Kelsey Berreth’s fiancé Patrick Frazee formally charged with murder
The charges indicate that authorities believe Frazee conspired with at least one other person to kill Berreth. The multiple solicitation charges suggest he engaged someone or multiple people to kill Berreth on three occasions.

Woodland Park Police Chief Miles De Young has said investigators recovered enough evidence at Berreth’s home to convince them that is where she was killed.

Court records indicate she was killed on Thanksgiving Day, but the arrest affidavit is sealed and few details are available about the evidence pointing to murder.

Although Berreth’s cellular phone was discovered in southern Idaho, authorities have indicated someone other than her took it out of state.

The murder solicitation charge means that someone else was involved in the crime but so far Frazee has been the only one who has been charged. To be charged with solicitation, the suspect did more than just ask someone to commit a murder on their behalf, Fourth Judicial District Attorney Dan May has said.

Murder charges filed against man in case of missing Colorado mom - CNN
Frazee showed no emotion in the Teller County Court in Cripple Creek on Monday morning.

He was charged with two counts of murder in the first degree and three counts of solicitation to commit murder in the first degree, District Attorney Dan May said.

Prosecutors filed two murder charges because they have different theories. One says he acted alone to kill Berreth, and another says he alone or with other people killed her during a robbery.

The three solicitation charges refer to soliciting the murder in three separate incidents. It could mean he solicited the same person three times or three people on different occasions.

During the hearing Monday, little information was given out -- Judge Linda Billings-Vela mostly issued rulings on preliminary motions that were filed by the defense and prosecutors. Those motions included requests to preserve information from law enforcement, limit media coverage of the court proceedings, limit the DA's contact with media, and to get the probable cause affidavit that contains the reason for Frazee's murder charge.

Billings-Vela agreed to partial preservation of law enforcement communications (with the exception of thousands of routine emails/text messages), shot down the defense's request to shut out media completely, and said the DA's office can continue hosting press conferences and releasing information through Twitter/Facebook. One piece of evidence was introduced that may be destroyed during testing, and the prosecution team filed a motion to say it's waiting for more information before officially introducing it.

But Frazee's attorney, Adam Steigerwald, said it was impossible to represent his client when the state wouldn't release the probable cause affidavit outlining the case against Frazee. Prosecutors said they would release the affidavit to Steigerwald Monday, but said he couldn't discuss the document with Frazee.

That brought an obvious objection from Steigerwald.

Billings-Vela questioned the move, and called it a "direct tension with the Sixth Amendment."

"How’s counsel supposed to start preparing if he can’t even discuss the information he’s receiving?" Billings-Vela said. "I’m well aware there are multiple investigations, and I want to make sure they’re not hampered, but Frazee has the right to be represented by counsel who can inform him."

Prosecutors asked for a hold of seven to 10 days before Frazee could see the affidavit, but that matter, along with the motion about the evidence testing, will be discussed at a hearing this coming Friday at 1:30 p.m.

Regardless, Dan May said that the affidavit would be released to the public pending a judge's ruling by Jan. 29, when Frazee will have his next preliminary hearing. That affidavit will shine a light on both the reason for the murder and solicitation charges.

At this time, no other suspects or persons of interest have been identified.

Prosecutors file charges against Patrick Frazee in connection with disappearance of Kelsey Berreth
Judge Linda Billings-Vela ruled that Frazee's arrest affidavit will remain unavailable to the public, but the defense will be able to look at it.

The next hearing in the case will be Friday at 1:30 p.m. During this hearing, the court will discuss a motion regarding consumptive testing, which is testing in which a piece of evidence must be destroyed in order to obtain information from it. They'll also discuss a motion to make the arrest affidavit available to Frazee himself.

Evidence and testimony will be presented at a preliminary hearing on January 29 at 9 a.m. Frazee will be required to enter a plea after that. After Frazee enters the plea, the prosecution will have nine weeks to determine whether or not they will seek the death penalty.

In a news conference following a hearing to present Patrick Frazee with formal charges in the murder case against Kelsey Berreth, who has been missing since Thanksgiving.

As CrimeOnline previously reported, Frazee was formally charged with five counts on Monday morning: Two counts of first-degree murder and three counts of solicitation of first-degree murder. Teller County District Attorney Dan May explained the multiple charges at a news conference following the hearing, pointing out that the two counts of first-degree murder were based on evidence supporting two theories; that Frazee premeditated the murder of his fiancee and mother of his 1-year-old daughter, and that Frazee killed Berreth during an attempted robbery, also premeditated.

In response to reporter questions about the three separate solicitation charges, May said he could not publicly identify any individuals associated with those charges, but said they were not based on separate theories. May said the three charges were “self-evident,” insinuating but not explicitly stating that they may refer to more than one person Frazee allegedly solicited in a conspiracy to murder Berreth, who has not been seen since Thanksgiving Day. At minimum, the charges appear to reference three separate incidents of solicitation although the number of individuals involved is not clear.

A charging document says Frazee is accused of working to find someone to kill Berreth between September and November and causing her death on or about Thanksgiving.

Frazee has said the two met at that time to exchange their 1-year-old daughter.

No other details were provided and the document laying out the evidence against Frazee remains sealed.

"The reason why the affidavits are sealed at this point is because this is an ongoing criminal investigation," Teller County Senior Deputy District Attorney Jennifer Vemen said. "There are multiple leads that law enforcement needs to follow up on and it's extensive."

The prosecution also revealed that the arrest warrant in the case must remain sealed, noting that publication of the details could 'seriously jeopardize the physical safety of potential witnesses in this investigation.'

Frazee and his lawyers will see that warrant for the first time on Monday afternoon, and may after that decide to enter a plea in the case.

Curious one theory maybe during a robbery ...... I don't think it was likely ....... how many robbers who kill while robbing and then would remove the body and then hide it so well????

Maybe I wrong here with my thinking but don't robbers usually go into a place to rob not murder. If they were surprised and it was accidently wouldn't they just run????

Colorado man charged with murdering his missing fiancée
A charge sheet released Monday suggests that Frazee may have ordered a robbery between Sept. 1 and Dec. 1, which resulted in Berreth's murder. Under Colorado law, if a person dies during the commission of a crime, that is equivalent to murder, 4th Judicial District Attorney Dan May said during a press conference on Monday.

“Obviously, there’s only one murder in this case. Under Colorado law, we file separate counts under different theories of first-degree murder,” May said.

May said the law requires the prosecution to differentiate between its theories of murder. One theory from the prosecution says Berreth was killed during the commissioning of a crime. The other says Frazee premeditated the killing of Berreth.

Because the case is still being investigated, and it is possible other people could be charged in Berreth's disappearance, all affidavits in the case are still sealed. Because of this, it is unclear what evidence the prosecution has against Frazee.

However, May said the judge overseeing Frazee's case has seen the arrest affidavit and believes there is probable cause to charge Frazee with first-degree murder.

May declined to specify if Frazee allegedly conspired with one or more people and the charges do not specify who those people might be.

Prosecutors file charges against Patrick Frazee in connection with disappearance of Kelsey Berreth
May said two motions that will be discussed at a future hearing, including one sealing the probable cause affidavit from Frazee for a week.

"This is an ongoing criminal investigation with multiple leads that law enforcement needs to follow up on, and it's extensive, so we are asking that that be sealed at this point until those leads can be followed up on," Jennifer Viehman, with the 4th Judicial District Attorney's Office said.

Right now the judge has the documents suppressed, meaning the defense has access to them, but the public does not, and Frazee can't look at them either.

Another motion discussed Monday by the prosecution was for consumptive testing, which means they have evidence so small, that it can only be tested once without it being destroyed.

"Any time there is a very small amount of evidence, the lab will tell us that they cannot complete the testing without it being consumptive," Viehman said. "We then notify the defense and the defense has an opportunity to send an expert and someone along to observe that testing."

The next hearing in the case will be Friday at 1:30 p.m. During this hearing, the court will decide on the two motions put forth by the prosecution on Monday.

The Colorado Public Defender’s Office, which represents Frazee, declined to comment, citing its standing policy of not commenting on pending cases outside of court.

Teller County District Judge Linda Billings-Vela set a motions hearing for Friday, and a one-day preliminary hearing for Jan. 29, state court spokesman Jon Sarche told Reuters by phone.

Frazee could face the death penalty or life in prison without the possibility of parole if he is convicted of first-degree murder.

Missing Colorado Mom Kelsey Berreth’s Ex Charged With Murder-For-Hire Plot
The first charge states Frazee murdered Kelsey after deliberation and with intent, while the second suggests Kelsey died during the execution of a second crime. Court papers state that Frazee, and possibly another person or persons, allegedly tried to rob Kelsey before she died.

Prosecutors also allege Frazee tried to enlist someone to murder Kelsey on occasions between September and November of 2018, according to the documents.

Kelsey was killed on Thanksgiving Day, the court papers indicate, though few other details are available on what happened. Arrest affidavits in the case are sealed.

Days before Christmas, Woodland Park Police Chief Miles De Young told reporters that investigators believe Frazee killed Kelsey at her townhouse. Kelsey is presumed dead, though her body hasn’t been found, he said.

“Our work is just beginning,” De Young told reporters. “You will be seeing a great deal of law enforcement activity in our community in the coming days and even weeks as we continue our relentless pursuit of justice for Kelsey and her family.”

De Young said cellphone records and other data led to Frazee’s arrest, as well as multiple searches of Kelsey’s and Frazee’s homes.

Asked whether cops could soon make additional arrests, De Young replied, “That’s an absolute possibility.”
