The Colorado Supreme Court removed former president and 2024 candidate, Donald Trump, from the state's 2024 ballot ruling that he violated the 14th Amendment's "insurrection ban".

The ruling was a 4-3 decision.

This ruling will be placed on hold until January 4, pending Trump's appeal to the United States Supreme Court, which could settle the matter for the nation.

Ratified after the Civil War, the 14th Amendment says officials who take an oath to support the Constitution are banned from future office if they “engaged in insurrection.” But the wording is vague, it doesn’t explicitly mention the presidency, and has only been applied twice since 1919.

The Trump campaign says it will “swiftly file an appeal” of the Colorado Supreme Court’s decision.

“The Colorado Supreme Court issued a completely flawed decision tonight and we will swiftly file an appeal to the United States Supreme Court and a concurrent request for a stay of this deeply undemocratic decision. We have full confidence that the U.S. Supreme Court will quickly rule in our favor and finally put an end to these un-American lawsuits,” Trump campaign spokesperson Steven Cheung said in a statement.

And now Maine has removed Trump from its primary ballot. Maine Secretary of State Shenna Bellows ruled that Trump's actions concerning the January 6, 2021 attack on the Capitol has made him ineligible to appear on the primary ballot.

"The weight of the evidence makes clear that Mr. Trump was aware of the tinder laid by his multi-month effort to delegitimize a democratic election, and then chose to light a match," she wrote, adding that he "used a false narrative of election fraud to inflame his supporters and direct them to the Capitol to prevent certification of the 2020 election and the peaceful transfer of power."

Here's what the Trump campaign spokesperson said:

"We will quickly file a legal objection in state court to prevent this atrocious decision in Maine from taking effect.
The Maine Secretary of State is a former ACLU attorney, a virulent leftist and a hyper-partisan Biden-supporting Democrat who has decided to interfere in the presidential election on behalf of Crooked Joe Biden. We are witnessing, in real-time, the attempted theft of an election and the disenfranchisement of the American voter."

SCOTUS to hear arguments over Trump’s Colorado ballot case

  • Trump appeals Colorado’s top court barring him from GOP primary ballot
  • How language in the 14th Amendment is interpreted will play a key role
  • SCOUTS will determine if Colorado rightfully removed Trump from ballot
(NewsNation) — The Supreme Court is set to hear oral arguments Thursday on an effort by former President Donald Trump to reverse a ruling by Colorado’s top court barring him from the state’s 2024 Republican presidential primary ballot.

The nine justices, three of whom Trump appointed, will hear arguments from Trump’s appeal of a decision by the Colorado Supreme Court. In December, Colorado’s top court decided that Trump engaged in the Jan. 6, 2021, U.S. Capitol insurrection and therefore should be disqualified from appearing on a ballot under Article III of the U.S. Constitution’s 14th Amendment.

Trump is not expected to be present at the arguments scheduled for 10 a.m. ET. Instead, he plans to start his day at his Florida home and travel to Nevada, according to a source familiar with his plans.

The US Supreme Court is going to blow this out of the water as being totally unconstitutional. JMO.

Is it though?

If only more states would follow suit. I am amazed that GOP or anyone is willing to sacrifice our entire democracy to get power, how can they support this wannabe dictator who has no regard for the constitution be allowed back in office? He will be Putin. It will be our last free election. It is baffling to me. If you are Republican, so many other candidates who could win, this is not about one side or the other. Trump is a populist nightmare and he will end our democracy in one fell swoop. The nation needs to come together to eliminate this possibility. A man who tried to stay in office after losing an election and who has simply refused to commit to the peaceful transfer of power and who incited an insurrection cannot be given power. It is unreal. MOO.

US Supreme Court throws out Colorado’s attempt to remove Trump from ballot

The supreme court ruled that Congress, not the state legal system would make the decision about Trumps place on the ballot.

Just my opinion here, but it seems to me that such a significant decision should be made based on rule of law, and not by a collection of political buddies and enemies.

So, will Congress now take up the question?
