Could just be a ploy to keep the mother out of the courtroom so she won't garner sympathy. If she's a witness, she cannot sit in the courtroom until after she's testified.

Maybe not. Every State has different laws, but in general, there is a thing called a Missing Witness charge and it goes something like this:

If a witness on the witness list of a particular side is not called to testify, the jury would be permitted to infer that the testimony of the missing witness would not have been favorable to the side that listed the missing witness on their list.

If Cindy is on the prosecution's witness list, I would expect her to be called to testify.

What conversation with Amy? If the conversation you refer to did not involve Cindy herself, Cindy would not be allowed to testify to the truth of that conversation. It would be considered hearsay. There are exceptions to this rule, but too numerous and complicated to go into within the context of this forum. If I knew what specific conversation you were referring to, I might be able to determine if Cindy's testimony about the conversation in question would be admissible, without going into a whole thesis about hearsay.

However, Amy could testify to the conversation you refer to (or at least the portion that Amy herself generated).

If the car is registered in the parents' names, all they have to do to have her charged with theft is to say she took it without permission. It doesn't matter if they only registered it in their names "for insurance purposes," ie to cheat their insurance company. It doesn't matter if she was allowed to use the car every day.

Exactly right! The owner of the car is the person whose name is on the registration. Anyone not on the registration needs permission to use the vehicle. Cindy would've said that Casey did not have permission to use the car and knowingly took the car without the owner's consent.

Ironically, then Cindy would have been asked why she waited 31 days before telling LE that her car was stolen.

"I plead the 5th Amendment, thank you."

Can Cindy refuse to testify? If not, she better not lie under oath or she will be held in contempt. Ps I think LE releases this stuff so the family argues and make her talk, but it wont happen. (OT-I always say to my husband I cant imagine how they all stay in that house with her. I couldnt keep my mouth shut if that was my daughter!)

Exactly! It has to be one intense household. I would beat the answer out of her. I cant imagine what they all do or talk about in there, or if they are watching NG and all the other coverage?? I hope they are scrutinizing every last detail like we all are and figuring out that lil miss kc is a baby killer. But I highly doubt that!! Bring on the trial :behindbar

I keep remembering CA's adamant statement to Judge Strickland, when JB directed her to tell the judge why KC should be home on bail - "Because she hasn't committed a crime". Not going to be a credible witness at the fraud trial, or any other trial. :waitasec:

Yeah, but when they DO get her in there she's gonna hear alot and I don't see her keeping her cool and pleading the 5th... IMO.. she is going to go balistic.. babbling about Zanny, Rotten Pizza, Squirrels and trying to convince the GJ that Casey should be "The Mother of the Year"..

I actually have no idea how a Grand Jury works but I think we all know how Cindy works... She wants to be in control, and LOVES to hear herself talk..

My understanding of the GJ, is that it is secret. People come in testify and leave. No one is allowed to sit there and listen. She will not hear any of the other witnesses or evidence other than her own questions.

If there is an indictment then she will not be allowed in the courtroom until after she has completed her testimony.

That is my own belief. correct me if im wrong.

she stole a (or 2 ) blank checks and tried to pass them.

She also altered a birthday check her grandmother had given her from 20.00 to something like 200+ dollars. Don't remember the specifics.

When I served on the GJ there were NO witnesses/observers at all in the room. Only the DA, the one testifying and that was it.

She will hear or see NO ONE but her own testimony. If it is like here, the witnesses are even kept separate from each other because the entire proceeding is secret and the witnesses are sworn to complete secrecy about any testimony they might have given or even that they were called.

OK..point taken.. I'll shut-up now.. but boy would I like to be a fly on the wall at that hearing.. LOL

I honestly don't think Cindy is capable of saying that. It goes against her every fiber of being. This woman cannot keep her mouth shut or stick to a script, for that matter.

We're talking about Cindy here, remember that. She has proven to us that she must be in control, and pleading the 5th will just not accomplish anything in her mind. She'll play every card in the manipulation deck. It doesn't matter who she's talking to or where's she at, its all about what Cindy thinks is right.

Don't forget we've already seen her in action on the stand during the bond hearing and what came out then was total Cindy spin. Cindy has a problem with taking advise from anyone for any length of time, and I don't see it changing anytime soon.

I'm hoping she will be asked what she meant when she told Amy that Casey is in trouble and if she didn't find her that Casey would be going to jail.
That statement drives me crazy. Why did she so quickly connect trouble to jail? The police hadn't been called yet, or had they?

Oh, I expect her to have to testify, too, but they may make her the last witness called for two reasons........1. so she can't garner sympathy for Casey by being in the courtroom during most of the testimony and ..............2. so she can't hear or intimidate the other witnesses prior to her appearance.

AWWW.... I hadn't heard about that! So, she wasn't able to steal from the nursing home account?
