"...Juror Dave Fitzsimmons spoke to the media after the verdict was handed down at the Daley Center Wednesday evening.

“Over the last eight days we’ve heard a lot of conflicting testimony and conflicting information from the expert witnesses,” Fitzsimmons said. “At the end of the day, it really came down to the physical evidence.”

During the trial, Rialmo testified he saw LeGrier barreling down the apartment building stairs holding a baseball bat over his head.

“I thought he was going to take my head off,” Rialmo testified...."

"CHICAGO (AP) - The judge presiding over a wrongful death lawsuit resulting from the 2015 fatal shooting of a teenager by a Chicago police officer on Wednesday reversed a jury finding in favor of the teen's family.

The Cook County jury awarded $1.05 million to the family of Quintonio LeGrier. However, Judge Rena Marie Van Tine reversed the decision after learning the jury also found Officer Robert Rialmo feared for his life when responding to a call of a disturbance.

The LeGrier estate had asked for between $12.55 million and $25.05 million. Van Tine's decision means the family will receive no money....

In making their decision, jurors signed a special interrogatory finding that Rialmo fired in reasonable fear of death or great bodily harm. Van Tine found the interrogatory outweighed the decision for LeGrier's estate and found in Rialmo's favor....

A Chicago police disciplinary body has ruled the shooting of LeGrier unjustified and recommended Rialmo's firing.

The jury on Wednesday also found in favor of Rialmo in his lawsuit filed against the LeGrier estate for the infliction of emotional distress. However, the jury didn't award him any money."

"...The jury deliberated for three hours.

"I don't believe Officer Rialmo is a bad person necessarily. I think he just made a bad decision in the moment," said Dave Fitzsimmons, jury foreperson.

"The city won when clearly, we had proved our case," said LeGrier estate attorney Bill Foutris.

LeGrier's father said nothing as he left court.

"If he's justified in using deadly force, there are no damages. That is simply the law," said Joel Brodsky, Rialmo's attorney.

When Brodsky was asked if the jury was instructed that if they check "yes" on the question of whether the shooting was justified the LeGrier estate would get nothing.

"Probably not," Brodsky answered....

Brian Gainer, an attorney hired by the City of Chicago, said that a person brandishing a bat is a threat.

"It's a life and death situation that happened in an instant. And in these situations people are going to see different things," Gainer said...."

"...After the ruling, Cooksey said she felt the jury was confused and was not properly instructed by the judge. She said it was never about the money. It was about getting justice for her son, and she is still waiting for that justice. She pledged to keep fighting for justice.

“You know, I lost my child. Robert Rialmo never showed remorse. He didn’t even show remorse for Bettie Jones in his deposition. I was there and he was cocky and very arrogant," she said. “I know my son. He wouldn’t hurt insects, let alone a person.”...

“He called for help. Why would he want to attack the help when he thought they were coming for him?” Cooksey said.

Jones' family stands to get $16 million in a settlement with the city.

The family's attorneys said they are considering their options, and Cooksey said the case is far from over.

“It’s about Robert Rialmo. He has to go. He has shown no remorse," she said....

Cooksey said she's afraid of what Rialmo might do back on the job.

"How can he be on the force again?” she said. "He said that the training is a joke. If the training is a joke then you’re a joke on the job. So how can they actually have him on the force again with that type of mentality? that means we're in danger.”

Rialmo is on paid desk duty. The Chicago Police Board has not decided if he should be fired. LeGrier’s mother said the family rejected a settlement offer from the city before trial that was for more than a million dollars."

"Though one of the charges against him will be dropped, embattled Chicago Police officer Robert Rialmo is set to go on trial this week over his role in a December 2017 fight at a Northwest Side restaurant.

Rialmo, 29, still faces two counts of misdemeanor battery stemming from a fight at at Moretti’s Ristorante and Pizzeria on Dec. 17, 2017.

The fight, which shows Rialmo knocking two other men to the ground in a flurry of punches, was captured on video:

Defense: Chicago cop Robert Rialmo threw ‘jabs’ at bar but feared for his safety

"A week after a Cook County civil jury found he was essentially justified in the shooting death of 19-year-old Quintonio LeGrier, Chicago police officer Robert Rialmo was back in court Monday — on trial for his role in a December 2017 bar fight.

Rialmo’s attorney, Joel Brodsky didn’t deny that his client, who was off duty at the time, had thrown a couple of “jabs” in the early morning hours of Dec. 17, 2017, at Moretti’s Ristorante and Pizzeria on the Northwest Side.

But Brodsky said Rialmo, 29, did so only after he feared for his safety from two patrons, one of who had “attacked” him at the bar...."
