you for giving it the effort to understand it. Good for you!

Thankyou! I so appreciate you taking the time to explain it--I never knew that and it's so interesting, compelling and now I know why you can fall in love with the law.

Themis.. you seem very litigious..

Here is how I see it :

Casey probably had an incident with Caylee that was an accident in nature. ( i.e. accidental drowning, fall down stairs etc )

Had she called POLICE or EMERGENCY SERVICES immediately, is there anything she would have been charged with? IYO?

You know Casey is self centered, narcissistic etc but I do not believe she accidentally killed her. I don't think it was a hot car or anything. She is so sociopathic and outside of the norm that I think she blew up and killed her...and justified it by blaming mom and dad and everyone else in her own mind.

And that is just how I see it. Could be wrong but who would get charged with murder if it were an accident? Not her, IMO

Me too, Katie. I posted earlier that sharing this with all the sleuthers has been the only salvation during this horrible case.

:blowkiss: to all sleuthers!

I too love WB and all the wonderful sleuthers here.:blowkiss::blowkiss::blowkiss: I also think we have a ways to go before this case is put to rest.

:blowkiss: I pretty much thought you knew that. Completely understand your opinion too. I'm here watching this board too.

And don't you go anywhere! We need your legalese on this one!! And thanks again!

I really don't think they knew. If they did know I don't think they would've even called the police. I feel terrible for them and I am sure they will blame themselves for the whole thing.
I agree they are very very odd but I believe they loved Caylee very much, maybe more then Casey even.

I agree they loved Caylee very much more than Casey but early on, thay knew and have done nothing but set up roadblocks to get at the truth ever since. How long ago was it that Cindy said she had already lost one and wasn't going to lose another. She knew then...yes they knew. IMO

My concern is that if the Prosecution and Casey agree to this immunity deal (by the way, ONLY a Prosecutor with authority to grant immunity can offer this immunity deal -- not LE), then if Casey leads them to the body it is going to splash all over national news. HOW would they find a jury pool that doesn't know about them finding the body?!?!? Any potential juror living in the Orlando or Florida area who didn't know about finding the body would have to be living under a rock and I'm not so sure they would make a good juror!

Looks like the prosecution could be backed into a corner and HAVE to make a plea deal favorable to Casey after that.

Child endangerment, child abuse, neglect, involuntary manslaughter....all after an investigation. The invest. would determine the charges, and if Casey acted as she has during this invest., they'd probably charge her with the biggest one they could.

Nancy feels so bad for the hell the GP's are going through?! Huh? Wake up Nancy...they made their own hell and now must live with it. No pity from me.

The only pity I have left is for Caylee, and the whole wealth of people who will never have the opportunity to meet her and love her as she grows up. My sympathy bucket is plum empty.

They both need to grow up. Its their fault shes hanging out at home right now instead of sitting in a jail cell breaking down everyday.

I don't feel bad for EITHER of them. Most of the information was already out when they jumped on their horse to rescue Casey under the guise of gleaning information. He and his media sleepover make me sick to my stomach and he is now changing his tune to save his reputation. He would have to be pretty dimwitted to not realize what a liar Casey was when he bailed her out.

I have no tolerance for either of the Padilla's and in fact they infuriate me even more now then they did weeks ago.

They accomplished NOTHING other than giving a potential baby killer comfort and a respite from jail.:furious::furious::furious::furious:

They did accomplish one thing. A helluva lot of publicity for $50K. Which is what I think was their objective, to begin with.

If LE was convinced that Caylee's death was truly the result of an unfortunate accident, as your hypothetical suggests, and that Casey in no way contributed to the accident, they would probably not have charged Casey with anything.

Accidents do happen occasionally. Accidents are not a crime.

Let me ask you this....I read tonight on one of the Orlando sites that the States Attorney is handling this. Or that the State Attorney said that she is invited into their office to give them information.

Is that because its not in a city...its in a county?

PRELIMINARY FBI RESULTS LINK DECOMPOSITION TO CAYLEE ANTHONY

http://www.wftv.com/news/17315205/detail.html

Preliminary results were back from FBI tests on physical evidence found in the trunk of Casey Anthony's car. The samples, which included hair that investigators said was scientifically linked to Caylee, a stain and dirt, came back positive for signs of decomposition. Investigators said more test results were expected.

Wouldn't the DEFENSE have to worry about that too?

This will be a repeat for a lot of you--but bear with me cause the server has been overloaded and I want this to be read by all our posters.

I want to make sure you all read this!

I also wanted to take a moment to say something to ALL THE POSTERS HERE: Every single one of you despite these horrible circumstances that brought us together, has given me so much faith in how truly giving, wonderful, caring and determined we all are despite our differences to see justice done for the victims that have no voice. We are their voice and we may argue, laugh, cry and despair but we are all united in this one thing. I have grown immensely, learned immeasurably and found things within myself that have been dormant far too long. I thank each and every one of you for that. Carry on the good work and thankyou for being here.

I'm not generally a supporter of the death penalty but do make an acception when it comes to children. They should be protected and avenged at all costs.

But I do think GiGi that Life without parole is sooooo much worse than the death penalty. There is no end to your misery that way. Casey would have to suffer for YEARS on end in a jail cell, growing old and becoming institutionalized. Did you see her after only 30 some odd days? She looked 100 years old when she got out.

I've always thought that LWOP is the best punishment for offenders like Casey.

SHE SHOULD ROT THERE! imho

We agree again.

Let her live her life in FDC. Let her become a number. Let her be in a place where corrections officers control EVERYTHING she does.

No myspace. No beer pong. Just body cavity searches and inmate haircuts.

If there's a hell on earth for Casey Anthony, it's life without parole.

snipped for space
Bold is mine. ?How could they forfeit the possibility of charging her with Murder 1 based on cause and manner of death pursuant to an autopsy????
Am I interpreting this properly?

Hi All-
I just registered today but have been lurking from the start of this sad case. I love this message that you wrote and I have to agree, you have all been Caylee's champions.
As a new mother of an adopted daughter, I cannot comprehend the antics of this family.
I go home everynight and as I hug my wee one, I whisper a prayer for Caylee.

I'm just sick over this. I was holding out hope that she was alive but after the documents and the Body Farm news, it is pretty clear that she's not.

I'm still hoping it was an accident and she did something stupid but I'm doubting that too.

So many lives shattered... how did Casey end up like this? One thing that really grips me in cases like this is what the turning point was that led a person to the point where something like that happens. Even if she had considered abortion or adoption, surely she did not give birth to Caylee and ever imagine that one day she would kill her. How does this happen and at what point does this happen? This is the thing that always gets me in these kinds of family on family cases... Mark Hacking and Scott Peterson probably didn't expect to kill their wives one day and probably would have been horrified at the suggestion that they would. I just always wonder about the turning point.

Rambling, sorry...
