Jury selection will begin today in the trial of Tom Fallis, who is charged with the murder of his wife in 2012.

A former Weld County correctional officer, Fallis is accused of killing his wife, Ashley Fallis, who died of a gunshot wound to the head after a New Year’s Eve party Jan. 1, 2012, in the couple’s home in Evans. Evans Police initially ruled the shooting a suicide.

The case is scheduled for 12 days, starting Monday and going through the last week of March. Depending on how quickly the trial progresses, it could stretch into a third week.

Pepping said he didn’t read 99 percent of them. But he remembered one. “It was basically saying I was better in bed than Tom was,” Pepping said. It’s unclear whether some or all of Pepping’s testimony will be presented to a jury in Tom Fallis’ trial."

If Pepping's testimony is allowed at trial, I'm sure the defense will have a field day with this information. JMO

The judge is not going to allow much of what was said by the man Ashley Fallis is accused of having an affair with.

Unfortunately they don't say how much, or what would be allowed. From the link DropthePuck posted above I am not getting a very high opinion of Pepping, tbh. But that's JMO only. :cow:

Shortly after leaving the party, Fox said she sent a text to Tom asking him to cool down.

She said a few minutes later, they saw a police car heading toward the house, so they turned around and drove back. “I ran into the house,” Fox said. “I could see blood and I could hear the kids crying.”

One of the girls told police that she was in her room with her cousin playing a game on her iPad when she "heard something and smelled something disgusting"...

The girl told police she walked into her parent's bedroom and saw her dad holding her mom. "He was telling her to wake up," she said. "She had blood on her face."

I just watched Dateline's coverage of the same case and for the first time, I was very disappointed with Keith Morrison's coverage. It was biased towards the defense. They did not include coverage that 20/20 did- like the evidence of the officer that also heard Tom confessing outside, which backed up Nick Gordon's testimony, nor prosecution blood spatter expert Tom Bevel who demonstrated that if Tom Fallis were lower down and tilted Ashley's head back it could explain the angle of the bullet, and they also didn't include how TF's DNA was under Ashley's fingernails, meaning the scratches on his neck and chest were NOT from him shaving his chest!!!
This was no suicide, and her journal entries from 6 months ago should not have been admitted. He is another OJ/Casey Anthony who is guilty, but got off.
Ashley's parents should also sue Fallis for wrongful death, IMO!

Even worse than sickening is that it is so obvious what happened, and just as obvious that it was covered up by the INVESTIGATOR.


Be sure and see the interview where he goes off at the young female interrogator. Chilling.
Imo.

It's as if the PD took his vehemence to be a statement of innocence, when IMO it was all an act of intimidation.

Hello Anybody:
Just picked up an old version of 48 Hours on the Tom Falis case. I love to evaluate controversial murder cases. I am a physician and neuroradiologist and have lots of experience in head trauma and penetrating head wounds by bullets and knives etc. I remain still a bit puzzled by a couple of aspects on this case.

1 I think I understand the head wound - entry wound below the right ear around mastoid, exit wound would have to be somewhere around the left frontal bone. Apparently bullet fragments still lodged inside skull but given a 9mm projectile I would expect substantial damage and fragmentation at exit wound - also substantial trauma to cerebrum. I visualized the recreation and mock ups of crime scene. Bullet hole in wall some 6 ft 3 inches above floor. The blood splatter pattern on neighboring wall is puzzling. It was assumed the bullet entered from back to front on on skull; the kinetic energy turns her head from "right to left" thus allowing "blood splatter 90 degrees away from bullet entry into wall. I find this theory utterly preposterous. The bullet fragments, bone, brain substance hair and skin will exit in the direction where the bullet fragment was recovered from the wall. In addition the exit injury from a 9 mm bullet through much of the human brain and skull will NOT produce a fine linear pattern shown in all the images. Certainly this is not a high powered rifle shot we saw in the Zapruder film re JFK assassination a 9mm metal fragment with ? muzzle velocity is expected to do huge damage to the skull. I could see autopsy photos of brain and head and skull I d understand mechanism better. Moreover, just on basis of entry wound location and bullet hole in wall - Ashley had to be in a crouched low position ie kneeling face towards bullet laden wall.

NEXT . - Tom early version of what happened is inaccurate or a frank lie. He had blood on his t shirt, and scratch marks on his chest caused by Ashley's fingernails ( presumably of recent vintage). The packed duffle bag and flashlight are curosities subject to assorted conjectures.

I have heard that powder burns were detected on Ashley's hand(s)- I assume Ashley was right handed. and I assume Tom was right handed. Tom allegedly had powder burns on his ?? face but not his hands. I find this set of "facts" puzzling. The distance from gun muzzle to the entry wound has not been given. Any info on that???


A lot of the ancilllary witness testimony is mostly noise. Useful but doubtfully dispositive except for tertiary questions. What who said when - I take with a grain of salt. I wish I could see first responder notes. I wish I could see crime scene photos. I d like to see the body at the crime scene. I d like to see body position, blood pool on the carpet, and gun - realizing defense could argue Tom rushed to the mortally injured Ashley, cradled the head, and made the 911 call. Still I would expect vastly MORE exit wound blood, bone /brain/skin fragment debris somewhere on the sidetable wall or carpet.

Finally fingerprints of any value here - naturally Ashley and Tom's could be innocently found on the weapon.

And I think matching the intricacies of CSI findings with a carefull detailed interview with Tom Fallis was absolutely de rigeur. This Evans Police Chief demurrely playing stupid was farcical and of course pointed to cover up incompetence collusion etc. And I had read - how would this be possible - 5 separate law /police agencies concluded Ashley death was a suicide. Somebody needs to write a concluding report detailing ALL forensic and investigatory evidence that is uncontested along with assertions and disputed facts plus layers of testimony and then provide a comprehensive no obfuscatory explanation of "Best Guess of Precisely What Happened".


and by the way the 48 hours CBS piece I saw "Murder After Midnight was utterly dreadful; in its construction; manner of exposition its editing etc. Just based on that piece's journalistic quality alone, CBS needs to fire a number of producers and middle managers for that series. Otherwise these "professionals" are doing nothing but calling in their stories.

I welcome corrections to any statements offered above and I welcome added insight or thoughts.
