I know I read somewhere that defense can ask for a continuance 3 times before the judge brings the hammer down. I do not have a link so maybe someone else will remember this also. This is the first time for the fraud trial. They already requested the murder trial to be moved up to accommodate AL. The judge led us to believe he wants the fraud trial over and done with so they can focus on the murder trial. I believe he expressed that opinion in not so many words but I think he is sincere about just wanting it behind them. So it will be interesting to see what happens on Monday because I bet the judge in no longer "sitting on that rainbow".

Can't somebody do something about them not even working on the murder trial? They haven't even taken many depositions in that either?

I know we don't know everything that they are working on but as far as I can tell they have done very little to prepare for a murder trial other than file motion after motion on irrelevant things... things (like the video taping of the family visits) numerous times even though it had already been ruled on prior?

How many depositions have they even taken in the murder trial? Do they even have any expert witnesses?

I understand that they have a right to be able to defend their client and need time in order to get everything together but it seems like they are not even trying at all to get prepared for a murder trial.

They spend all of their time doing media appearances, book signings and filing motions that are borderline kindergarden temper tantrums instead of professional motions that would help their client.

At this rate this trial won't happen until 2020.

Can't somebody put their foot down? Can't JS say "look the trial is January 2011... be ready." I guess not because if the defense says they are not ready then they can't force them to go to trial. So, basically the defense can hold this off as long as they want.

I also remember reading that they are barely even visiting Casey in jail. How can you build a case without talking to your client? Oh, I forgot, they have nothing to talk to her about since they are doing NOTHING.

Hmmm- wouldn't you think that an innocent person would be demanding to get this show on the road so they can tell 'what really happened' and get out of jail? I would...

And OJ was loved by millions. Who would want to believe he would do such a thing. Worst part is "if he did it", he left his children alone in the house to find their mother in the morning. Thankfully that did not happen. In OJ's case everyone was grasping at straws to prove he was innocent as many of us were in denial.

This is the biggest sticking point for me. Who in their right mind would sit in jail for over a year and tell their lawyer, take your time I'm doing great. That just makes no sense whatsoever and the defense has to realize this. The longer that Casey sits in jail awaiting trial without giving the SA or LE something concrete to prove that she is innocent (since the defense claims they have this information) just proves that she is in fact guilty. The defense may not realize how much of an idiot they are appearing to be but for some following this case it is painfully obvious.

Allowing continuance after continuance is a flaw we have within our Justice system, imo. A Judge should set a date and demand both sides meet that date, unless someone involved has a true emergency. The Defense in this case will have ample time to get it all together and be prepared for a 2010 summer or early fall trial date. imo

delaying a trial is a defense stragety that works to garner a better deal from the DA/SA, the public softens on its view of the defendant, witnesses are lost, memories change, evidence is lost/spoiled....etc., the defense HOPES their delaying the trial will result in one if not many of these results. My consolation comes from knowing that KC will remain in jail until her trial, therefore, my only need for a speedy trial is for my personal entertainment. In the meantime, KC is definately fading from the national spotlight - I'm in Cali and I never hear anything about her anymore on TV, on NG or even the tabloids. What I have noticed is that since this case hit the spotlight - NUMEROUS similar cases have also come to the media's attention. Currently the missing 8 mos. boy from AZ and his train wreck mom are the new KC/Caylee - its simply disgusting.

Reading Mr. Hornsby's law blog I just learned something interesting. We knew if she is convicted her felonies can be used to impeach her if she were to testify, but I never expected that she would indeed take the stand in her murder trial. What I learned is that we don't need her to testify, the felony can be brought out by mom and pop. Mr. Hornsby explains "So, if any witness (but especially Cindy, George, or Lee Anthony) is called to testify by either party and the defense attempts to elicit exculpatory statements attributable to Casey Anthony, the State can impeach the exculpatory statements attributed to Casey Anthony by introducing her 13 felony convictions and asking Judge Strickland to read Florida Standard Jury Instruction 2.5 to the jury at the same time:

“The evidence of Casey Anthony’s thirteen felony convictions should be considered by you … in weighing the credibility of the statements attributed to Casey Anthony.”
Watching the ZFG depositions with mom and pop unhinged and uncivilized I remember thinking these two are sealing their daughter's fate. I have never seen such poorly disciplined adults.It is highly likely that they will "open the door" at the murder trial too, imo. Everything I read says there is a hearing 1/21 @ 10
a Trial (or plead) on 1/25 @ 10
and a 1/26 hearing at 1:30 in courtroom 6-D.
