I agree there is no way she will be getting out on bond.

Courts across the country are dealing with the same COVID concerns and they just need to come up with common sense practical solutions. Releasing convicted prisoners or letting someone out on a much lower bond should not even be considered IMO.

If my local cigarette store can install a plexiglass shield in front of customers, then surely our court systems can arrange a solution that works for everyone without having to give someone a free ticket out of jail.

Hatfield,
I’m linking this only because killers are being set free due to Covid. This one killed the very next day. I agree that LS won’t be released but only because she wouldn’t be safe in the public for more than 24 hours.

From the New York Times....

Florida Inmate Released Amid Pandemic Killed Someone the Next Day, Officials Say
Joseph Edward Williams shot and killed a man in Tampa, Fla., on March 20, the authorities said, one day after he was among more than 160 inmates released from Hillsborough County jails.

During the Jodi Arias trial, it was fascinating to watch JA and her expressions as certain witnesses testified. We were able to make a lot of deductions about her from just watching her and her reactions.

You could tell when she disagreed with certain witnesses.
You could tell when she was fake crying and faked trying to be upset.

There was a lot of information she shared and she probably did not have a clue she was sharing it.

One of the more interesting things she shared was after she looked around the courtroom to see everyone getting upset at a particular photo, then she all of sudden became upset too. It was obviously a fake reaction because we got to see her look around first to see what people's reactions were before she even had her own reaction. Things like that are invaluable to a jury who is paying attention to a defendants behaviors and reactions and facial expressions during a trial.

I will always remember that trial. She insisted on doing some crazy things. Her lawyers couldn’t tell her what to do. Looking back, we can have a good laugh. But Travis never stood a chance.

So many posts discussing this, so it is not directed at anyone in particular. But to clarify, my understanding is that LS is not being kept from video conferencing with her attorneys due to COVID-19, but because inmates on the ward where she is currently housed, are not given this "privilege" (for lack of a better word). Basically, she's in the psych ward (per CrimeOnline, I think). Inmates on the psych ward are not given video conferencing privileges. Per the court documents linked previously.

ETA (because I always think of something after I hit "post"): Her attorneys were told they could visit her in person but they don't want to do that due to COVID-19 (understandably, IMO).

Hmm. So lawyers, unlike doctors, get to avoid CoVid. And teachers will have to go back to the classroom (where I am, probably in August) and without plexiglass and with just a mask.

Half of my family are deemed essential workers, and they don't get the luxury of not going to hospitals or other places.

I think the attorneys should suit up like everyone else, figure it out.

Perhaps they should just put up a clear plexiglass shield around the witness box. It could easily be disinfected regularly.

I love this idea. Even better if they only unmask her, once safely contained in the specimen box.

Everyone else gets to keep their masks on. Not being able to read their reactions to her lame responses would totally fluster her and the Tsplaining would go into overdrive I’m thinking :D

Thanks LoveNeverFails.
Yeah, I had heard about some jails or prisons were releasing inmates because of the Coronavirus. I think the country of Iran is where I first saw that happening. And yeah its happening in US now too.

I couldnt believe it when I first heard about that and its still hard to fathom that. It seems to me they could have come up with a better solution than just letting them out.

Can you imagine being a victim of one of the inmates and you did all the right things to help get the person get convicted, went to the trial and made sure justice was served. To only find out someone came up with "just let them out" as the best way to deal with the Coronavirus.

Iran has released 85,000 prisoners in an emergency bid to stop the spread of the coronavirus
Wow. That’s a great article. 85,000? Amazing.

A lot are being let out in NY City and LA. I’m glad our Governor has better sense. Not knocking any certain State. It’s just the idea of violent offenders being sent to prison and then being released.

Spencer has the scoop, y’all :

Ok, so @EPCSheriff is basically saying #LetechiaStauch’s attorneys have had video access to do conferencing, but it was restricted to just one hour and not used.

Now they’ve added additional time for video visits as well.

Attorneys were always allowed in for visits in person.
@EPCSheriff also goes on to say while they have had cases in their staff, there are no positive cases in inmates. They previously told me it was only a matter of time.

They are very proud of their safety set up, but understand if attorneys are not comfortable going in.
Sheriff’s office didn’t comment about the evidence delay, if there is one.

But they did flat out say her attorneys have had access (video, call, or in person) this whole time even if it was just for an hour (now additional time added.)

So that’s the fundamental disagreement.

But he wasn't in jail for murder when they decided to release him. It says he was there for low level, non-violent drug crimes.

Now that he's been arrested on a murder charge, they won't be releasing him due to Covid. Nor will they be releasing Letecia.

Many thanks to Spencer Wilson for digging into this further. I was concerned to hear attorneys were being restricted in communication with their clients. As it turns out, that was not the case.

I can go back and look. If you are correct, I posted the wrong article and I’m sorry. I googled it from my memory. The one I was speaking of was specifically in for murder. He was released along with other violent offenders.
You are correct. LS isn't going anywhere, except maybe to a maximum security prison.

Do we take this new request on behalf of LS as a sign she's miserable in jail? Scared maybe? CoVid-terrified?

I sure hope so.

I think that LS is trying to call the shots from jail and has manipulated her lawyers into saying that her rights are being violated, because of Covid. I also think that she's trying to get the case postponed, because she knows that when she's found guilty, she'll lose the VIP (Very Important Prisoner) treatment that she's been getting while in jail.

Color me confused. The May 12 motion for video access says that on May 4 counsel was prohibited from a video visit and the new policy was that visits were limited to in person visits:

3. Throughout the months of March and April, counsel met with Ms. Stauch an average of three to four days per week via online video visitation in accordance with jail policy and COVID19 protocols. On May 4, 2020, a member of the defense team attempted to schedule a video visit with Ms. Stauch and the jail refused to permit the visit. That same day, Counsel contacted Day Shift Commander Lt. Eric Carnell to discuss the refused visit request. Lt. Carnell informed counsel that the DATE FILED: May 12, 2020 REDACTED jail had changed their policy regarding professional video visitation and that Ms. Stauch and all inmates with her security designation were now prohibited from using the online visitation system. Counsel was instructed that the only way to visit or speak to Ms. Stauch would be to go to the jail in person.

Hmm.good question. Those were Spencer’s tweets from this morning. Ashley Franco went and interviewed PIO Jackie Kirby & KKTV will have more in depth reporting on this tonight.

10:00 news comes on in about an hour so I’ll post more as I find it.

I just noticed the wording of the new policy says “LS and all inmates with her security designation “. Maybe the ward she is housed in only allows her in-person visits.

“ Stauch is currently being housed at the ward section of the jail, where inmates receiving mental health services are housed. “

Thanks! Ah, so maybe it's about the mental health ward? It still doesn't make a whole lot of sense but I can't think of much else.

Attorneys for Letecia Stauch seeking to push back court, potentially allow for bond

The motion claims the El Paso County jail stopped allowing video visitation for Stauch and other inmates with her security designation in early May. A spokesperson with the sheriff's office could not directly speak to the case due to a gag order but told 11 News reporter Ashley Franco that all inmates had access to video visitation, just not all at the same time. In a document provided to 11 News by the sheriff's office, the office confirms that video visits cannot be scheduled for inmates in certain wards during standard duty hours (8 a.m.-5 p.m.), but can be scheduled after normal hours.

In-person visits were always permitted for inmates during the pandemic, EPSO said.

"Pre-COVID, attorneys had the ability to meet with their clients in person at the jail, through a professional visit, through a contact visit if documents need to be passed through and reviewed, or they had the ability to do those visits online. Now, all of those options still remain today," said Jacqueline Kirby, a spokesperson with the sheriff's office.
Kirby told 11 News Stauch could use her time out of her cell to see legal counsel if she wanted, and said that as of Monday there was no restriction to how long an inmate meets with their attorney via video after hours.

"... We have never barred attorneys from meeting with their clients. I want to make that very clear."

Yeah, I saw a case today where a guy whose bond was waived got out and killed a woman in a Walgreens parking lot as she was getting into her car. It’s very terrible. Do the crime, serve the time. CoVid-19 or not.

Can we address the elephant in the room. Why on Earth is TS in the Psych Ward?! Either...

1. She’s suicidal or pretending to be.

2. She’s planning on waging an insanity defense.

3. They are protecting her from other inmates. Unfair and don’t they interact in there also?

4. They are trying to protect her from CoVid.

5. She’s planning an escape and restrictions are looser.

Verrry Interesting... so as of Monday the 18th all restrictions were lifted so the motion may just be out of date as it was filed on the 12th.

Otherwise it seems that defense was upset that they couldn't meet with LS outside of normal hours (8 am to 5 pm). I dunno, I'm calling shenanigans until I hear what defense has to say.

I think number 1 plays the largest part...

Gannon...
I like 3 or 4...
IMHO, she is exactly where she should be, as long as it is a permanent residency.
