Oh this poor girl. Tried to be a big sis and keep her little siblings safe while the parents argued. :-(
Disturbing and heartbreaking on so many levels. It just occurred to me that HH lost her father, stepbrother, and essentially has lost her mother, stepfather and stepsister.

I think he's working well with this witness - assisting her in remembering the name of the school, helping to calm her down by such assistance, instead of making it a point about her memory. His voice is controlled and kind. She's able to look straight at him and it seems to be helping with her testimony (she's rather vague and he's quietly drilling down as best he can without pushing her into tears again.

THe comments of people on some of the youtube feed are horrific - I'm finding Recovery Addict's moderation to be the best.

IMO.

I was just going to post the opposite again, it doesn't feel like he is getting the best out of Harley as a witness, to m he almost confuses witnesses, I don't know, maybe he is just warming her up, it just doesn't feel flowy to me.

I don't read any of the counts on YouTube, they are nearly always vile.

It's not just a matter of Colorado law though. Juries are always asked to make the decision when there is an insanity plea. Not to assign a diagnosis, but to say yes/no to insanity. And any person in any US state who has ever been found Not Guilty by Reason of Insanity or found Guilty but Insane by a jury has been competent to stand trial. (Competency is a fairly low bar.) Competency relates to functioning at the time of trial while insanity relates to functioning at the time of the crime. Sometimes a person's presumed insanity makes the person incompetent for trial too. But certainly not always. So there can't be an assumption that a person was or wasn't insane at the time of the crime based on competency at the time of trial. But if there's a trial verdict, the person had to be competent or the trial wouldn't have occurred.

I believe there are many other states that do NOT have CO's rule on burden of proof. I should have added that to my point.

CO is one of a few states that require the prosecution to prove sanity. Proving sanity means that the presumption is that Tee, sitting there, is in fact insane.

She must be proved sane. This, to me, is an extraordinary error in the way CO has constructed this law.

Just my opinion. We do *not* have that law in California nor does Alabama (so it's a diverse range of states that put the burden of proof on the defendant and the defendant is presumed to be sane).


I'm not going to tabulate the states here, but just reading from the top - it's mostly burden of proof on the defendant.

Hike: Gannon had to go to the bathroom, so they left per text from LS to HH.

*This testimony and verbal back and forth doesn’t seem as prepared as I had imagined.

Talks about how LS hired a babysitter for all of them to cover the cruise she and AS went on, despite the fact that HH had babysat the kids before, overnight even. HH was upset by the decision.

AS's mother stayed for a while after that. Then AS had to go for more training in OK.

26th January. The family didn't go to church. HH was not scheduled to work, but got called in to cover a shift.

Was sent pictures of the hike. Was told via text by LS that Gannon had a continence accident and they had to go home.

Looking through the printouts of text messages from then, now.

Harley is now talking about Jan 26th, 2020. Harley was not supposed to work, but got called in to work at Massage Envy.

Harley said she was supposed to go on a hike that Sunday with her mom, Gannon and Laina but got called into work. Her mom told them they still went and sent her pictures.

Definitely. I didn't realize that was the point you were making. The thread had posts saying asking jurors to decide mental health issues was wrong...but that's always the case with insanity defenses..

I truly value your perspective. Maybe it's just that I've seen worse. And truthfully, I haven't followed this as closely as you have (in fact, I have to go get ready for work, sadly). I always value your contributions and insights here, and count on your perspective to help me out.

The judge moved her there so he could keep a better eye on her, he went over this at the opening. She's been flipping people off.

Harley testified about Letecia and Al’s relationship, saying they argued often. She said sometimes Gannon and Laina, Gannon’s sister, would go to Harley’s room during arguments. “I didn’t want them to have to listen to them argue,” said Harley.

She's sounding a little more confident, her voice is stronger at times. Still fragile, but not so terrified and tearful as when she began.

I think she planned a lot, but it wasn't going the way she wanted. To me, her google searches show someone that is unhappy with and perhaps suspicious of their husband. I think that is the main trigger to her actions. I wonder if she didn't really hate Gannon, but hated how much she perceived he was loved by his Dad. The 18 stab wounds to the chest remind me of a crime of passion. Was she thinking of her husband while stabbing young Gannon?
Before I started watching the trial, I thought she was probably abusing him. This particular time the abuse went too far, and she felt the need to cover it up. As I hear the injuries that poor Gannon suffered, I can't help but think there is more than abuse going on. I am thinking she wanted to get rid of him either as revenge or jealousy. The location of the stab wounds are right where the heart is. When he didn't die right away, she retrieved a handgun. With this kind of mindset, I start thinking maybe she is crazy because only someone out of their mind could plot and act out such brutality on an innocent child. I hope there isn't a juror thinking like that, and she gets away with this.
I think each time she attacked Gannon, whether with knife, gun, or blunt object, she had her husband in mind.

What do Gannon’s accidents have to do with anything? Why the focus? I’m infuriated by these degrading questions. As someone upthread once said, it’s like killing Gannon all over again.
