Custody hearing Thursday concerning Kelsey Berreth's child
The man locked up for allegedly murdering his fiancee is expected in court Thursday for a hearing over the couple's young daughter.

The custody hearing starts at 1 p.m. in Teller County. 11 News is waiting to hear if this hearing is more of a formality whenever a child is taken from their home, or if this was already set in motion by the couple before Berreth's disappearance.

Folks have been reaching out saying stations are reporting the custody hearing involving Patrick Frazee and Kelsey Berreth is not on the docket. We checked and it still appears to be there and is scheduled for 1:00 p.m. Kelsey Berreth’s name no longer appears on it.

The Berreth family just left the courtroom. Just a couple of minutes ago they were in the same room as Patrick Frazee. Inside the courtroom was Frazee’s mom as well.

Reporter says that PF's mother also attended the hearing.

Patrick Frazee appears for custody hearing in Teller County
Both Patrick Frazee and Cheryl Berreth, the mother of Kelsey Berreth, appeared in court Wednesday afternoon for a custody hearing regarding Frazee’s 1-year-old daughter.

KOAA will continue to investigate and will have the full report tonight at 5:00 pm.

Update: After having a hearing Thursday for temporary custody of Patrick Frazee and Kelsey Berreth's only one-year-old daughter, Kaylee, we are learning more about the case.

While KRDO crews are waiting to hear the outcome of the ruling from the judge, we captured police escorting Frazee to a police vehicle.

A grieving mother faced off with the man accused of killing her daughter in a Colorado courtroom on Thursday.

Cheryl Berreth appeared at the Teller County Courthouse for an emergency custody hearing regarding her granddaughter Kaylee, whose mother Kelsey has been missing since Thanksgiving and is presumed dead.

She was joined by Patrick Frazee, the former fiance of her daughter and Kaylee's father who on Friday was charged with first-degree murder in the death of Kelsey Berreth.

Frazee arrived in the courtroom wearing his prison clothes and looking disheveled while a steely Cheryl kept her composure as she at one point stared down the accused killer.

She arrived in court with her husband by her side as the couple prepared to take custody of their granddaughter.

Frazee was the first to leave after the hearing, exiting the building shackled and in cuffs before being whisked off in a police car.

The Berreths left a short time later and remained silent about the proceedings despite being surrounded by members of the media.

Frazee remained silent throughout the hearing, refusing to speak even during the few times he was addressed by the court.

On December 21, 2018 the court granted a Temporary Emergency Custody Order made by Teller County Department of Human Services (TCDHS) placing the minor child in the temporary physical custody of maternal grandparents and legal custody of TCDHS. As required by law a Preliminary Protective Proceeding was held on 12/27/18. TCDHS caseworkers were present with Special County Attorney Steve Zentz. The court appointed attorney Lindsey Parlin to represent father and a guardian ad litem was appointed to represent the best interests of the minor child. TCDHS, father and guardian ad litem requested the hearing be closed to the public. The court made finding under CRS 19-1-106 that it was in child’s best interest to close hearing. The maternal grandparents were added to the case as special respondents. Paternal grandmother file a motion to intervene. The parties agreed to reserve for later hearing paternal grandmother’s motion to intervene and placement request. The court continued the temporary custody of the minor child with maternal grandparents. The case is continued for a pre-trial conference on January 3, 2019 at 8:30 a.m

Judge says Berreth's parents will get custody of child
A judge decided Thursday afternoon Kelsey Berreth's parents will get temporary physical custody of Berreth and Patrick Frazee’s 1-year-old daughter but the Teller County Department of Human Services will retain legal custody.

On Thursday, Berreth's mother and Frazee's mother declined media interviews.

It's not clear when the custody motion was filed with Teller County. Berreth's parents were added to the case as special respondents. Frazee's mother filed a motion to intervene, according to minute order summary. The case is continued for a pre-trial conference on Jan. 3.

At the time of Frazee’s arrest, the child, who was safe, was put in protective custody and would be reunited with Berreth’s family, Woodland Park Police Chief Miles De Young said on Dec. 21.

A few days before the fiance’s arrest, De Young said they had been in contact with the Teller County Department of Human Services in regard to the baby’s custody. At that point, he said the department didn't have any evidence that the child’s safety was at risk with Frazee.

Kelsey Berreth's parents granted temporary custody of her 1-year-old daughter
On Friday, a court granted temporary physical custody of the girl to her maternal grandparents and legal custody to the Teller County Department of Human Services. In a preliminary protective proceeding Thursday, the court continued the temporary custody arrangement.

Frazee and a lawyer were present at Thursday's hearing, which was closed to the public.

A pre-trial conference in the custody case will be held January 3 at 8:30 a.m.

Patrick Frazee, 31, appeared in court Thursday for the custody hearing, which was closed to the public at the request of all parties, according to a summary of the proceedings posted online. Police arrested Frazee on suspicion of first-degree murder and solicitation to commit first-degree murder on Dec. 21 after weeks of searching for his fiancee, Kelsey Berreth.

The girl, K, has been with Berreth’s family since the arrest, though Teller County Department of Human Services has maintained legal custody of the child, according to the document.

The court postponed a final decision after Frazee’s mother, the girl’s grandmother, filed a motion in the custody case. The custody case will be back in court at 8:30 a.m. on Jan. 3, and the girl will stay with Berreth’s family in the meantime.

Patrick Frazee Appears In Court For Custody Hearing
Frazee’s mother, Berreth’s parents, and TCDHS caseworkers were in attendance at Thursday’s hearing.

The hearing was required following the Teller County Department of Human Services’s order declaring the child in the department’s legal custody a week ago. The department subsequently placed the child in temporary custody of Berreth’s parents.

The criminal case against Frazee continues on Monday and the judge has ruled cameras will be allowed in the courtroom. Frazee faces murder charges in the case. His home in Florissant and her home in Woodland Park have both been searched extensively.

Parents of Colorado woman feared dead granted temporary custody of her daughter
Kaylee had already been in the care of her maternal grandparents after the court granted them a temporary emergency custody order on Dec. 21, the same day the girl’s father Patrick Frazee was arrested and charged with murder. The child had been with Frazee until his arrest.

The Teller County Department of Human Services will maintain legal custody of the child, Colorado Supreme Court spokesman Rob McCallum said on Thursday. The court will make a final decision on who is awarded custody of the child during a pre-trial conference on Jan. 3.

Day Before He Was Arrested in Case of Missing Fiancée, What Colorado Dad Told a Client
The day before his arrest in the murder of his still-missing fiancée, a Colorado man gave no indication that he was worried.

To the contrary, Patrick Frazee thought that as the investigation ramped up and calls flooded his cell phone, client Clinton Cline might have trouble getting through — and so Frazee reached out first, sharing a new cell number with Cline, who worked alongside Frazee to care for a protected herd of wild donkeys in the small town of Cripple Creek.

Another client of Frazee’s, Sonja Oliver, who trusted the care of her horses to him for five years, spoke to reporters before his arrest attesting to Frazee’s good character. But she tells PEOPLE the accusations made public against him have since changed her mind. “We all know what happened now,” she says.

While authorities have declined to discuss the couple’s custody arrangement, Cline says Frazee was the primary caretaker for their daughter — and would have had no reason to know immediately that Berreth had gone missing.

He also contends that Berreth had disappeared on other occasions and returned. Police have not confirmed any such incidents from Berreth’s past.

Colleague of fiance arrested on murder charge speaks
Cline is president of the Two Mile High Club, a group Frazee has worked with for the last six to seven years. He says Frazee came off as professional, dependable and a good father to the couple's 1-year-old daughter.

Cline wants to withhold judgment until the evidence in the murder is made public.

Judge says Berreth's parents will get custody of child
UPDATE (Friday, 8:45 a.m.) — According to new documents released Friday morning, Senior Deputy District Attorney Jennifer Viehman, on behalf of the people of Colorado, objected to unsealing the arrest warrant before Patrick Frazee is formally charged, which is scheduled to take place Monday morning.

That motion was granted in court.

In the motion, Viehman said she believes that the disclosure of the information from the warrant could “seriously jeopardize the physical safety of potential witnesses in this investigation.”
