#LeteciaStauch’s attorney just revealed she will be pleading not guilty to all charges, but also told the judge they plant to enter “evidence of her mental condition after Gannon’s disappearance”.


Her attorney, Josh Tolini, said they aren’t planning to plead not guilty by reason of insanity, but they do want to enter evidence of testimony by a mental health expert.


They are planning to schedule her jury trial for March 28. They expect it to last for six weeks. Her next appearance for a Motions Hearing will be January 6th at 1:30 PM.

Allen requests a SIX week trial setting. That's a long one. They're looking at March 28 for trial - [9 AM].

A motions hearing is set for January 6. Pretrial readiness on March 17 for #LeteciaStauch. She did not speak at today’s hearing. Her counsel spoke for her.

#LeteciaStauch is entering a not guilty plea. The defense wanted to enter into the court about evidence of her mental condition after #GannonStauch went missing. Six week trial likely. Trial set for March 28.

Sounds like she was able to put some effort into her appearance - curled hair, oh so pretty. Good to know her priorities are straight.

If any evidence is introduced regarding a mental health issue, and if expert testimony is to be offered at trial, #Stauch MUST be examined.

Tolini, Stauch's attorney, says it may be beneficial to revisit this in around three weeks... because this is not a typical insanity evaluation.

Judge Werner says in-custody evaluations are WAY behind. "The sooner we get it resolved, the better it's going to be for everybody."

The prosecution is wanting #LeteciaStauch to be evaluated at a state hospital. Judge Werner agrees she needs to undergo an evaluation. They are still discussing when and where this evaluation will be done.

Judge Werner is concerned the evaluation would push back the trial date. Prosecution wants to know what the evaluation would be used for in the trial for the defense and what would be asked. The judge said it’s the defenses choice how they want to present that.

@4thJudicialDA makes another bid for access to what they are doing in order to combat what they will present.

Judge says "Not yet, i want to see what Mr. Tolini files. I agree there is a waiver, just not sure how far it goes. "

So he will work with him, but there's red tape.

Defense team worries "Speedy trial" could be a hold up, saying it might not be moving fast enough and then there's trouble.

Mr. Tolini speaks up against his own team, says he's not worried about it.

@4thJudicialDA also saying there might need to be some limiting parts to this evidence so any findings won't affect more than the time span they're talking about.

Basically saying IF there was something they found, the jury didn't get confused and think it counted before...

So, trying to get this mental health eval straight in my head, is the plan for her to say she didn't murder him, but just moved the body?
