The Utah County Commission has officially appointed attorney Kathryn Nester to represent Tyler James Robinson, the man accused in the high-profile murder of conservative commentator Charlie Kirk. Robinson is alleged to have shot and killed Kirk on the Utah Valley University (UVU) campus earlier this month.

The Commission unanimously approved the contract appointing Nester after the court determined that Robinson could not afford private counsel. This action fulfills the county's constitutional duty to provide legal representation to indigent defendants, in accordance with Utah law.

We are not going to stream it since he will not be appearing today. We will have a report on it later. This is what we received from the court: “Due to a request from the defense, Tyler Robinson will no longer attend Monday’s hearing in person. He will now appear remotely from jail without video."

Tyler Robinson will be in court on October 30th at 10a MT for a preliminary hearing. His defense requested to push today's hearing because of the amount of evidence they will need to go through.

Tyler Robinson, facing death penalty for allegedly murdering Charlie Kirk, has three court-appointed attorneys: Kathy Nester in Utah, Richard Novak & Michael Burt in California. They’re experienced: I met Burt in Idaho 12 years ago when he represented serial killer Joseph Duncan.





Joseph Edward Duncan III was a serial killer who committed multiple murders, most notably the 2005 killings of the Groene family in Idaho. He murdered Brenda Groene, her boyfriend Mark McKenzie, and her son Slade, while kidnapping her two younger children, Dylan and Shasta, leading to Dylan's murder and Shasta's eventual rescue.

his lawyers want Judge Tony Graf to allow Robinson to wear his own clothes during hearings. They also asked that Robinson be unrestrained going forward.

The defense argued a jury could be swayed by the sight of Robinson in jail clothes and shackles, while civilian clothing would make him, as reported by Court TV.

To make their case, they noted a 'highly publicized death penalty case in Ada County, Idaho' - referencing Kohberger, who was allowed to wear a suit and appear without his handcuffs for his pretrial hearings.

have asked Judge Tony Graf to ban cameras in the courtroom.

Shortly after proceedings started,
Judge Graf ordered all press and public to leave the room.

The defense asked the judge to allow Robinson's parents to stay,
which was denied."

Stil in the hallway. No updates.

Okay, they just let us back in the Tyler Robinson courtroom.

Tyler Robinson judge says during the short public session this morning, there was an alleged violation. Defense says the live stream is threatening Robinson's right to a fair trial. They say his shackles are visible in the live stream and documents on the lawyers desk were filmed

Tyler Robinson's defense wants the live stream stopped immediately and the camera thrown out. State seems to be agreeing.

Judge says there was a violation involving the live stream in Tyler Robinson hearing. But he says he won't thrown the camera out.

The judge is moving the camera to the other side of the courtroom.

Now another break -- so the camera can be moved.

I have to say - I was surprised how close the camera was to Tyler Robinson and his defense table. Never seen it allowed that close.

They are now discussing the gag order in the Tyler Robinson case. State is asking for clarification who it applies to. Who is not allowed to talk publicly.

5:00 pm ET Gag orders are interesting. Sometimes they back fire and breed more misinformation and create a frenzy of rumor.
