It wouldn't surprise me if Cindy was putting what she could into a foundation for Caylee so it wouldn't be lost in a law suit.

It would also make sense that this may be the very reason it was denied. She's in the middle of a law suit, she can't go moving funds at the moment.

When late hubby and I did estate planning, our attorney set up trusts. He didn't mention family foundations.
different animals. there are so many different kinds of trusts too.

I wonder if CA was more concerned with someone else taking the name so she filed?

She was approved for a dba/ Fictious Name

Don't have any info as to if acquiring the name is the first step in proceeding with a corporation.

amazing....she doesnt even feel badly for her daughter ruining zanidas life these last few months. The least zanida could get is a few dollars for all this grief.

Hmmmm....she apparently met all the qualifications? I mean, I didn't notice a newspaper ad (See 'D'), but then, I wasn't looking for one. Do newspapers archive those online, anyone know?

(a) The name to be registered.

(b) The mailing address of the business.

(c) The name and address of each owner and, if a corporation, its federal employer's identification number and Florida incorporation or registration number.

(d) Certification by the applicant that the intention to register such fictitious name has been advertised at least once in a newspaper as defined in chapter 50 in the county where the principal place of business of the applicant will be located.

(e) Any other information the division may deem necessary to adequately inform other governmental agencies and the public as to the persons so conducting business.

Such statement shall be accompanied by the applicable processing fees and any other taxes or penalties owed to the state.

A family foundations are good estate planning tools.they are good tax saving vehicles.

That isn't filed as a family foundation.

Well, technically she is. The ZG lawsuit is against Casey and also CA's homeowner's insurance policy, I believe. The policy would be in CA's name since she is the sole homeowner so technically she is involved. Just my opinion, I'm no expert (and it's 1 am, yikes!) :)

To set up a family foundation you have to have a 503(3)C charitable trust set up and back to the bankruptcy problem. You also have to file a charter for a corporation and my guess is she tried to do this and didn't know what she was doing.

In addition, she also must file with the county for a Business Tax Receipt (certificate). The county can then charge an Annual tax on Personal Tangible Property Assets such as business equipment and so on.

Setting that up now is not going to avoid the judgment of any lawsuits filed prior. She is just setting herself up for her insurance company not to pay and them taking her assets. She needs to stop this nonsense before she ends up in jail.

I'd disagree with that because the suit is against their homeowner's policy and them, and they can't put the house in the Foundation. Esp not since they've been served with notice of the lawsuit, they can't try to dump assets into a foundation.

That is what I just said............she is going to get in a ton of trouble if she is tying to bypass the courts and any judgment ZG will receive.

who do you suppose is giving cindy this advice ? she wouldnt know to do this stuff on her own would she ?

There is also the advertising first and having the incorporation set up first. There is no corporation set up, I just checked. No wonder they rejected it.

I would think an attorney would give her good advice and not have the business entity rejected! Just my opinion, lol.
