I'm interested in knowing that as well. From what I understand, it will probably be without prejudice because Jack Smith needs to basically wrap up everything in order to be able to release a public report. If they retained the right to re-file, it wouldn't really be over (MOO) and we wouldn't see the report.

That's just all MOO based on what I've read and heard but I could be wrong.
That would be WITH prejudice. It doesn't appear his motion says either way, and I'm guessing he just doesn't want to take a stand. But it may not matter. I don't think it would be able to be refiled anyway.

I realized after I posted my question that I put it on the wrong case, intended for the Jack Smith one, though I guess the question applies to all his federal cases.

I see the documents posted online, it was dismissed WITHOUT prejudice, preserving the right to refile, though the Bluesky poster I read said it is unlikely they'll do so.

@PrairieWind I'm curious why you don't think they'll be able to? (assuming he does eventually leave office, that is)

Thank you for clarifying! My legal terminology is tepid at best.

I'd also heard that it would be pointless to try and re-file at any point in the future, because the Trump DOJ would make sure all cases were permanently dropped.

So if Smith does it now--and he hurries--he may be able to get the report released to the public before Trump takes office.

Though it may not always be a trump DOJ. Chutkan has dismissed without prejudice. Can a trump DOJ somehow change her ruling? And if it can, can a future non-trump DOJ change it back to ‘without prejudice’?

A person should not be able to try to subvert election results if an election is not decided in their favour. It should not be overlooked. imo
