Petition seeks more charges in Kelsey Berreth case

The petition, which was formed by a group of concerned citizens, was submitted to the federal attorney’s office in Denver on Wednesday. It asks the justice department, as well as the Office on Violence Against Women, to bring conspiracy to commit murder charges against Krystal Kenney and all of the other people she referenced in her interrogation with law enforcement.

As of 11:30 a.m. Thursday, the petition has gained nearly 2,000 signatures. News 5’s Sam Kraemer is sitting down with some of the people that started the petition and will have more tonight on News 5 at 10.

Evidence released in the preliminary hearing also suggested some people close to Kenney had an understanding of the murder Frazee was trying to get her help with. For example, just before she drove down to clean up the scene, Kenney switched cars with a close friend before making the drive to Colorado.

Media interviews with Kenney’s friends also indicate she told close friends about the crime. Michelle Stein told CBS News that Kenney disclosed her role in the murder to Stein. No one, including Kenney, alerted police to the crime, even in the months before as it was planned.

Police spent $80,000 on landfill search for Berreth’s remains

The City of Woodland Park spent $80,000 in the search for Kelsey Berreth’s remains at the Midway Landfill south of Colorado Springs.

The supplemental appropriation was approved by the city council during its meeting on Thursday.

That money covered the bulk of the operation — equipment, fuel, food, personnel (and overtime) and more — according to Woodland Park Police Chief Miles De Young.

In the case of Teller County woman Kelsey Berreth, who went missing late last year and is presumed dead, suspected to have been murdered by her fiance, Florissant rancher Patrick Frazee, due process has become a textbook example of how law enforcement and our legal system should act. From the outset of the case, Woodland Park Police Chief Miles de Young and Dan May, our District Attorney, have been scrupulously cautious about safeguarding due process by following the letter of the law.

Though many will naturally speculate in sensational cases such as this, instinctively drawing conclusions and making inferences, our legal system is exacting and provides broad protections against abuse.

In that context, I spoke with Chief de Young concerning the case, and our conversation highlights this deep concern. “I have faith in our process and I’m willing to let this case grind through that legal process.”

The Chief raised a particularly important point in the case concerning the restrictions imposed on law enforcement. “When we initially spoke with (Frazee), the discussion was focused on Kelsey being a missing person. At that time, we couldn’t do a formal interview with him and sit him down as a Mirandized person; and as he subsequently retained a lawyer that froze the process. We took the time to work the landfill to be reasonably certain there was no evidence there. It was the right thing to do for all concerned.”

Judge bars cameras from Patrick Frazee court hearing because of publicity concerns – The Denver Post
A Teller County judge has barred TV and newspaper cameras from a court hearing scheduled Friday in the Patrick Frazee murder case claiming that extraordinary media coverage might impinge on his right to have a fair trial.

“This case has received extraordinary media attention. I have considered whether there is a reasonable likelihood that expanded media coverage would interfere with the rights of the parties to a fair trial,” Sells’ court decorum order says.

“I have determined that any expanded media coverage of the arraignment on May 24, 2019 would interfere with the rights of the parties to a fair trial and would create adverse effects greater than those caused by traditional media coverage,” he wrote

Sells’ order says that no expanded media coverage of any type will be permitted on Friday.

Judge will not allow cameras at Frazee arraignment hearing

Cameras were allowed in Frazee’s previously scheduled arraignment on April 5, when the hearing was delayed to allow investigators to test more evidence in the case. Cameras were also allowed in court on Dec. 31, 2018, when he was formally charged.

Woodland Park police said the investigation is still active and they are committed to bringing justice to Kelsey’s family.

Teller County District Judge Scott Sells said he made the ruling Wednesday because of "extraordinary media attention" on Patrick Frazee, saying he didn't want to compromise Frazee's right to a fair trail.

A trial date will be set if Frazee, 33, pleads not guilty in the case. He is scheduled to be arraigned before Sells at 8:30 a.m. in Cripple Creek.

A spokeswoman for the District Attorney's Office said she is barred from addressing the issue of plea negotiations, and the defense has cited a gag order in declining to field questions, making it unclear how Frazee intends to proceed.

The arraignment hearing has ended with Frazee entering a not guilty plea. There is another hearing involving Frazee happening at 9 a.m., but we do not yet know what information that will cover.

Frazee’s attorney is asking the judge to prevent live-tweeting and blogging inside the court during proceedings. He is also asking the judge to bar media from taking photos of Frazee walking into or out of court.

Judge Sells said he won’t decide on the request today.

Judge Scott Sells has already set a date for a motions hearing on June 14 related to consumptive testing of evidence in the case. Sells also set another motions hearing for Aug. 23, and his pre-trial readiness court date is scheduled for Oct. 18.

Man accused of killing local mom pleads not guilty
On Friday, Frazee pleaded not guilty to all felony charges at the Teller County courthouse in Cripple Creek, Colorado.

Frazee's next trial date has been set for October 28th at 8:30 a.m.

A consumptive testing hearing will take place on June 14th at 9 a.m. and a motions hearing is set for August 23rd at 9 a.m.

The trial is expected to last three weeks.

A second hearing happened on Friday right after Frazee's not guilty plea. The second hearing was on behalf of Cheryl Berreth, Kelsey Berreth's mom. Everyone not related to the case, including the media, was not allowed inside the courtroom.

Judge Scott Sells set the date for another motions hearing relating to consumptive testing of evidence on June 14. The hearing will decide how consumptive testing procedures will be handled. Until that hearing, testing will not be allowed. Prosecutors still have not disclosed which piece of evidence will undergo consumptive testing, which means the item can only be tested once due to the size or the material of the piece of evidence.

Sells also set a court date for an all-day motions hearing for Aug. 23 and his pre-trial readiness hearing on Oct. 18.

District Attorney Dan May said his office has nine weeks to decide if prosecutors will pursue the death penalty in this case. May said he will examine a list of statutory “aggravators” related to the death, meet with Berreth’s family and meet with the defense before making a decision about pursuing the death penalty.

The defense filed a motion to ban cameras, live-tweeting and blogging in the courtroom. They also asked that Frazee not be photographed while walking into court during future hearings.

Judge Scott Sells did not make a decision regarding future media coverage during Friday’s hearing. DA Dan May said his office did not state a position relating to restrictions of the media, however, he said media organizations will be able to state their case.

Patrick Frazee pleads not guilty in killing of Woodland Park mom Kelsey Berreth
A Teller County man accused in the bludgeoning death of his fiancee last Thanksgiving pleaded not guilty Friday, setting the stage for a closely watched murder trial in the fall.

The hearing on June 14 will determine whether investigators can destroy the evidence while testing it — a step usually required when the item in question is too small to survive testing, or if too little of it exists.

Friday's arraignment was followed by a 2½-hour hearing on conservators, which is different than a custody hearing in that it's usually held to appoint someone to represent a child or adult in ongoing legal matters.

Sells closed the courtroom to media and anyone not associated with the case, and details of that hearing — including the outcome — were not available Friday.
