(will last 6 weeks) Case & court info from 3/2/20 to 9/9/21 reference post #118 here: Found Deceased - CO - Gannon Stauch, 11, Colorado Springs, El Paso County, 27 Jan 2020 *Arrest* #51 9/23/21 Update: Stauch appeared again on video from jail, chose not to appear in person. Judge Werner said he is going to go over the summary of law & recap what evidence was presented in the preliminary hearing since Stauch was not present. Judge Werner said the court has found that there is enough proof presumption great to bind this case to trial. Stauch is being asked to be in court on November 4 at 1:30pm to enter a plea. He's telling her she HAS to be physically present in the courtroom for the arraignment hearing, she cannot appear over WebEx. Stauch will be held without bond until trial. 11/4/21 Update: Stauch plead not guilty. There will be a motions hearing on 1/6/22. Pretrial readiness conference hearing on 3/17/22. Judge Gregory Werner set a trial date for 3/28/22 & expects it to last for six weeks & at 1:30pm Plea hearing. For the upcoming trial, the defense attorney Josh Tolini said on Thursday that they plan on introducing new evidence regarding a mental condition of Stauch, however, it is not an insanity plea and is separate from the issue of competency., but they do want to enter evidence of testimony by a mental health expert. The mental condition argument will also only apply to Stauch's actions after the alleged murder of Gannon. DA said if defense is going to bring up Letecia's mental health again, she should be evaluated at the same state hospital that did her last evaluation. The judge said that it's likely this mental condition defense could be related to the charge of tampering with a body. She’s also facing escape charges & it looks like they don’t want to address those today. Both sides are going to file motions related to a mental health evaluation & the judge is going to decide what to do after those motions are filed. They'll reconvene on 12/9/21 at 1:30 to discuss this mental health issue & discuss plans for the evaluation. 11/8/21 Update: Evaluation hearing was deleted from court site. Murder: Next Motions hearing on 1/6/22 & Escape: Review with appearance of parties.11/17/21: Stauch’s lawyers also filed a motion, asking to seal any records of her meeting with her attorneys. But prosecutors say in their brief that Stauch is waiving her attorney-client privilege by placing her “mental condition at issue.” People's brief addressing issues raised by defendant's Notice of Intent to present evidence of her mental condition filed 11/17/21. link: https://www.courts.state.co.us/user...d by Deft Notc of Intent Evid Mental Cond.pdf 12/2/21 Update: Review hearing for both cases is on 12/9/21. Motions hearing for murder charge on 1/6/22 & escape attempt charge has review with appearance of parties hearing also.
What I wanted to say was LS cant have it both ways. The laws where in place way before she come along. No amount of wordsmithing is saving her this time imo
What could be discussed: the new evidence the defense says they plan to introduce, asserting a mental health issue for #LeteciaStauch AFTER the alleged murder of her stepson, #GannonStauch. She’ll need to be evaluated, if that evidence is to be introduced.

#LeteciaStauch’s been deemed competent to stand trial, twice.
The last time we were in court, Judge Gregory Werner said both sides needed to have a plan for this mental health evaluation. So, that could be what happens at today’s hearing.
UPDATE on these court documents in #LeteciaStauch’s case: @4thJudicialDA says her defense failed to show why the names of people visiting Stauch in jail should be confidential. Prosecutors say those jail logs contain no confidential conversations.
#LeteciaStauch has a mental health hearing today. After two mental competency evaluations, the state previously found her competent to stand trail but her attorney said it is likely they will introduce evidence about Stauch’s mental condition *after* Gannon's disappearance @KDVR
Just got to the courtroom for #LeteciaStauch’s review hearing. We’re expected to learn more about a mental health evaluation for her conduct specifically after her 11-year-old stepson #GannonStauch was murdered. She’s facing first-degree murder charges for his death.

It sounds like the Judge is going to have someone bring a laptop into the jail cell so they can have a better connection. The audio keeps cutting in and out. "This is not working," Judge Werner said. He wants to find out why #LeteciaStauch is not present in the courtroom first.
Josh Tolini #LeteciaStauch's attorney said he was ONLY made aware that she refused to come to the courthouse when he came in today. We are now waiting for a deputy to either bring a laptop with better connection to where she is or come to the courtroom.
