There were a couple dozen family and friends of the mcStay's attending today. Some traveling from out of state. After a decade of being silenced, today was their day to speak. I'm sure those loved ones set to speak today had prepared, putting the hearts and souls into choosing the right words.
This is another travesty playing out today.

Imes trying to rehabilitate McGees decision not to put their cell expert, Vlad on the stand. He bolstered McGees argument that he had sound legal strategy behind that decision.

I don't think the motion for Ineffective Counsel will succeed.

Right now I think it's about when and how they got additional cell phone records that the State was using in Boles direct examination, the defense didn't have them at all by the sounds of it.

*I don't recall this. But this was during the time that L&C pulled out and we only had audio. I am not sure if it was addressed in open court though. Anyone else remember this?

I think they failed at proving the bolded, as well. JMO

Judge ruling now... if we could only get him to talk faster!!!!!

I do hope they get through the sentencing today. The families shouldn't have to come back. Get it done.

Judge on Ineffectiveness of Counsel---the claim being made by defense that McGee failed to meet the standard of effectiveness is on them to prove. They have failed to do so.
An informed competent tactical decision was made by McGee. And it was in the best interests of his client.

He indicated that McGee reviewed all of the info from his expert and was in constant contact with the expert and made his decision, with the expert, that it would be counterproductive to put him on stand.

The judge also said the remaining arguments by defense, that McGee failed to understand or argue about the calls and the issues with the Azimuth, were FALSE.

Merritt has his head in his hands, once again.

I hope to never hear the word azimuth again. You know how when you say a word over and over it stops sounding like a word? That's where I'm at with azimuth.

One thing I have to say about this judge---he has tremendous recall and has an amazing grasp on all of the legal details of the trial. He really is on top of it.

Chase was pinning his hopes for freedom on that word Azimuth. Judge is now shooting that down.
