I agree witnesses would have to be able to see the defendant and vice versa. But most witnesses who have received preparation for testifying look towards the jury or at least at the person asking the questions when testifying, not at the defendant. So I doubt witnesses, at least adult witnesses, will be rattled by her mouthing words or shaking her head during their testimony. LS may be more extreme than some but an awful lot of defendants do things like that during testimony from state witnesses. A difference here is that jurors are able to ask questions and a juror asked about LS's behavior. (Not all states allow jurors to ask questions but it is apparently required in Colorado Can Jurors Ask Questions During Trials?)

I don’t know if he’s addressed it yet ( his answer)
Maybe he will this morning before any more witnesses are called?

I recall the judge asking for the attorney's positions on each side, and the defense requested " time" to go through case laws and come up with an answer. So, the court is in limbo, waiting to respond ( or not ) to the jurors question.

Suitcase (that has been in a freezer since it was discovered) will be entered into evidence in the courtroom today.
It will be taken right back out of the room, or it will "stink up" the room. UGH.

:(

#LETECIASTAUCHTRIAL DAY FOUR: Day four is starting with Kelly Smith, a crime scene technician for Santa Rosa County Sheriff's office. @KDVR #LeteciaStauch #GannonStauch

Smith got called on March 17th 2020 to the bridge for suitcase with body found.

When Smith got first briefing from Detective Yoder, she heard they had found a suitcase with a body under the bridge.

Dent in olive green suitcase led CSI tech Smith to believe it was thrown from over the bridge down.

Smith took photos of the scene under the bridge. They are going to submit them into evidence.

Allen: Was it apparent to you when you got on scene that there was decomposition? Smith: Yes, because of the coloring of the suitcase and the bug activity

Says inside of the suitcase was very wet. She says it is common with decomposition.
