Court Declares Mistrial In Mark Redwine Proceedings

DURANGO, Colo. (CBS4) – A mistrial was declared on Monday in Durango in the trial for Mark Redwine, the man accused of killing his 13-year-old son Dylan in southwest Colorado in 2012. The mistrial was declared because of alleged issues with the attorney who represents him.

The district attorney in court “made allegations concerning recent behavior of one of Mr. Redwine’s attorneys and the contents of a telephone call made from the La Plata County Jail,” according to new court records.

The records go on to say “The Court, for the reasons stated on the record and without making any findings as to the veracity of the allegations … has no choice but to … declare a mistrial to ensure that Mr. Redwine has effective assistance of counsel.”

I hope the judge realizes the attorneys will be pulling this COVID-symptom stunt all trial and that they need to get on with it regardless. This case is a no-brainer (and Monster Mark knows that). He also knows that the more time that passes, the more likely he will get away with this. So it is obvious this was just a stall tactic. Now jury selection has to start all over again. Poor Elaine and Cory. Does anyway know if they are staying in a hotel during the trial or what Elaine's living arrangements are while the trial is on-going?

The family (Elaine & Cory) were residents of La Plata County for many years and probably have many resources for accommodations. The family definitely voiced their frustrations Monday in their comments to media:

Dylan Redwine’s family members opposed a mistrial, speaking in court Monday about how difficult it is for the family that the case is still pending three years after Mark Redwine’s arrest and eight years after Dylan disappeared.

“It seems like the courtroom in this case just kind of stands still,” said Cory Redwine, Dylan’s brother. “We’ve all exhausted our energy, our time to be down here.”

Court news reporter LB that broke the news about the mistrial just announced another covid delay (2 weeks) in El Paso County Court for an unrelated case. Regardless of the long-time alleged antics played by Redwine defense to delay this trial, we can trust the Court will follow the CDC guidelines including up to 14 days of quarantine. The next status hearing was set for Nov 13.

On Monday, the judge announced in court that he had tested negative in two separate tests for coronavirus. But in a new motion for a mistrial, attorneys for Redwine, 59, said that members of the defense team also began showing possible coronavirus symptoms last Thursday. Although one person on the defense team has since tested negative, results are pending for others involved in the case, said one of Redwine’s attorneys, Justin Bogan.

Bogan argued that the defense would be forced to quarantine for 10-14 days under state and federal coronavirus recommendations, making it impossible to conduct the trial.

In opposing the mistrial, District Attorney Christian Champagne asked the court to wait until other test results came back before scrapping the case. Champagne also questioned whether Redwine’s attorneys were “intentionally” using the coronavirus scare as a way of putting off their client’s trial.

Champagne said Mark Redwine was captured on tape discussing the bid for a postponement in a recorded jail phone call.

The court granted the mistrial without making findings "as to the veracity of the allegations."

"I beg of you judge keep this trial on track," Hall told the court, speaking of the family's "heartbreak" and saying they have been "victimized over and over again."

Mark Redwine was indicted in July 2017, with authorities saying the boy’s blood was found throughout his home. He faces up to 48 years in prison if convicted in his son’s murder.

Redwine’s trial was most recently postponed in June, due to a statewide moratorium on trials because of the pandemic. Redwine has been held at the La Plata County jail in Durango since his arrest three years ago.

Redwine was ordered to trial in October over objections from the defense, which cited Colorado’s spiraling infection rates in asking for a mistrial and another postponement.

“The longer the defendant’s trial is delayed, the more likely both sides are to lose evidence necessary to fairly try this defendant,” the judge said in an Oct. 19 ruling.

What a absolutely joke for Dylan’s family. How much more suffering do they have to endure?

The narcissistical pig wins yet again as the family suffer more hurt and no doubt losing more money due to yet more delays.

I am not impressed...poor Elaine and family...I bloody called this and now it’s happened...uggh, for once I hate to be right.

Almost 8 stinking years waiting for justice...facepalm

I don’t want people to think I don’t take Covid seriously either because I am in the U.K. and we take it very seriously but this is just more delaying tactics. It’s just Bulls*it and no doubt if we get another date set then Mark will come down with symptoms.

While it's no secret that the defense cited COVID as a reason to delay the trial as early as June and again in October, nearly every case in Colorado is on hold by not less than two weeks since Colorado is currently citing 1000 hospitalized cases of COVID -- the highest ever in the state.

In El Paso County -- the jail has 73 employees and two hospitalized with COVID. Hundreds of inmates also tested positive.

This is infuriating and heartbreaking! Grrrr!!!

The only saving grace is that at least MR is behind bars while this drags on.

Agreed! He may think he is pulling one over on Elaine and Cory, but he is the one that is locked up without the freedom to do what he wants. Of course, I feel for them having to wait so long for justice for precious Dylan, but there’s satisfaction in knowing he’s not going anywhere.
